In consideration of being allowed to participate, caregive, and/or volunteer in any way in Deep & Beyond
Inc. related events, programs, and activities, as well as those of any affiliated organizations, I and/or the
minor participant and/or volunteer, the undersigned:

1. Agree that prior to participating, caregiving, and/or volunteering, I will inspect, or if a parent and/or
legal guardian, I will instruct the minor participant and/or volunteer to inspect the facilities and
equipment to be used, and if I believe anything is unsafe, I and/or the minor participant and/or
volunteer will immediately advise of such conditions and refuse to participate.

2. Acknowledge and fully understand that I and/or the minor participant and/or volunteer will be
engaging in activities that involve risk of serious injury, including permanent disability and death,
and severe social and economic losses which might result only from my own actions, inactions,
negligence of others, the rules of play, or the condition of the premises or any equipment used.
Further, that there may be other risk not known to me or not reasonably foreseeable at this time.

3. Accept all the foregoing risks and accept personal responsibility for the damages following any such
injury, permanent disability or death.

4. Release, discharge, and covenant not to sue Deep & Beyond Inc., their representative
administrators, directors, agents, coaches, and other employees or volunteers of the organization,
other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and leasers
of premises and equipment used to conduct the events, all of which are hereinafter referred to as
“releasers”, from demands, losses or damages on account of injury, including death or damage to
property and equipment, cause or alleged to be caused in whole or in part by the negligence of the
releaser or otherwise.

5. Agree to abstain from the use of alcohol and/or illegal drugs while participating and/or volunteering
in any event sponsored by the Deep & Beyond Inc. Failure to adhere to this requirement will result
in immediate removal and possible suspension.

6. Do hereby authorize, consent to and direct the Deep & Beyond Inc. to seek medical help in the case
of an emergency.

7. It is acknowledged and understood that Deep & Beyond Inc. has not participated in the preparation
or production of any food offered for consumption on the premises and therefore cannot and is not
responsible or liable for any effects, allergic reactions, or illness that may result by the consumption
of such food.

8. I further agree to indemnify and hold harmless, Deep & Beyond Inc. and its participants, volunteers,
employees, sponsors, and board members from and against any and all liability incurred, including
the payment of attorney’s fees and court costs, as a result of or in any manner related to my
participation in Deep & Beyond Inc.’s, programs, activities and related events.

9. I understand that any information given will be shared with the volunteers and staff that directly
work with me, in case of an emergency, and for email updates.

I/We have read the above waiver and release and understand that I/we have given up substantial rights by
signing this document and sign it voluntarily.
