ADULT WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT

2026 Pooch Plunge

I, the "Participant", represent that I am at least eighteen (18) years of age. In consideration of being permitted to participate in the 2026 Pooch Plunge sponsored by the Township of Cranford Swim Pool Utility/Cranford Community Pools ("SPU") and Cranford Community Connection ("CCC") at the Centennial Avenue Municipal Pool, and any related activities (collectively, the "Event"), I agree to the following:

ASSUMPTION OF RISK

I understand that participation in the Event involves inherent risks to both myself and my dog, including but not limited to bodily injury, illness, property damage, disability, paralysis, and death. These risks may result from my actions, my dog's actions, the actions of other participants or dogs, event conditions, health conditions, or the negligence of others.

I acknowledge that not all risks associated with the Event are known, foreseeable, or avoidable. I knowingly and voluntarily assume all risks associated with my participation in or attendance at the Event and accept full responsibility for any resulting injury, loss, damage, or expense.

I understand that the Released Parties do not provide medical or veterinary services or reimbursement for the same. If I or my dog(s) require medical or veterinary treatment, I am fully responsible for the costs thereof.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I release and discharge the Township of Cranford, SPU, CCC, their affiliates, sponsors, officers, officials, employees, representatives, agents, volunteers, and contractors (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or related to my participation in the Event, my attendance at the Event, or my dog's participation in the Event, including claims arising from the negligence of the Released Parties.

INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to my actions, my dog's actions, or my participation in the Event.

PARTICIPANT RESPONSIBILITIES

I acknowledge that I am solely responsible for supervising and controlling my dog at all times. If I believe any condition or circumstance presents a safety concern, I will immediately discontinue participation and leave the activity area.

I certify that:

• I am the legal owner of the dog identified below.
• My dog is at least six (6) months of age.
• My dog is currently vaccinated against rabies as required by law.
• My dog is in good health and able to safely interact with other dogs and people in a crowded environment.
• My dog does not have a history of dangerous or aggressive behavior.

I agree to follow all event rules, policies, and instructions provided by Township, SPU, and CCC representatives. I understand that event staff may deny participation, remove me or my dog from the Event, or require us to leave the premises at their sole discretion if safety concerns arise or event rules are violated. No refunds or credits will be provided if participation is denied or discontinued.

PHOTO AND MEDIA RELEASE

I grant permission to the Township of Cranford, SPU, and CCC to use photographs, video recordings, and other likenesses of me and my dog for promotional, educational, or advertising purposes without compensation.

GENERAL PROVISIONS

I have carefully read this Agreement and understand that by signing it I am waiving substantial legal rights, including the right to seek compensation for injuries, damages, or losses arising from participation in the Event.

I sign this Agreement freely and voluntarily and intend my signature to be a complete and unconditional release of liability to the fullest extent permitted by law.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
