USCIS/CBP Search & Remand Issues
The American Immigration Council has heard of USCIS processing FOIA requests for a-files and/or specific immigration records by (i) issuing a no records determination after searching only Person Centric Identity Service (PCIS), (ii) then remanding for a new search after a requester appeals the search, and (iii) finally not conducting the new search or otherwise processing the request on remand within 20 business days. 

The Council has heard that CBP is also issuing no records determinations but has less information about whether CBP is identifying the systems it is searching before making that determination and how CBP is handling administrative appeals of searches 

The Council is exploring advocacy on these search/remand issues and is trying to get a sense of how widespread they are
