PHOTO RELEASE FORM FOR MINORS & ADULTS 

The non-profit organization, Nā Kahu o Hō῾ai, Inc. and/or The Royal Order of Kamehameha I, Chapter 3, "Kaumualii", has my permission to use my or my child’s photograph publicly to promote the organization.  I understand that the images may be used in print publications, online publications, presentations, websites, and social media. I also understand that no royalty, fee or other compensation shall become payable to me by reason of such use.

AGREEMENT, WAIVER AND RELEASE 

I, (the “Participant”), acknowledge that I have voluntarily applied to participate in the Kamalo’ula Cultural Restoration Project (the “Project”), and which Project will involve the cutting, clearing and eradication of non-native haole koa (leucaena leucocephala) and other vegetation, restoration of cultural sites, and other culturally significant work projects in and adjacent to the Prince Kuhio Park and Kamalo’ula Cultural Preserve (the “Restoration Areas”). 

I AM AWARE THAT SOME OF THESE ACTIVITIES ARE HAZARDOUS ACTIVITIES AND THAT I COULD BE SERIOUSLY INJURED OR EVEN KILLED. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND AGREE TO ASSUME ANY AND ALL RISKS ASSOCIATED THEREWITH, INCLUDING, BUT NOT LIMITED TO, BODILY INJURY, DEATH, AND PROPERTY DAMAGE, WHETHER THESE RISKS ARE KNOWN OR UNKNOWN.

In consideration of being permitted by Nā Kahu o Hō῾ai, Inc. and/or The Royal Order of Kamehameha  I, Chapter 3, "Kaumualii" to participate in activities at Prince Kuhio Commemorative Park and Kamalo'ula  Cultural Preserve, I hereby waive, release and discharge any and all claims for damage for personal  injury, illness, death or property damage which I may have, or which may hereafter accrue to me, as a  result of participation in activities at said facilities. This release is intended to discharge in advance Nā  Kahu o Hō῾ai, Inc. and/or The Royal Order of Kamehameha I, Chapter 3, "Kaumualii", their officers, representatives and agents from any and all liability arising out of or connected in any way with my participation in activities at this site even though that liability may arise out of negligence or carelessness on the part of those parties. It is understood that activities such as the ones I will be participating in involve an element of risk and danger of accidents and knowing those risks, I hereby assume those risks.  It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold harmless, Nā Kahu o Hō῾ai, Inc. and/or The Royal Order of Kamehameha I, Chapter 3, "Kaumualii", their officers, representatives and agents from any loss, liability, damage, cost or expense which they may incur as the result of my illness, death or any injury or property damage that I may sustain while participating in any activity at this site. 

CONSENT OF PARENT/GUARDIAN (If Participant is a minor) 

I am the parent or legal guardian of the participant listed above. I hereby consent that the participant may participate in activities at this Royal Order of Kamehameha site, and I hereby execute the Agreement, Waiver and Release on his/her behalf. I hereby affirmatively state that the said Participant is physically able to participate in said activity. I hereby agree to indemnify and hold the persons and entities mentioned above free and harmless from any loss, liability, damage, cost or expense that they may incur as result of the illness, death, injury or property damage that said participant may sustain while participating in any activity at this site. 

I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND NA KAHU O HO’AI AND THE ROYAL ORDER OF KAMEHAMEHA I, CHAPTER 3, "KAUMUALII", AND I SIGN IT OF MY OWN FREE WILL.
