Taxing period products imposes an unconstitutional, sex-based discriminatory economic burden on consumers.
MADVoters, in collaboration with Planned Parenthood Alliance Advocates East, Period Law, Indiana National Organization for Women (NOW), Indianapolis NOW, Monroe County NOW, Northeast NOW, Women4Change, City Moms, League of Women Voters of Fort Wayne, Good Trouble Coalition, American Association of University Women Indiana (AAUW), and AAUW Indianapolis present this petition to demonstrate support for passing tax-free period product legislation in the 2025 Indiana legislative session.
In 2024, Indiana got closer than ever before to becoming the 25th state to make period products tax-free. Although the provision ultimately failed when it was removed from legislation in the final day of the session, enormous progress was made to illustrate the necessity of such legislation in Indiana, a state where menstruating Hoosiers currently pay $5.6 million annually on sales tax alone for period products. The amount is tiny compared to the $45 billion biennial Indiana budget, but the impact is immense when you consider one in four menstruating Hoosiers struggles to pay for feminine hygiene products.
Prescriptions, food, and medical devices are exempt from Indiana sales tax - period products should be on that list. The fact that they are not is a violation of our own tax code, as the FDA regulates tampons and pads as medical devices, and the Streamlined Sales and Use Tax Agreement (SSUTA), of which Indiana is a member, recently re-categorized “feminine hygiene products” as “menstrual discharge collection devices” on their taxability matrix.
