All events that take place are
catered for by the company named hereafter as ‘Surplus to Purpose CIC (SToP)’.
The names under
section ‘customer details’ overleaf are responsible and liable for this booking
in its entirety and are named hereafter as ‘the customer’.
1.)
When you make your booking with us, it is
considered provisional until we receive your written confirmation and deposit.
Provisional bookings are held for
up to 14 days, after which, if written confirmation and a deposit have not been
received in full and funds cleared, the booking will be automatically released.
2.)
Your deposit fee will be determined through your
events coordinator. Deposits are non-refundable and non-transferable. Your
deposit will be deducted from the final balance in your final invoice prior to
your booked date.
Any extra costs incurred on the day or
any damage caused from your event will be invoiced accordingly after the event
and is payable to SToP within 14 days.
3.)
The customer is responsible for the hire of any
equipment and provision of utilities required, unless stated otherwise in the
‘Equipment/additional requirements to be provided by SToP’ section. All costs associated with the hire of any
equipment and the provision of any utilities are to be paid directly to the supplier
of these services by the customer.
SToP will
provide specifications of any equipment required and can if required recommend
suppliers.
SToP accept no liability or
responsibility if they are unable to provide the required catering due to the
equipment and utilities provided by the customer being unavailable or
unsuitable (not to the SToP provided specifications) on the event date. No
refund will be available in these circumstances.
4.)
Unless specifically stated in the
‘Equipment/additional requirements to be provided by SToP’ section and previously
discussed with your events coordinator, your booking does not include staff to
clear up after your event, including but not limited to removing used plates
and washing up. For non-staffed buffets
any non-disposable platters are to be returned to SToP by the customer cleaned,
or a collection arranged with your events coordinator.
5.)
Your final guest numbers must be received in
writing 6 weeks prior to your booked event date. An invoice will then be issued
for the remaining balance one month prior to the event date. This invoice is due for payment within 7
days.
If total monies are not received on or
before 14 days prior to your booked date, we reserve the right to cancel the
booking which would incur cancellation charges in line with our terms and conditions
of business.
6.)
All of the ingredients used to create our menus
are intercepted from landfill, therefore though we will endeavour to provide
them, specific and exact menu requests cannot be guaranteed.
SToP requires
advance notice of any specific dietary requirements of your guests when final
numbers are confirmed 6 weeks prior to your event. SToP will not accept
responsibility if these requirements are not received prior to this.
Children aged
between 2 years and 10 years are charged at 50% of the adult price for a half
portion of an adult meal.
Children under
2 years are free of charge, as they are not catered for.
In the event that SToP are unable to
provide a service on the planned date, alternative suppliers will be discussed.
7.)
Events booked far in advance may be subject to
an increase in costs. Elements could be subject to a reasonable adjustment in
price due to inflation, living wage increases and fluctuations in market
conditions. SToP reserves the right to increase prices in the event of circumstances
beyond our control, e.g. increases in tax and duty.
8.)
If a booking has been confirmed and is
subsequently cancelled by the customer, the following cancellation charges on a
sliding scale of the total booking price will be charged:

Cancellation of a confirmed booking – loss of
deposit
·
Less than 1 month - 100% of the total anticipated charge.
The total
anticipated charge is calculated based on approximate guest numbers given upon
booking and the catering package chosen.
All cancellations
must be made in writing and sent by email to events@surplus2purpose.com
We are conscious of the difficulties
that can arise in the event of a cancellation and therefore strongly recommends
that special insurance is taken out.
9.)
Any complaint arising from the event provided by
us must be made in writing within 7 days after the event. After this no
correspondence will be entered into.
10.)
Force Majeure – If StoP is limited or hindered
from providing the event booked by you due to circumstances beyond its control
(e.g. Government intervention, acts of God, civil disturbance, war, national or
local disaster, strikes, labour disputes, fire), SToP will accept no liability
or responsibility.
11.)
SToP does not in any way exclude or limit its
liability for death or personal injury caused by its negligence.
12.)
All guests will comply with any statutory
requirements regarding SToP health and safety and fire conditions.
13.)
You will be held liable for the cost of repairs
carried out as a result of any damage caused to any part of SToP property by
the negligence, wilful act or default of any person invited by you or any
person attending your event. SToP does
not accept liability or responsibility for the loss of or damage to any goods
including gifts, or property belonging to any guests or other persons invited
by you.
14.)
Both parties acknowledge the ongoing COVID-19
crisis in the UK and accept their obligation to comply with any official
guidance from UK Government. The parties agree to communicate without delay any
issues they may have in performing their obligations under this agreement. You
acknowledge that COVID-19 may require us to take one or more of the following
measures for the safety of our staff and the safety of guests attending the
event to which this booking relates:
(i) limit food
availability
(ii) impose
specific requirements regarding personal protective equipment such as the
wearing of masks
(iii)
designate alternative entrance and exit routes for the serving of food
(iv) amend the
style of service e.g. from self service to waited service. In some
circumstances we might consider revising your booking fee.
If you are unable to provide the agreed
guest numbers because of infections or travel restrictions, then we will offer
you either a proportionate reduced fee for the event or agree to re-schedule
the booking. If guest numbers decrease below 70% of the contracted number
(notified by you in writing 6 weeks prior to event), we reserve the right to
cancel the event.
15.)
We reserve the right to amend these terms from
time to time.
All of the above terms and
conditions will be governed by English Law.
