Open letter to the Chancellor, Government and Parliament of Germany.

We, German and international survivors of prostitution and trafficking for sexual exploitation, frontline NGOs providing direct support to victims of these crimes, human and women’s rights’ activists, organisations and movements combatting all forms of sexual and sexist violence are shocked, hurt and appalled by the German legislation and public policies on prostitution. Since 2002, German Government has organised and protected a system of massive sexual exploitation and human rights violations of the poorest and most vulnerable women.

Gathered in Mainz on the occasion of the 3rd World Congress against the sexual exploitation of women and girls1, we solemnly call upon the German Chancellor, Government and Parliament to put an immediate end to the State’s sponsored sexual exploitation of the most marginalised women.

In order to do so, we urge the German Government to:

• Respect its international obligations by criminalising the exploitation of prostitution, including the running of a brothel and making any form of profit from someone else’ s prostitution;

• Recognise that purchasing sexual access to a person’s body based on their financial constraints, not their physical desire is a form of sexual and sexist violence and prohibit the purchase of sex;

• Ensure neither punitive policies or legislation nor specific controls or registration are imposed on prostituted individuals, who should never be punished for their own exploitation.

• Establish a nation-wide exit policy, with programmes offering protection, assistance and socio-economic support to victims of prostitution and trafficking. These must include access to social housing, residency permits for foreign victims, physical and psychological healthcare, education and professional insertion;

• ecognise the responsibility of the German State for the sexual exploitation of several hundreds of thousands of women, and provide financial compensation for victims of prostitution and trafficking whose exploitation in State’s licensed brothels has been permitted and encouraged by the 2002 and 2017 prostitution legislation.

We urge Chancellor Merkel and the heads of all political parties to receive a delegation of the signatories before the end of May 2019. The Government needs to criminalise the exploitation of prostitution of others and the purchase of sex, close brothels, and offer effective protection, social support and economic alternatives to victims of prostitution and trafficking in Germany. We are determined to obtain this, including through domestic and international legal actions to ensure that Germany starts fulfilling its international human rights obligations by the end of 2019.

Wir, deutsche und internationale Überlebende der Prostitution und des Menschenhandels zum Zweck der sexuellen Ausbeutung, Nichtregierungsorganisationen, die unmittelbar und direkt die Opfer dieser Verbrechen unterstützen, Aktvistinnen und Aktivisten für Menschen- und Frauenrechte, Organisationen und Bewegungen, die alle Formen sexueller und sexistischer Gewalt bekämpfen, sind durch die deutsche Gesetzgebung und öffentlichen Ansätze zur Prostitution schockiert, verletzt und zutiefst erschreckt. Seit 2002 hat Deutschland ein System massiver sexueller Ausbeutung und Menschenrechtsverletzungen an den ärmsten und gefährdetsten Frauen organisiert und geschützt.

Anlässlich des 3. Weltkongresses gegen die sexuelle Ausbeutung an Frauen und Mädchen in Mainz versammelt, rufen wir die deutsche Kanzlerin, die Regierung und den Bundestag feierlich dazu auf, der staatlich geförderten sexuellen Ausbeutung der gefährdetsten Frauen sofort ein Ende zu bereiten.

Um dies zu erreichen, fordern wir die deutsche Regierung dazu auf:

• ihren internationalen Verpflichtungen durch die Kriminalisierung der Ausbeutung der Prostitution einschließlich des Bordellbetriebs und jeglichen Profits aus der Prostitution anderer nachzukommen;
• anzuerkennen, dass die Bezahlung sexuellen Zugangs zum Körper einer anderen Person wegen deren finanzieller Nöte und nicht deren körperlichen Begehrens eine Form sexueller und sexistischer Gewalt darstellt und den Kauf von Sex zu verbieten;
• sicherzustellen, dass prostituierten Individuen weder Strafen noch besondere Kontrollen oder Registrierungen auferlegt werden, da diese für ihre eigene Ausbeutung weder Strafen noch Kontrollen unterworfen sein sollen;
• auf Bundesebene Richtlinien zum Ausstieg aus der Prostitution mit ausgestatteten Programmen einzuführen, die den Opfern der Prostitution und des Menschenhandels Schutz, Begleitung, sowie soziale und finanzielle Unterstützung bieten. Diese Programme müssen Sozialwohnungen, Aufenthaltsgenehmigungen für ausländische Opfer, medizinische und psychologische Gesundheitsversorgung, Bildung und Zugang zu Berufsmöglichkeiten enthalten;
• die Verantwortung des deutschen Staates für die sexuelle Ausbeutung mehrerer hunderttausender Frauen anzuerkennen und den Opfern der Prostitution und des Menschenhandels, deren Ausbeutung in den deutschen, staatlich zugelassenen Bordellen durch die Gesetzgebung zur Prostitution in der Jahre 2002 und 2017 erlaubt und gefördert wurde.

Wir fordern die Kanzlerin Angela Merkel und die Vorsitzenden aller Parteien auf, eine Delegation der Unterzeichnenden vor Ende Mai 2019 zu empfangen. Die deutsche Regierung muss die Ausbeutung der Prostitution anderer und den Sexkauf kriminalisieren, die Bordelle schließen und den Opfern der Prostitution und des Menschenhandels in Deutschland effektiven Schutz, soziale Unterstützung und wirtschaftliche Alternativen bieten. Wir sind entschlossen, dies zu erreichen und dabei auch nationale und internationale Gerichtsverfahren anzustrengen, um sicherzustellen, dass Deutschland damit beginnt, seinen internationalen Menschenrechtsverpflichtungen vor Ende 2019 nachzukommen.

BACKGROUND NOTE

>Violation by Germany of its international obligations under international human rights law.

Germany is one of the very few States in the world which grants impunity and legal protection to brothel owners, pimps, procurers and sex buyers. By doing so, Germany violates its international obligation under the CEDAW Convention to “suppress all forms of traffic in women and exploitation of prostitution of women2”.

The definition under international human rights law of “exploitation of prostitution” includes “any person who 1) Procures, entices or leads away, for purposes of prostitution, another person, even with the consent of that person; 2) Exploits the prostitution of another person, even with the consent of that person, 3) Keeps or manages, or knowingly finances or takes part in the financing of a brothel; 4) Knowingly lets or rents a building or other place or any part thereof for the purpose of the prostitution of others”3.

In February 2014, the European Parliament formally adopted a resolution recognising that prostitution and trafficking were “highly gendered issues and violations of human dignity, contrary to human rights principles, among which gender equality, and therefore contrary to the principles of the Charter of Fundamental Rights of the European Union, including the goal and the principle of gender equality4”.

Instead of suppressing trafficking in women and exploitation of prostitution of women, the German State has encouraged and fostered these crimes and human rights violations. In a 2013 detailed investigation, Der Spiegel explained “how the State fosters trafficking in women and prostitution5”. Many more media investigations have shown how the “legalisation of prostitution” has only benefited organised crime, traffickers, pimps, procurers and sex buyers, and has led to massive violations of human and women’s rights including widespread violence.

Prostitution is a world of violence (threats, abuses, assaults, rapes, murders) and a sexual violence in itself e.g. the repetition of sexual acts imposed under physical, or economic constraint. The consequences on physical and psychological health are extreme, including PTSD, anxiety, depression, self-harm, suicide, early mortality.

This inherent violence of prostitution is true everywhere in the world but in the German “Bordell Europa’s”, this violence is actually protected and licensed by the State. The scale of sexual exploitation is 10 to 20 times higher than in neighbouring countries. The impunity of sexual exploiters and abusers has led to a culture of extreme objectification and commodification of women and to “cruel, inhuman and degrading treatments” which meet the international definition of torture7.

Unsurprisingly, the economic and sexual exploitation of people trapped in prostitution disproportionately affects the most vulnerable and discriminated-against populations. As for all forms of sexual violence, women and girls represent an overwhelming majority of those affected by prostitution. Furthermore, all over the world, the youngest, poorest and most discriminated-against women (refugees, displaced, migrant people, those belonging to indigenous communities, ethnic minorities, people of colour, lowest castes etc…) are greatly over-represented in prostitution. The exploitation of prostitution is fuelled by -and generates additional- poverty, sexism, classism, racism and colonisation. This is also true in Germany where the vast majority of prostituted persons are migrant women coming from poorer and marginalised communities.

Women and girls from all over the world are sex-trafficked for one reason: to meet male demand for paid sex. This is exactly why the UN Palermo Protocol (2000)8, the Council of Europe Warsaw Convention9 (2005) and the EU Anti-Trafficking Directive (2001)10 urge all States parties to “adopt or strengthen legislative or other measures to discourage the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking”. On the contrary, the 2002 legislation has trivialised the purchase of sex and legitimised sex buyers. The German Governments is thus also failing to respect its international obligation under three instruments to “discourage the demand that fosters all forms of exploitation”.
