THIS IS A LEGALLY BINDING DOCUMENT. DO NOT SIGN UNLESS YOU AGREE TO BE BOUND BY THE TERMS.
In consideration and as a condition of being allowed to participate in Foam Dart Battles, Target Play, Scavenger Hunts, Summer Camp, Escape Room, or any other recreational activity provided by PANDAMONIUM, I hereby acknowledge and agree to the following terms:1. I am a competent adult aged 18 years or older.
2. In so far as this waiver and release of liability agreement (“agreement”) is signed by me on behalf of a child who is under the age of 18 years (“child,”) I confirm that the child’s full name
and age are printed below and that either (i) I am the parent/guardian of that child; or (ii) where I am not the parent/guardian of that child, I certify that the child’s parent(s) or guardian(s) (as the case may be) of that child has(/have) granted permission for me to assume responsibility for that child (“Responsible Adult”) and for me to have the right to sign this agreement on their behalf.
3. I acknowledge that this agreement will be used by PANDAMONIUM and will govern my actions and responsibilities while participating in (or, if applicable, while the child participates in) the Foam Dart or Recreational Activities at Pandamonium.
4. My (/the child’s) involvement and/or participation in the Foam Dart or Recreational Activities event is voluntary, and I am acting under my own free will (on behalf of the child in my capacity as parent, guardian or Responsible Adult, as applicable).
5. I acknowledge that my(/the child’s) participation in theFoam Dart or Recreational Activitiesmay be physically demanding and mentally intense and may require extreme exertion to play and that the possibility of injury to my(/the child’s) and others exists, including the potential for trips, jumping into walls, slips falling over and other common physical injuries, eye injuries, bodily injury, permanent disability, paralysis and loss of life. I also acknowledge that such risks cannot be eliminated entirely without jeopardizing the essential qualities of Foam Dart or
Recreational Activities and that while particular rules, equipment and self-discipline may reduce the risks, the risk of injury does still exist.
6. I acknowledge that there are potential for risks and dangers that may not be obvious or reasonably foreseeable at this time.
7. I agree to accept and assume all of the risks of participating in (/the child participating in) Foam Dart or Recreational Activities including by way of example and not limitation, any and all risks that may arise from the acts and omissions of other participants in Foam Dart or
Recreational Activities, the negligence or carelessness on the part of PANDAMONIUM, from
dangerous or defective equipment or property owned, maintained, or controlled by them or others, or because of their possible liability without fault.
8. To reduce the risks, I agree (on behalf of the child as parent, guardian or Responsible Adult, as applicable) to follow (and, if applicable, procure that the child follows) the rules established for participation in Foam Dart or Recreational Activities.
9. I confirm that I have read (and/or have had read to me), understand and will follow (and, if applicable, procure that the child follows) the rules established for participation in Foam Dart or Recreational Activities and the reasonable instructions given to me by PANDAMONIUM.
10.I confirm that the child is fit both physically and mentally to participate in Foam Dart or Recreational Activities.
11. I confirm that the child will wear the eye protection and other safety equipment provided at all times within the gaming areas.
12.I understand that failing to comply with any rules stated verbally as well as written documents will result in ejection from the chosen activity and no refunds will be offered.
13.I confirm that I and the child will always follow the instructions of the PANDAMONIUM Staff and Referees.
14.I understand that I or the child must not climb on any of the structures, inflatables or buildings
within the gaming areas nor will we move the structures or boxes.
15.I accept full responsibility for any item or device loaned to me for the purposes of Foam Dart or Recreational Activities provided by PANDAMONIUM, and I commit to return them in the same working order. I or now one that I have taken responsibility for, will throw or purposely drop any device or safety gear.
16.I understand that all equipment used for game play can vary from recommended use for 4 years to 14 years plus, and that any of those can be used during game play. However, I also fully understand that my group must use the equipment designated for the youngest participant in our group and that there are NO EXCEPTIONS to this rule. I understand that we have the option to split the session in half so that the varying age groups will not participate at the same time and that children 13 and under must be supervised by a responsible adult in the party at all times.
17.I understand that I or the child may decline to participate in any part of Foam Dart or Recreational Activities at any time. I also understand that if I decline to play it does notconstitute grounds for refund.
18.I confirm that I have read the rules and the safety instructions provided by PANDAMONIUM and that I have explained them to the child or children in my care and we agree to follow the
rules and guidance presented therein.
19.I certify that I have (/the child has) no medical conditions or health concerns that make it dangerous to participate in Foam Dart or Recreational Activities in a safe manner for myself
(/himself or herself) or others and that if I have any concerns in this regard, PANDAMONIUM
has been informed or will be informed prior to my(/the child) undertaking in Foam Dart or
Recreational Activities.
20.I accept sole responsibility for my own (/the child’s) conduct and actions while participating in Foam Dart or Recreational Activities.
21.I agree, to the full extent permitted by law, to waive, release, and discharge PANDAMONIUM, the owners of the property on which Foam Dart or Recreational Activities are held and any other players who might injure me however arising from any and all liability for my death,
disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me(/the child, as the case may be) as a result of participation in Foam
Dart or Recreational Activities.
22.I agree (/on behalf of the child, if applicable) to indemnify, hold harmless and promise not to
sue (and, if applicable, procure that the child shall not sue) PANDAMONIUM, the owners of
the property on which Foam Dart or Recreational Activities are held and any other players who might injure me however arising for any and all liabilities or claims arising as a result of participation in Foam Dart or Recreational Activities incidental thereto, wherever, whenever, or however the same occur, whether caused by negligence or otherwise.
23.I confirm that I am 100% liable for all medical expenses incurred as a result of any injury or property damage during participation by myself(/the child.) in Foam Dart or Recreational Activities.
24.I consent and agree that PANDAMONIUM may take photographs or digital recordings of me(/the child) participating in Foam Dart or Recreational Activities and use these in any and all media for training, promotional or other safety purposes. I further consent that my identity
(and, if applicable, the child’s entity) may be revealed therein or by description, text or commentary. I waive any rights, claims or interest to inspect or approve the use of the
photograph and/or recording with respect to myself (and, if applicable, the child), and understand that there will be no financial or other remuneration of any kind.
25.I consent to receive (/for the child to receive) treatment that may be deemed advisable in the event of injury, accident, and/or illness as a result of my (/the child) participating in Foam Dart or Recreational Activities.
26.I agree that entering into this agreement indicates permanent waiver and release of liability
with respect to myself (and, if applicable, the child). I understand that this agreement will be
kept on file for future visits. I understand that if I wish to revoke this agreement I must contact
PANDAMONIUM and obtain their agreement to such revocation in writing.
27.I understand that this waiver, release of liability and image release is intended to be as broad and inclusive as permitted by the full extent of the law (with respect to myself and, if applicable, the child). I further understand and agree that if any part/s of this agreement are
held invalid the remainder will continue in full force and effect.
28.I CERTIFY THAT I HAVE READ THIS DOCUMENT AND FULLY UNDERSTAND ITS
CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.

required for all participants.
