I acknowledge that I have entered and will participate in the Matobo Hills Heritage Mountain Bike Challenge (“the event”) entirely at my own risk.

 In this regard:

 (1)    I acknowledge that mountain biking by its very nature is hazardous;

(2)    I acknowledge that the event passes through National Parks and Communal Lands and that inherent dangers exist from both wildlife and the rough nature of the terrain;

(3)    I acknowledge that I am aware that whilst the organisers of the event have provided limited medical back up, I am entirely responsible for securing my own medical attention for any injury or sickness; I further acknowledge that in the event of rescue that due to the nature of the terrain this may be lengthy and possibly cause further injury and I absolve all parties including but not limited to, the Medical Support Service Provider from any such responsibility; I acknowledge that there is no air evacuation possible;

(4)    I acknowledge that recovery of participants unable to complete the course is difficult because many parts of the route are inaccessible to vehicles and have limited cell phone coverage;

(5)    I hereby release and forever discharge the Organising Committee, the Matobo Conservation Society, National Parks, the Medical Suppport Service Provider, Camp Dwala  and all sponsoring organisations, and their directors, officers, employees, agents, volunteers and landowners from any responsibility, personal liability, claims, for loss, damage, accident, theft, injury or death that may occur during this event or arising out of or in conjunction with my participation in the event;

(6)    ! agree to abide by all the rules and regulations for the event;

(7)    I acknowledge that the route itself is the property of the Organising Committee and Camp Dwala and accept that the Organising Committee reserves the right to make changes to the course, or to the postponement of the event, in the interest of safety or due to circumstances beyond their control;

(8)    I agree that, once my entry has been completed and accepted, the Organising Committee are not liable to refund entry fees if I am unable to participate for any reason, nor are they obliged to refund any fees if the event is cancelled or postponed for whatever reason;

(9)    I hereby grant to the event and its sponsors and partners all right, title and interest in and to any video, photographs or other reproduction of my images in any format, captured in connection with my participation in the event for use in connection with broadcasting, advertising, exhibitions, websites, promotions, training materials or otherwise.  The Organising Committee reserves the right without further notice to any information that is provided and to make use of any photograph or film taken at the event without payment or permission.  We guarantee that no photographs of a compromising nature will be used;

(10) I confirm that the correct medical aid information has been given on my entry form, and such medical aid companies / schemes supplied are valid and shall meet any anticipated costs, including evacuation.  I confirm that the release of this information to the organisers does not imply any obligation on the organisers to arrange for medical attention in the event of my injury or sickness.  I confirm that the Organising Committee, the Medical Support Service Provider, its agents or sponsors are in no way liable for the costs of any such evacuation;

(11) I confirm that I have read the regulations and information in all supporting newsletters, notices and presentations and confirm that I am well acquainted with the details and particulars of the event and have satisfied myself as to the true nature of the inherent risks associated with the event.  I confirm that I am fit and well enough to participate and do so with no knowledge of any serious / critical inherent health conditions;

(12) I represent and warrant that in respect of any child I am registering under the age of 18, I am the parent or legal guardian of that child and have the legal authority to enter into this agreement on their behalf and by proceeding with this event registration, I am responsible for them.  I agree that the terms of this Indemnity Agreement and Waiver shall apply equally to all registered parties;

(13) I confirm that, as a rider over the maximum age of 70 years, permission has been requested and granted by both a medical practitioner and the event organisers;

(14) I accept that that in the event of the challenge being cancelled due to safety or any other reason that a refund, and the quantum thereof, is entirely at the discretion of the Organising Committee;

(15) I confirm that, if I have requested vehicle re-location services, that the driver of my vehicle shall not be held liable for any damage or loss of property.

(16) I confirm that I will not hold the Organising Committee or its agents liable should I contract any infectious disease as a result of my participation in this event.
