WAIVER of LIABILITY

Thank you for your continued trust in us.

This Assumption of Risk and Waiver of Liability acknowledges the inherant risks involved in participation of activities at and through Bellevue Dance Academy, LLC.

Thank you for taking a moment to complete this Assumption of Risk and Waiver of Liability Agreement.

ASSUMPTION OF RISK Bellevue Dance Academy (BDA) has instituted measures in an attempt to prevent the spread of COVID-19. However, BDA cannot, and expressly does not guarantee the students will not become infected as a result of receiving instruction in person. Furthermore, given the nature of the instruction, close contact between students and teachers, and even other students, cannot be avoided. Despite adhering to state guidelines, there is still a chance that you could be exposed to an illness in our studio, just as you might in any public setting. It is not possible to guarantee a risk free activity of all persons at all times. *

I realize while enhanced safety precautions are being taken at Bellevue Dance Academy, an inherent risk of exposure to COVID-19 exists in any public place where people are present.

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child and I may be exposed to or infected by COVID-19 by attending classes at Bellevue Dance Academy. I understand that the risk of becoming exposed to or infected by COVID-19 at Bellevue Dance Academy may result from the actions, omissions, or negligence of myself and others, including, but not limited to, BDA staff, instructors, volunteers, other students, and their families.

On my behalf, and on behalf of my child(ren), heirs, estate, personal representatives and successors, I hereby release and hold harmless Bellevue Dance Academy, its staff, instructors, volunteers, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Bellevue Dance Academy staff, instructors, volunteers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Bellevue Dance Academy classes, programs or events.

PRE-SCREENING and MONITORING *

I understand that it is my choice to allow my child(ren) to participate in any Bellevue Dance Academy activity.

I understand that Bellevue Dance Academy is not responsible for pre-screening or monitoring individuals and that all adults are encouraged to self-screen themselves and their child(ren) at home prior to going out in public.

By visiting Bellevue Dance Academy and allowing my child(ren) to participate in studio activities, I voluntarily will do my part to help my child(ren) follow proper protocol as well.

Students and family members understand and agree that they must follow instruction or direction from Bellevue Dance Academy and its teachers, instructors, volunteers, and staff while receiving instruction and that failure to do so may result in the student being asked to leave the BDA premises.

I have talked to my child about appropriate etiquette and protocol.

My dancer and I will agree to follow the rules, regulations, and procedures as set forth in the BDA Policies and Procedures.

LIABILITY of TUITION and PAYMENT *

I acknowledge and accept that the schedule is tentative and can change due to unforeseen circumstances.

ACCIDENT or INJURY It is understood that dance is an activity with inherent dangers for injury. Our staff is professionally trained and will train students in the safest manner possible. It is required that all students be covered by their own family’s insurance policy, and if an injury occurs, it is understood that the student’s own policy is your only source of reimbursement. BDA is not responsible for injuries sustained in class, on-premises, or at any related event. *

As the parent, I acknowledge and voluntarily assume the risk for accident and injury.

By signing this agreement, I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to personal injury, disability, and death), illness, damage, loss, claim, liability, or expense of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at BDA or participating in BDA programs.

As the parent/guardian of the dancer(s) listed, I understand Bellevue Dance Academy, LLC, and its teachers and staff are not liable for any illness or injuries sustained by my child during the course of classes, rehearsals and performance.
