Acknowledgement, Release of Liability, Waiver of Claims, and Indemnity
This release affects your legal rights. Please read carefully before signing below.

Note:  If I am under 18 years of age, I understand that while I am bound by the provisions of this Agreement and must acknowledge and agree to its terms, I am not permitted to execute this Release or use the Bicycle and other Company Equipment without approval of my parent or legal guardian, who must sign this Release on my behalf.

I, ("Lessee"), in consideration of the services of Company, their agents, owners, employees, and all other persons or entities acting in any capacity on their behalf acknowledge and agree as follows:

A. Lessee understand and acknowledge that bicycling is a hazardous activity and entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks cannot be eliminated by Company without jeopardizing the essential qualities of this activity. The risks include among other things: falling, collision with highway or roadway vehicles, striking obstructions or other person, unsafe speed of travel for conditions, equipment failure, and weather conditions including temperature exposure (hypothermia, sunstroke, sunburn, heat exhaustion and dehydration).

B. Lessee Assumes Risk of Injury. Lessee knowingly, intelligently and voluntarily assumes all risks, including but not limited to death or serious bodily injury, which may result from the operation of the Bicycle. Lessee acknowledges all the risks of operating a Bicycle on streets, roads, bike paths, bike lanes, and in traffic, including but not limited to the risks of serious bodily injury or death from falling off the Bicycle, colliding with other Bicycles, motorcycles, motor vehicles or other objects, hitting potholes, or suffer sudden loss of control from flat tires due to unseen objects puncturing or damaging tires, or brakes failing, and hazards relating to weather conditions. Despite knowing all associated risks, Lessee freely assumes all risks of personal injury and/or damage in the operation of this Bicycle and Lessee agrees - hold Company harmless from all claims of injury or damage.

C.  I agree knowingly, intelligently and voluntarily agree to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

D. Lessee hereby agrees to defend, protect, indemnify and hold harmless Company from, all claims, actions, proceedings, costs, damages, and liabilities, including attorney's fees, arising out of, in any way connected with, or resulting from my participation in this activity or my use of the leased equipment, including without limitation the possession, use, operation, or return of the equipment, including any such claims which allege negligent acts or omissions on the part of Company.

E.  Should Company or anyone acting on its behalf; be required to incur attorney's fees and costs to enforce this Release, I shall indemnify them and hold them harmless for all such fees and costs.

F.  I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I understand and agree that any insurance coverage I maintain, whether liability, casualty, personal or health, shall constitute the primary coverage in the event of any loss, injury, death, or damage to person or property while using or operating Company equipment. I further certify that I have no medical or physical conditions that could interfere with my safety in this activity, or else I am willing to assume all liability, damages or costs that may be created, directly or indirectly, by any such condition.

G.  I acknowledge and agree that it is my obligation to make any necessary inquiries to the Company regarding my ability, physically or otherwise, to safely use and operate the Bicycle and that, prior to executing this Release, I have been provided the opportunity to inquire and discuss the possible risks and hazards to me resulting from my use and operate the Bicycle. Any questions I had regarding my ability to participate in the Program have been answered to my satisfaction, and I have received sufficient information to make a sound and voluntary decision to participate in the Program.

Please pay particular attention to the following paragraphs regarding your risk liability:
In consideration of my rental and use of the Bicycle and other Company equipment, and having reviewed and agreed to all acknowledgements listed in paragraphs A through G above of this Release as detailed above, I do, for myself and for my personal representatives, heirs, and next of kin, agree to assume all the risks and responsibilities of renting and using the Bicycle and other Company equipment. I release and forever discharge and covenant not to sue the Company, and its officers, directors, managers, employees, representatives, agents, and contractors ("Releasees") from and against any and all liability for any and all claims, demands, actions, causes of whatever kind or nature, costs and expenses of any nature, including attorneys' fees ("Claims"), that I may have or that may hereafter accrue to me, arising out of or related to any harm, loss, damage or injury, including but not limited to suffering, death, or property loss that may be sustained by me, whether caused by my action or negligence or the action or negligence of Releasees or third parties in connection with my rental and use of the Bicycle and other Company equipment. I also agree not to sue Releasees in connection with any such harm, loss, damage or injury. I agree to indemnify and hold Releasees harmless from and against all claims asserted against any of the Releasees by any entity based upon my rental and use of the Bicycle and other Company equipment whether caused by the negligence of the Releasees or otherwise.

LESSEE HEREBY KNOWINGLY, INTELLIGENTLY AND VOLUNTARILY WAIVES THE RIGHT LESSEE, OR ITS AGENTS, MAY HAVE A TRIAL BY JURY IN RESPECT TO ANY LITIGATION BASED ON HEREON OR ARISING OUT OF, UNDER, OR IN CONNECTION WITH THIS RELEASE OR ANY COURSE OF CONDUCT, COURSE OF DEALING, STATEMENTS (WHETHER VERBAL OR WRITTEN), OR ACTIONS OF ANY PARTY RELATING TO THE SUBJECT MATTER OF THIS RELEASE. THIS PROVISION IS A MATERIAL INDUCEMENT FOR THE PARTIES TO ENTER INTO THIS RELEASE.
The undersigned Lessee, by my signature below, hereby represent, warrant, and affirm that:  (a) I am mentally competent to enter into this Release; (b) I have carefully read this Release and fully understand all terms, conditions, and provisions herein; (c) I understand that I am legally bound by this Release; and (d) I in assuming all liability for possession and operation of the rental property and I assume all such risk and liability voluntarily, intelligently, and knowingly.
