THIS AGREEMENT is made and entered into by and between Dark Castle Haunted Attraction, its owners, officers, directors, employees, agents, affiliates, successors, and assigns (collectively, "Dark Castle"), and the undersigned individual ("Volunteer").
IN CONSIDERATION for being allowed to participate as a volunteer in any capacity for Dark Castle Haunted Attraction, the undersigned Volunteer agrees as follows:
1. Acknowledgment of Risk
Volunteer understands and acknowledges that participating in the activities associated with a haunted attraction, including but not limited to acting, performing, constructing props or sets, working with special effects, participating in rehearsals, or assisting with operations, involves inherent risks. These risks may include, but are not limited to:
- Slips, trips, falls, and collisions in dark or uneven environments
- Emotional distress or psychological reactions due to frightening or intense scenarios
- Contact with theatrical smoke, fog, strobe lighting, and sound effects
- Physical injury from props, equipment, guests, or other volunteers
- Exposure to weather, insects, or other environmental factors
- Any risks associated with transportation to or from the venue
Volunteer freely assumes all such risks, both known and unknown, and acknowledges that their participation is voluntary.
2. Release of Liability
To the fullest extent permitted by law, Volunteer hereby waives, releases, and discharges Dark Castle, from any and all liability, claims, demands, causes of action, damages, or losses, whether in law or equity, arising out of or relating to Volunteer’s participation, including but not limited to:
- Personal injury
- Property damage or loss
- Emotional or psychological harm
- Illness or death
This release applies even if such damages are caused in whole or in part by the negligence of Dark Castle or any of its representatives.
3. Indemnification
Volunteer agrees to indemnify, defend, and hold harmless Dark Castle from and against any and all claims, liabilities, damages, losses, and expenses (including attorney’s fees) arising out of or related to Volunteer’s actions, conduct, or participation.
4. Medical Treatment
Volunteer consents to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during their participation. Volunteer releases Dark Castle from any claim arising from such treatment or lack thereof.
5. Photographic & Media Release
Volunteer grants permission to Dark Castle to photograph, video record, or otherwise capture Volunteer’s image, likeness, or voice for use in marketing, promotions, or archival purposes without compensation or further approval.
6. Code of Conduct
Volunteer agrees to:
- Follow all safety protocols and instructions from staff
- Refrain from consuming alcohol or drugs while on duty
- Conduct themselves professionally and respectfully toward all guests and staff
- Notify Dark Castle of any medical conditions that may affect participation
Dark Castle reserves the right to dismiss any volunteer for unsafe, inappropriate, or disruptive behavior, with or without notice.
7. Minors
If the Volunteer is under 18 years of age, this agreement must be signed by a parent or legal guardian. The guardian also agrees to all terms set forth herein on behalf of the minor.
8. Governing Law & Severability
This Agreement shall be governed by the laws of the State of South Carolina. If any provision is found to be unenforceable, the remainder shall continue in full force and effect.
9. Entire Agreement
This document reflects the entire agreement between the parties and supersedes any prior oral or written agreements.
