These services may include but are not limited to, edge sharpening, waxing, base repair, binding adjustments, and other necessary maintenance procedures.
3. Release of Liability
The Customer, on behalf of themselves, their heirs, not to sue the Service Provider for any liability, injury, or damage to person or property that may occur during or as a result of the tuning services provided, even if caused by the negligence or other fault of the Service Provider.
This release applies to all claims, including but not limited to, claims arising from the Service Provider’s employees or agents, or any defect in the equipment or materials used in the tuning process.
4. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Service Provider from any claims, demands, or causes of action arising from the Customer’s use of the tuned or repaired equipment, including any claims for personal injury, property damage, or wrongful death, whether such claims are caused by the negligence of the Service Provider or otherwise.
5. Equipment Condition and Acceptance
The Customer acknowledges that the Service Provider will inspect and assess the condition of the equipment before performing any services. If the equipment is found to be unsafe or in a condition that may pose a risk to the Customer or others, the Service Provider may refuse to perform the tuning services. In such cases, the Customer will be notified of the equipment’s condition, and no warranty or guarantee will apply to the service.
6. No Warranty
The Customer understands and agrees that the Service Provider does not guarantee the performance or functionality of the ski or snowboard equipment after tuning or repair services. The Service Provider does not guarantee that the equipment will be free of defects or errors after the service or that the tuning will prevent accidents or injuries.
7. Governing Law
This Agreement shall be governed by the laws of the State of Colorado. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
8. Acknowledgment of Understanding
By checking the box below the Customer acknowledges that they have read and fully understand the terms and conditions of this Agreement, and they voluntarily agree to release and waive all claims as stated above.
Additionally, the Customer acknowledges that they have been provided with clear and reasonable information about the risks involved in skiing and snowboarding equipment tuning and that they are voluntarily accepting the services provided with full awareness of the potential risks.
