The Euroa Horse Park Pty Ltd provides facilities for people to ride horses and acts as an agent for Equine Sports Breeding (ESB) and Euroa Agistment Centre (EAC). The following questions affect your legal rights and obligations. Please read these carefully and only complete these question if you fully understand their contents. For Participants under 18 years of age, these documents must be completed by a parent or legal guardian.

RISK WARNING: 

I (on behalf of myself and the above named persons) understand, acknowledge, and accept that horse sports and stud activities are dangerous and that horses can act in sudden and unpredictable ways, especially around breeding times or if frightened or hurt. These activities pose significant risks that may result in serious INJURY or DEATH. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Directors of the Euroa Horse Park Pty Ltd. I voluntarily participate at my own risk and assume sole responsibility for any injury, death or property damage I may suffer or cause that may arise from my participation in the activities organised by this entity. 

I agree to only ride the horse in a safe and controlled manner; wear an Australian Standard Approved helmet that is less than five years old and hasn’t been damaged; wear correct riding footwear or farm boots at all times; and to follow all signs on the property and all instructions. Back protectors are to be supplied by myself if I chose to wear one. 

I am aware that by my participation in any activities arranged by the Provider, certain risks or dangers may occur which could include:

·        Physical, bodily or psychological injury or death.

·        Physical exertion to which I am not accustomed.

·        Failure of equipment or use of inadequate equipment.

·        There may be no or inadequate facilities for treatment or transport to treatment if I am injured.

·        The conditions in which the activities are conducted may vary without warning.

·        I may cause injury to other persons and/or other persons may cause injury to me.

·        I may be injured or die due to the negligence, breach of contract or breach of statutory duty or guarantee of the provider.

Participant’s Warranties

I declare that I am medically and physically fit and able to participate in the Activities.  I acknowledge that I must, and agree that I will, disclose any pre-existing medical or other condition, injury or concern that may affect the risk that either I or any other person will suffer injury, loss or damage during the course of the Activities and notify the Provider of any injuries, illness or concerns that may arise during the Activity.  I will not engage in any reckless, negligent or foolish behaviour or any other behaviour that is likely to cause injury to me, any other participant or person.

I agree that if I suffer any injury or illness, the Provider may provide evacuation, first aid and/or medical treatment at my expense and that my acceptance of these terms and conditions constitutes my consent to such evacuation, first aid and/or medical treatment.

I declare that I have not consumed any alcohol or mind altering substance, or medication that may impact my judgement or physical capacity, before or at the time of engaging in the Activities.

BIOSECURITY QUESTION: I understand that outbreaks of endemic or exotic diseases such as Equine Influenza are possible and that Government authorities may quarantine, restrict or prevent the movement of horses, vehicles, equipment and personnel for a period of time. I acknowledge and agree that such action is in everyone’s best interests and shall comply with all directions given from organisers and officials and shall pay for any additional costs incurred as a result of such an incident. Have you been in contact with horses showing any signs of illness or disease in the last 48 hours? *
SAFETY: I agree to wear and ensure any others visiting with me wear, an approved helmet, suitable clothing and footwear at all times whilst participating in activities and agree that I am solely responsible for ensuring that any saddlery, gear and equipment is safe, well-kept and in good order. I also understand and acknowledge the additional dangers associated with the consumption of alcohol or any mind altering drugs before and during the activity and I take full responsibility for any injury, loss or damage associated with their consumption. *
COVID-19: I agree not to enter the property if experiencing cold or flu like symptoms. I agree to follow the current protocols recommended by the State and Federal Governments as stated - https://www.health.gov.au  I understand and acknowledge the risks involved in having contact with people and I take full responsibility for any loss, sickness or expense associated with my actions. *
Risks:

I agree to follow the directions of any event organiser or official and that any wilful or unorganised pursuit, misconduct or refusal by me to follow any direction of an organiser or official can result in the cancellation of my participation in the event and my immediate removal from the property. I understand that any such non-compliance may result in injury, death and/or permanent disability and I agree to indemnify the organisers and property owners against all claims made by any person as a result of my failure to comply. 

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless and agree not to sue the Euroa Horse Park Pty Ltd, any event organiser, their officers, officials, volunteers, coaches, agents and/or employees, other participants, sponsoring agencies, sponsors, state bodies, affiliated clubs and if applicable, owners and lessors of the premises used to conduct the activities with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by the negligence of them or otherwise.

Exclusion of liability

I agree to and unconditionally release, waive, discharge and forever hold harmless, the Provider or any of its employees, agents, directors or officers, from any claims as a result of any personal injury sustained, whether caused by the Provider’s negligent act or wilful act or omission, breach of contract, breach of statutory duty, error, or otherwise in connection with or arising out of the Activities.

I agree that the Provider will not be liable for any claims for personal injury that may be brought against it as a result of or in connection with any act, omission, default, failure or error on the part of the Provider, and agree to indemnify and keep indemnified the Provider in respect of any such claims. 

I have had sufficient opportunity to read this release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by completing this online form, I am doing so freely and voluntarily without inducement of any kind. 

I understand that my agreement to this document constitutes a complete and unconditional release of all liability to the entities and their associated parties in the greatest extent allowed by law in the event of me and/or the other parties and children under my care and jurisdiction, suffering injury or death.
