PRIVACY, ASSUMPTION OF RISK AND RESPONSIBILITY, RELEASE & WAIVER OF LIABILITY, AND DECLARATION PRIVACY

Asian Real Estate Association of America – Greater Toronto Chapter & ICherish Foundation Inc (the "Event Organizers") keeps all personal information in strict confidence. We will use your information for event communication to send gift acknowledgements and to communicate Hospital and Foundation updates. We will never sell or trade your personal information. RELEASE AND INDEMNITY
1. In consideration for the acceptance of my application and the permission to participate in this Event, I hereby grant a full and final release and discharge to the Foundation its directions,  the sanctioning bodies, Markham Stouffville Hospital (the "Hospital"), The Corporation of the City of Markham , and the sponsors and sponsoring companies and their directions, and each of their successors, heirs, and assigns (collectively, the "Releasees") from any and all claims, demands, damages, costs, expenses, action and causes of action whatsoever both in law and in equity (each a "Claim") that I, my heirs, executors, representatives, successors, or assigns, or any of us now have or may have against, one or more of the Releasees, for or by reason of any cause, matter, or thing whatsoever arising out of or in any way related to the Event, including the equipment used during the Event (the "Equipment"), notwithstanding that the same may have been contributed to or occasioned by the negligence of any of the aforesaid.

2. And for the said consideration, I hereby further agree not to make any claim or take any proceeding in connection with any of the Claims released by virtue of this Agreement against any other person, firm, or corporation which might claim contribution or indemnity from any one or more of the Releasees by virtue of such claim or proceeding.

3. And for the said consideration, I hereby agree, with any other participant in the Event (each a "Participant"), to jointly and severally defend, indemnify and save harmless each of the Releasees from any Claim for which the Releasees or any of them may, now or in the future, become liable for, in respect of any loss, damage, injury, or death to any person or property resulting from or by reason of any act, negligent or otherwise, which is in any way connected with the Equipment and/or the participation of any Participant in the Event.

4. I hereby acknowledge that the Releasees do not accept responsibility for the safety of myself or any other Participant during the Event and hereby agree that it is the sole responsibility of myself and the other Participants to ensure that all necessary safety precautions are in place and that all Equipment is suitable and thoroughly checked prior to the Event. I hereby further agree that none of the Releasees shall be liable for any direct, indirect, incidental, special, consequential, or exemplary damages whatsoever arising in connection with this Agreement.

5. I hereby acknowledge that the Foundation and the Hospital and the Event Organizers reserve the right, in its sole discretion, to cancel or suspend part or all of the Event, or to remove any person from the Event, at any time or for any reason and acknowledge that the Foundation and the Event Organizers will not be responsible for any loss or damage suffered by myself or my heirs, executors, representatives, successors, or assigns, whatsoever resulting from such cancellation, suspension, or removal.

DECLARATION
1. I hereby grant to the Foundation and the Event Organizers the perpetual right to use my name, address (city and province), picture, portrait, likeness, and voice, without remuneration, at any time, and from time to time, in connection with any advertising and promotional publicity carried out by or on behalf of the Foundation with respect to the Event whether prior to, during, or after the Event.

2. I understand that my personal information shall be collected, used, and disclosed by the Foundation for the purposes stated in this Agreement or as required by law.
3. I acknowledge that the invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of the remaining provisions of this Agreement.
4. I acknowledge that I do not have the right to assign this Agreement.
5. I hereby declare that I have carefully reviewed the foregoing, that I fully understand its contents, and that I have entered into this Agreement of my own volition.
