BootyLab Inc. is a personal and group training service provider.

By signing this electronic form, I have requested Booty Lab Inc. to conduct personal and or group training sessions and have agreed to enroll in a program of physical exercise including but not limited to strength training, gymnastics, Olympic lifting, joint mobility development, stretching and flexibility development, use of training equipment, and aerobic exercise ("activities").

ACKNOWLEDGMENT OF HEALTH

I declare myself physically and mentally sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation in training sessions, physical exercise, activities, or my use of equipment. I acknowledge I have been informed of the need for a physician's approval for my participation in an exercise/fitness activity or in the use of equipment. I recognize it is my sole responsibility to obtain an examination by a physician prior to involvement in any exercise program. I acknowledge I have either had a physical examination and been given my physician's permission to participate, or if I have chosen not to obtain a physician's permission prior to beginning this exercise program with Booty Lab Inc., I acknowledge I am doing so at my own risk.

ASSUMPTION OF RISK

I understand and am aware that physical exercise and activities, including the use of equipment (including, but not limited to, treadmills, bikes, rowers, free weights, etc.), are potentially hazardous activities. I assume all risks of injury associated with or in any manner related to my use of or presence upon the Booty Lab Inc. premise, including injury resulting from the negligence of the health club or its employees. I acknowledge the possibility that injuries, and physical and mental changes ("Injuries and Changes") arising during and/or resulting from engaging in Activities does exist. Injuries and Changes include, but are not limited to, heart attacks, abnormal blood pressure, fainting, tendinitis, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and even death. I understand Injuries and Changes could result in my becoming partially or totally disabled and incapable of performing any gainful employment or having a normal social life.

I am voluntarily participating in Activities and using Equipment with knowledge of the dangers involved. I understand and take sole responsibility for any and all Injuries and Changes that may occur to myself and or others, related to any and all Activities associated with Booty Lab Inc. even if not specifically set forth in this document, whether or not they fall within the scope of reasonably foreseeable injuries related to such Activities and whether or not undertaken in my trainer's presence. Although Booty Lab Inc. will take precautions to ensure my safety, I expressly assume and accept sole responsibility for my safety and for any and all Injuries and Changes that may occur.

WAIVER AND RELEASE OF LIABILITY

For and in consideration of my participation, I, individually and on behalf of my personal representatives, heirs, administrators, assigns and successors, do hereby waive, release and forever discharge Booty Lab Inc., its owners, instructors, and all other persons and entities associated with the exercise program from any and all responsibilities and liability from injuries resulting from my participation or my use of equipment in the above mentioned activities. I understand that this waiver applies regardless of whether I am using exercise equipment at the time of the injury or whether the injury occurs as a result of my presence upon the premises regardless of the purpose or activity at the time of the injury-causing incident. I agree not to sue or otherwise attempt to hold Booty Lab Inc. liable for any injuries regardless of the cause. I do also hereby release all of those mentioned above and any others acting on their behalf from any responsibility or liability for any injury or damage to myself including (a) my use of any exercise equipment or facilities which may malfunction or break, (b) Booty Lab Inc.'s improper maintenance of any exercise equipment or facilities, (c) Booty Lab Inc.'s negligent instruction or supervision, including personal training, and (d) any slips or falls that may occur on any portion of the premise for any reason, including Booty Lab Inc.'s negligent inspection or maintenance of its facility regardless of cause, unless caused by the negligent act or omission of any of those mentioned or others acting on their behalf. 

I understand that this waiver and release agreement is intended to be as broad as is allowed under applicable law and applies to any and all claims for damages, regardless of whether they are allegedly caused by the negligence of Booty Lab Inc. or its employees.

CANCELLATION POLICY

Booty Lab Inc. has a 24-hour cancellation/rescheduling policy. If a client misses their appointment, cancels, or changes their appointment with less than 24 hours’ notice, the client will be charged for the visit in full. This policy includes personal training.

Booty Lab Inc. has a 12-hour cancellation policy for Booty Lab Inc. classes. If a client misses their class, cancels, or changes their class time with less than 12 hours’ notice, the client will be deducted a session from their package. Thank you for understanding and your cooperation.

REFUND POLICY

After packages (classes or personal training) have been purchased in full, any unused sessions will not be refunded. Unused sessions will only be refunded if the sessions were unused during the first month of the client's purchase. Thank you for understanding and your cooperation.

PHOTO RELEASE

By agreeing to this liability waiver, I hereby grant Booty Lab Inc. permission to use my likeness in a photograph or other digital reproduction in any and all of its publications, including website entries, without payment or any other consideration.

I understand and agree that these materials will become property of Booty Lab Inc. and will not be returned. I hereby irrevocably authorize Booty Lab Inc. to edit, alter, copy, exhibit, publish or distribute this photo for purposes of publicizing for its programs or any other lawful purpose.

In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive the right to royalties or other compensation arising or related to the use of the photograph. I hereby hold harmless and release and forever discharge Booty Lab Inc. from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate or may have by reason of this authorization.

My signature is proof of my intention to execute a complete and unconditional waiver and release of all liability to the fullest extent of the law. I am at least 18 years old and am mentally competent to enter into this agreement. (If you are not at least 18 years old, you must have a parent or guardian sign).
