Coaching, Workshop, and Masterclass events are non-refundable and non-transferable.


WORKSHOP AND COACHING ENROLLMENT

By registering and participating in a Bloom with Nadine, LLC Workshop or Coaching Session, you are agreeing to the following:



LIABILITY RELEASE AND WAIVER:

By registering for a Workshop or Coaching Session (“Event”) with Bloom with Nadine, LLC, you hereby agree to the following Waiver of Liability, Consent, and Release Agreement, agree to the:

1. I affirm that I have answered all the questions on this form honestly and fully disclosed all the information requested.

2. I am at least 18 years of age. I am voluntarily participating in the Event and accept complete responsibility for my own medical, health, mental, emotional, psychological, spiritual and bodily wellbeing. I recognize that the Event requires physical or mental relaxation as well as exertion, which may be both relaxing and strenuous and can cause beneficial physical (or other) changes and increased vitality as well as injury and unanticipated physical or mental challenges. I understand that it is my responsibility to consult with a qualified health authority (as determined by me) prior to and regarding my participation in the Event. I represent and warrant that I am adequately fit and of sound ability to take responsibility for my choice to participate in the Event. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured.

3. I understand that this Event is not therapy or psychological counseling and is not a substitute for the treatments or services ordinarily provided by health care professionals for physiological or psychological complaints. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the practices offered in this Event. I understand that the information and or practices offered are not a substitute for the treatments and or services ordinarily provided by health care professionals. If I need or desire medical treatment, therapy, or psychological counseling, I will seek it from a licensed provider. I understand that if I desire or need medical treatment, psychological counseling, or therapy during, or as a result of, my participation in the Event, I will not receive this from any of the Event staff. I confirm that I am well physically, psychologically, and emotionally, and commit to being responsible for my own well-being during, and after, the course of this Event.

4. I recognize that during the Event I will receive information including but not limited to health, meditative practices, interpersonal relationships, spirituality, healing, and sexuality. I recognize that I am participating voluntarily in practices pertaining to yogic sexuality, including the practice of masculine/feminine and sexual archetypes. I understand that I may be paired with practice partners I may not know and guided through practices including but not limited to sexuality, interpersonal relationships, masculine/feminine, energy, and spiritual connection. My decision to participate in this event is a personal decision. No one has made any promises or warranties as to the results or benefits I may receive or as to any specific results I may realize from my participation in this Event. I am committed to participating fully in this Event for the full duration. I understand that this includes being present for all sessions, completing all assignments, and supporting my fellow participants as requested. I understand that I am responsible for notifying a staff person if I choose to leave the Event prior to its completion.

5. I do, on my own behalf, my assigns, executors, guardians, and all other legal representatives, hereby release, discharge, waive, and forever relinquish the Event, Bloom with Nadine, LLC, Nadine Hamilton, and each of their agents, employees, officers, directors, program/workshop assistants, employers and any other person associated with the aforementioned persons and entities (collectively, the “Released Parties”), from any and all known or unknown claims resulting from, arising out of or in any way connected to the Event. I further agree that under no circumstance will I attempt to present any claims against, prosecute, sue, seek to attach any lien for any purpose including satisfaction of a judgment or other judicial decree, to the property of the Released Parties. I hereby waive all claims, demands, compensation and all actions that I or anyone associated with me currently or hereafter may have for any injuries or perceived injuries or perceived or real losses I may suffer or believe to suffer because of my attendance at the Event.

6. I understand and agree that in the event a third party were to bring any claim for damages against the Released Parties or any person associated with the Released Parties as a result of my actions, omissions, or other act, that I and/or my estate shall indemnify and hold harmless the Released Parties and all persons associated with the Released Parties from, any and all claims, actions or damages, legal and otherwise made by me or anyone associated with me including costs and expenses (including reasonable attorneys’ fees) associated with defending such actions or claims.

7. I am aware that there is no obligation for any person to provide me with medical care during, or after, the Event. I understand and acknowledge that: (a) there may be no aid stations available for the Event; and (b) if medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.

8. INTELLECTUAL PROPERTY: I understand that all materials used in this Event are confidential and proprietary in nature and other than for my own personal use, I will have no future right to these materials or processes in any way without express training, written permission, and licensing by Bloom with Nadine, LLC, Nadine Hamilton. I accept full responsibility for any product or material loaned to me as part of participation in this Event and commit to return the same in good working order. I explicitly agree not to teach any practices, lessons, or information in general that I experience/learn during my participation in the Event without written consent and agreement from Bloom with Nadine, LLC, Nadine Hamilton. I agree to not post on any public sites, electronically or physically, that I was trained and/or approved/certified to teach in the modalities taught by Bloom with Nadine, LLC, Nadine Hamilton unless I was given specific authorization to do so.

I understand that I am not allowed to record any video sessions of the Event from any of my electronic devices without explicit written and/or verbal consent from Bloom with Nadine, LLC, Nadine Hamilton. If I am given permission to record a session, I understand that I am not allowed to post any clips, stills, or any content in general from said recording on any social media sites or websites, including, but not limited to: Facebook, Twitter, Instagram, Pinterest, YouTube, TicTok, and any personal or public web pages. The sessions that I participate in are private and confidential and attendance is only permitted by the Event members who have paid tuition to participate in the Event.

For Online Events: I understand that I am not permitted to share any private login details for any of the Event sessions with individuals who have not paid for the Event - this includes inviting non-paid attendees to share a computer screen with me during the sessions. If the Event includes a private Facebook group, I understand that I am not allowed to share the private Facebook group with any individuals who are not associated with the Event. If it is found that I record sessions, share said recordings with others, share any call links or my screen with individuals who are not part of the Event, or share the private Facebook group, Bloom with Nadine, LLC, Nadine Hamilton will release me from the Event and can pursue legal action. I understand that if legal action is pursued I am liable for all legal expenses associated with any claims.

9. REFUND POLICY: All Workshop Events are Non-Refundable and Non-Transferrable. By registering for this Event, I’m voluntarily agreeing to pay the full amount of the Event regardless of whether I participate in the Event. If I leave the Event early, if I cannot begin the Event after committing to the Event, or if I am asked to leave the Event, I understand that any payment commitments will still continue. I understand that if I am on an installment plan, all installments must be paid in full even if I am no longer participating in the Event. I voluntarily commit to continue the installment payments until I have paid the balance of the Event in full.

10. FORCE MAJEURE: The Event and Released Parties are not liable for any failure to perform due to causes beyond our reasonable control including, but not limited to, acts of God, fire, flood, natural disasters, war or threat of war, acts or threats of terrorism, civil disorder, unauthorized strikes, governmental regulation or advisory, recognized health threats as determined by the World Health Organization, the Centers for Disease Control, or local government authority or health agencies (including but not limited to the health threats of COVID-19, H1N1, or similar infectious diseases), curtailment of transportation facilities, or other similar occurrence beyond control of the Event and Released Parties, where any of those factors, circumstances, situations, or conditions or similar ones prevent, dissuade, or unreasonably delay at least 90 percent of prospective Event attendees from appearing at the Event, or where any of them make it illegal, impossible, inadvisable, or commercially impracticable to hold the Event or to fully perform the terms of the Event Agreement.  If any of those circumstances arise, The Company (Bloom with Nadine, LLC) will automatically transfer your enrollment to the next Bloom with Nadine, LLC Workshop within a 1-year period.

11. EMAIL OPT-IN: By registering for this Event, I agree to subscribe to Nadine Hamilton's mailing lists to receive occasional newsletters and information about future events. I understand that I can opt-out at any time.

12. SPAM: I agree not to use the Event to grow my personal business and therefore agree to not solicit my business to any other participants in the Event or associated Events. If I am a coach, I explicitly agree not to solicit Event participants as clients and I agree not to form any outside groups with Event participants without written consent.

I understand that I am strictly prohibited from using this Event for illegal spam activities, including gathering email addresses and personal information from others or sending any mass commercial emails. I understand that I am strictly prohibited from adding Bloom with Nadine, LLC, Nadine Hamilton's internal email addresses to my email list without a specific request or opt-in by Bloom with Nadine, LLC, Nadine Hamilton, and their respective representatives.

13. PARTICIPANT CONNECTIONS: I understand that this Event is a sacred container for deep practice. As a participant of this Event, there may be times when I will be instructed to privately message or connect with other participants within the context of structured practices. I otherwise agree not to connect, flirt, hit on, privately message, or solicit other participants. I will not ask other participants for their personal contact information.

14. MEDIA RELEASE: The entire Event will be recorded. By choosing to participate in this Event, and interact with Nadine Hamilton during the Event (including but not limited to a Q&A session), you give your consent to be recorded and understand that these recordings may be used for future Bloom with Nadine, LLC, Nadine Hamilton programs and promotions. You hereby release The Released Parties from any and all claims and demands arising out of connection with any use of the Released Media, including without limitation, claims for privacy violations, right of publicity claims, defamation, and/or any other intellectual property rights. I claim no ownership of the Released Media and forego any opportunity, whether past or present, to copyright or trademark the Released Media.

The Released Media will include but is not limited to, all photographs, videos, sound recordings, and all other media currently known or hereinafter developed, captured of me or my likeness during the Event.

15. This Agreement contains the parties’ entire understanding relating to the subject matter contained therein and cannot be changed, modified, or terminated except by an agreement signed by both parties. I specifically agree that if any provision of this Agreement is found to be invalid or unenforceable in any jurisdiction, the other provisions herein shall remain in full force and effect in such jurisdiction and shall be liberally construed in order to effectuate the purpose and intent of this Agreement, and the invalidity or unenforceability of any provision of this Agreement in any jurisdiction shall not affect the validity or enforceability of any such provision in any other jurisdiction. This Agreement shall be interpreted, construed, and governed in all respects under the laws of the State of New Jersey, which state shall be the forum for any legal proceedings arising hereunder.




TERMS AND CONDITIONS:

You recognize that during the Masterclass you will receive information including but not limited to health, meditative practices, interpersonal relationships, spirituality, healing, and sexuality. You recognize that you are participating voluntarily in an event pertaining to spirituality or sexuality, including the practice of masculine/feminine and sexual archetypes. You confirm that you agree with this subject matter and practices.  

Although anyone may find these practices and/or teachings useful, they are made available with the understanding that we are not engaged in presenting specific medical, psychological, emotional, sexual or spiritual advice. There is no context for physical, psychological, emotional, sexual or spiritual abuse in these practices and/or teachings. Nor are these practices and/or teachings intended to be diagnoses, prescriptions, recommendations, or cures for any specific kinds of medical, psychological, emotional, sexual, or spiritual problems. Each individual has unique needs and these practices cannot take these individual differences into account. Each person should engage in a program of treatment, prevention, cure, or general health only in consultation with a licensed, qualified physician, therapist or other competent professional. Any person suffering from a sexually transmitted disease or any local illness of their sexual organs should consult a medical doctor and a qualified instructor of sexual yoga before practicing the sexual methods described in these practices and/or teachings.
