Assumption of Risk and Waiver & Release of Liability – Milwaukee Dragon Boat Festival 

Name of Event: 2024 Milwaukee Dragon Boat Festival

Date of Event and Practices : August 5th-10th, 2024

Location of Event and Practices:  2024 Milwaukee Dragon Boat Festival, 500 N Harbor Dr, Milwaukee, WI 53202

In consideration of being allowed to participate in any way in the Milwaukee Dragon Boat Festival, related events and activities including, without limitation, the Event, training and/or practices for the Event (collectively, the “Activities”), the undersigned acknowledges, understands, and agrees that:

1. The risk of serious injury from participating in the Activities is significant, including the potential for permanent paralysis or death.  Additionally, while I participate in the Activities, which include the congregation of potentially a large number of people in a small area, I may be exposed to the infectious diseases including but not limited to MRSA, influenza, COVID-19 and monkey pox, and such disease can cause serious and potentially life threatening illness and even death.   While taking appropriate precautions may reduce the risk of serious injury or serious illness, it is not possible to prevent serious injury, series illness and death from participating in the Activities. 

2. I KNOWINGLY AND FREELY CHOOSE TO ASSUME ALL RISKS ARISING OUT OF OR IN CONNECTION WITH PARTICIPATING IN THE ACTIVITIES, BOTH KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others and assume full responsibility for my participation, and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness (which may be severe and can result in death), damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in the Activities.   

3. I willingly agree to comply with the stated Event rules, instructions from Event officials and customary terms and conditions for participation. I understand I may be removed from the Event at any time at the discretion of an Event official. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest Event official immediately; and,

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the Milwaukee Dragon Boat Festival, Milwaukee Chinese Community Center(MCCC), Lakeshore Park, the City of Milwaukee, the State of Wisconsin, volunteers, sponsors and all related parties, the owners(s) and lessee(s) of the premises, waterways and grounds where the Event will be held, the owners, lessors, lessees of all equipment used in connection with the Event, sponsors, sponsoring agencies, advertisers and beneficiaries of the Event and the respective departments, officers, officials, directors, members, contractors, agents, employees, licensees, invitees, servants and volunteers of the foregoing ("Releasees"), of and from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to my participation in the Activities, including without limitation injury, disability, death or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise. 

I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS  Assumption of the Risk and Waiver & RELEASE of Liability, AND FREELY AND KNOWINGLY ASSUME THE RISKS AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.

Photo/Video Release Agreement

I, hereby grant Milwaukee Chinese Community Center (MCCC”) permission to use my name and my likeness in a photograph/video without payment or any other compensation.  These photographs/videos may be used for promotional and marketing purposes through a variety of mediums including, but not limited to, printed collaterals, television media, internet, website and social media (including the MCCC Facebook, Instagram, LinkedIn, and Twitter pages, among others).
