TERMS OF CONTRACT, RELEASE, AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT

 
IN CONSIDERATION of being permitted to participate in any way in the RISE AND GRIND TRAINING and TEAM CRUSH BASEBALL facility activities ("Activity") I, for myself for personal representatives, assigns, heirs, and next of kin:

ACKNOWLEDGE, agree, and represent that I understand the nature of such activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.
FULLY UNDERSTAND THAT: (a) RISE AND GRIND TRAINING and TEAM CRUSH BASEBALL ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.
HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE RISE AND GRIND TRAINING and TEAM CRUSH BASEBALL, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
 

** HEALTH ATTESTATION **

THE PLAYERS ATTEST THAT THEY ARE FULLY ABLE TO PARTICIPATE IN AN EXERCISE REGIMENT, PRACTICE, OR GAME WITHOUT UNDUE RISK.
 

** COMMUNICABLE DISEASES **

It is my intent as a participant that I am agreeable to the following:

I acknowledge that I am aware that there are risks to me of exposure to directly  or indirectly arising out of, contributed to, by, or resulting from:

An outbreak of any and all communicable disease, including but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, which is responsible for Coronavirus Disease (COVID-19) and/or any mutation or a variation thereof;  
 
In consideration of having the opportunity to participate as either a team member or competitor, and in acknowledging that I am aware of and willing to assume the risks associated with this activity, I hereby voluntarily agree to waive, hold harmless and indemnify RISE AND GRIND TRAINING AND TEAM CRUSH BASEBALL and its trustees, agents, volunteers and employees from any and all claims, demands, damages and causes of action of any nature whatsoever arising out of ordinary negligence which I, my heirs, my assigns or successors may have against them for, on account of, or by reason of my participation in the above activities.  I indicate my agreement to this hold harmless electives noted below.

 
I acknowledge and must adhere to the following rules:

- Physical social distancing of 6 feet at all times.
- Stay home if you are experiencing or come in close contact with any symptoms.  Notify the RISE AND GRIND TRAINING OR TEAM CRUSH BASEBALL Staff if you start to experience any symptoms during a training session or game. Per the CDC, symptoms include cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headaches, sore throat, and new loss of taste or smell.
- No gum, seeds, spitting, and team coolers or shared drinking stations\bottles.
- Athletes must have face masks.
- Temperature checks may be required for all coaches and athletes before entering the facility or participating in a practice.
- Players and coaches use hand sanitizer before entering and leaving the facility.
- No-touch rule – coaches and athletes should refrain from high fives, handshake lines, and other physical contacts with teammates, opposing players, coaches, umpires, and fans. A “tip the cap” can be used following the game in lieu of the handshake line.
- Must avoid exchanging\sharing documents or equipment with players, coaches, or spectators.
- Stay home if you are at or come in contact with a person with high individual risk factors (e.g., older age; the presence of chronic medical conditions, including immunocompromising conditions; pregnancy).  
Should self-monitor and self-quarantine for signs and symptoms of COVID-19 if you suspect possible exposure.  Follow the CDC guidelines if you think or know you have COVID-19 and had symptoms - Click Here
Players are not to share any equipment or belongings with teammates including but not limited to water bottles, gloves, bats, hats, helmets, catcher’s equipment, and other on- and off-field gear.
 

** MINOR RELEASE **

AND I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF RISE AND GRIND TRAINING and TEAM CRUSH BASEBALL ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.


** POSTPONED, RESCHEDULED, AND CANCELLED EVENTS, GAMES, PRACTICES, CLASSES SCHEDULES **

While every effort is made to provide accurate and up-to-date information, RISE AND GRIND TRAINING AND TEAM CRUSH BASEBALL and Event coordinators reserve the right to change, without notice the scheduling of Events, Games, Practices, and Classes schedules.  Parents are required to have a valid account within our Team Management or Registration system, mobile phone number, and email address to make sure they are aware of any schedule changes.

 

** WEATHER POLICY **

There are times when the weather becomes a factor for Events, Games, Practices, and Class schedules.  RISE AND GRIND TRAINING, TEAM CRUSH BASEBALL, and Event Coordinators will try to adhere to the original schedule to the fullest extent possible.  You understand and agree to the factors weather may play into the scheduling.  RISE AND GRIND TRAINING, TEAM CRUSH BASEBALL, and Event coordinators reserve the right to change or cancel without notice the scheduling of Events, Games, Practices, and Class schedules.

 

** CANCELLATION AND REFUND POLICY **

ALL DEPOSITS AND REGISTRATION FEES ARE NON-REFUNDABLE.

REFUNDS WILL NOT BE ISSUED FOR ANY REASON.

THIS INCLUDES INJURY, ILLNESS, JOB LAYOFF, MILITARY LEAVE, RELOCATION, AND MORE.  

 

SPORTSENGINE OFFERS REGISTRATION INSURANCE THAT COULD PROVIDE REIMBURSEMENT FOR NON-REFUNDABLE REGISTRATION FEES.  RISE AND GRIND TRAINING AND TEAM CRUSH BASEBALL DO NOT HAVE ANY AFFILIATION WITH THE INSURANCE COMPANY NOR DO WE PROFIT FROM ANY INSURANCE PURCHASED.   ALL QUESTIONS OR CLAIMS SHOULD BE DIRECTED TO THE INSURANCE COMPANY.
 

ALL REQUESTS FOR REFUNDS ARE TO BE MADE IN WRITING WITHIN 14 DAYS OF THE PARTICIPANTS REGISTRATION DATE.
 

RISE AND GRIND TRAINING CLASS CANCELATION MUST BE MADE WITHIN 24 HOURS.

 
LEAGUE, TOURNAMENT, EVENT, TEAM CAMP, SHOWCASE, AND UNIFORM COSTS FLUCTUATE, REQUIRE DEPOSITS OR FULL PAYMENT AND ARE NON-REFUNDABLE. THEREFORE, RISE AND GRIND TRAINING AND TEAM CRUSH BASEBALL RESERVE THE RIGHT TO OFFER EITHER A REFUND OR CREDIT.  
 

NO REFUND OR CREDIT FOR AN EVENT, GAME, OR PRACTICE THAT IS CANCELLED, RESCHEDULED OR POSTPONED DUE TO WEATHER, UNPLAYABLE FIELD CONDITIONS, NO FIELD AVAILABILITY, OR LOCAL, STATE, OR FEDERAL GUIDELINES, MANDATES, REQUIREMENTS OR RECOMMENDATIONS RESTRICTING PEOPLE FROM PARTICIPATING IN ANY ORGANIZED PRACTICE, GAME OR EVENT.

 

** RELEASE & MEDICAL CONSENT **

 I hereby give permission for my child/children to receive any medical attention necessary to be administered to my child until such time as I may be contacted. I hereby authorize any Officer, Coach, Assistant Coach, or representative of the Rise and Grind and TEAM CRUSH BASEBALL, to transport the registered child (ren) for any medical attention. I hereby give my consent for all medical care, including that prescribed or administered by a duly licensed Doctor or Dentist for the registered child(ren) under whatever conditions are necessary to preserve the life, limb or wellbeing of my child(ren). I hereby assume all risks and hazards incidental to my child (rens) participation at Rise and Grind facility and TEAM CRUSH BASEBALL, including transportation to and from activities, and do hereby waive, release and absolve the Employees, Coaches, Sponsors, Supervisors and Representatives of Rise and Grind and TEAM CRUSH BASEBALL, from any claim arising out of any injury to my child except to the extent and to the amount covered by accident liability or medical insurance.

 

** MEDIA RELEASE FORM **

I hereby give permission to RISE AND GRIND TRAINING and TEAM CRUSH BASEBALL to make and use photographs, videos, and/or audio recordings in which my child/children picture or image appears for all purposes and in all media and formats now known or later created including, without limitation, all promotional materials. I hereby waive any right that I may have to inspect or approve the finished product or products or advertising or printed matter that may be used in connection with this video, audio or photographs or the use to which it may be applied. I hereby irrevocably release and discharge RISE AND GRIND, CRUSH BASEBALL and its officers, directors, employees, and agents, from all claims, demands, and causes of action that I now have or in the future may have relating to the permitted use of my likeness. I agree that RISE AND GRIND and CRUSH BASEBALL will be the sole owner of all rights in the above-mentioned recordings.

 
** PLAYER CODE OF CONDUCT **

The following Code of Conduct Agreement is constructed as an instrument to emphasize those values, principles, and beliefs that are central to the foundation and structure of Team Crush Baseball Organization.

 

All players shall adhere to this Code of Conduct Agreement. Any infraction of this Code by a player that is deemed to be detrimental to a teammate, the team, or the organization may be cause for disciplinary action or immediate dismissal. The coaches reserve the right to interpret and enforce this Code in its sole and absolute discretion.

 
Players: At all times, I agree to and support:

- I will use every effort to be a positive member of my team and exhibit good sportsmanship at all times.  
- I will keep in mind that this is an extra-curricular activity and will keep my grades and behavior at an appropriate level so that I may participate.  
- I will attempt to attend and actively participate in every practice and event scheduled. If I cannot make it, I will inform my coaches as to why I am unable to attend.  
- I will practice and play to the best of my ability.  I recognize that I am playing a team sport; as such the interests of the team shall take precedence over individual exploits.  
- I will not criticize the performance of another teammate, a coach’s decision, a umpire’s call or an opponent.  
- I will conduct myself in a respectable manner at practices and at games.  I will not attempt ever to deliberately injure another player.  
- Refrain from any behavior that is unwelcome, offensive, creates a hostile environment or is demeaning to fellow athletes, including the use of foul language or gestures.
- Show respect for opponents, coaches, officials, parents, and spectators.
- Play by the rules of the game and not lie, cheat, or steal and encourage my teammates to do the same.
- I realize that failure to comply with the above regulations will result in loss of game time or suspension from athletic participation.
 

** Attendance Policy **

It must be understood that the time missed by the player can affect team chemistry and personal conditioning. Players who miss workouts, practices or competition for any reason may have their position or playing time adjusted.

 

** PARENT\GUARDIAN CODE OF CONDUCT **

PARENT: At all times, I agree to and support:

- Provide positive support, care, and encouragement for my child’s participation in sports by following this code of ethics.  
- I will encourage good sportsmanship by demonstrating positive support for all players, coaches, and officials at every game, practice, or other sports event.
- I will place the emotional and physical well-being of my child ahead of any personal desire to win.  I will insist that my child plays in a safe and healthy environment.  
- I will demand a drug, alcohol, and tobacco-free sports environment for my child and agree to assist by refraining from their use in the playing facilities.  
- I will remember that the game is for the children and not for the adults.
- I will ask my child to treat other players, coaches, fans, and officials with respect, regardless of race, sex, creed, or ability.  
- I (and my guests) will be a positive role model for my child and encourage sportsmanship by showing respect and courtesy, and by demonstrating positive support for all players, coaches, officials, and spectators at every game, practice, or other sporting events.
- I (and my guests) will not engage in any kind of unsportsmanlike conduct with any official, coach, player, or parent such as booing and taunting, or using profane language or gestures.
- Parents are not permitted near or in the dugout.
 

** Communication Coaches Expect From Parents **

Concerns expressed directly to the coach.
Notification of any schedule conflicts well in advance.
Specific concerns in regards to a coach’s philosophy and/or expectations.
Specific medical problems that could adversely impact your child’s performance or safety.
 

Appropriate Concerns to Discuss with Coaches

The treatment of your child mentally and physically.
Ways to help your child improve.
Concerns about your child’s behavior.
Family concerns that may have an emotional impact upon your child and his or her athletic participation.
 

Issues Not Appropriate to Discuss with Coaches

Playing time, team strategy, play-calling, lineups, substitutions, and other student-athletes on the team.
 

Unacceptable Contact with Your Child’s Coach

Prior to and during practice.
Prior to, during, or after a contest.
These are typically either very busy times or, in the case of a contest, emotional times for all parties involved. Things can and will be said that are not meant. Meetings of this nature do not promote resolution. There are situations that may require a conference between the coach and the parent. These are to be encouraged. It is important that both parties have a clear understanding of the other’s position. When these conferences are necessary, the following procedure should be followed to help promote a resolution. It is of utmost importance that the proper chain of command is followed. Though we understand your desire to talk with the Athletic Director, those phone calls first will be referred to the appropriate coach.

 
If You Have a Concern to Discuss with a Coach, This is the Procedure You Should Follow:

 
Call or email the coach (during an appropriate time) to set up an appointment.

If the coach cannot be reached, email info@crushbaseball.com to help schedule the meeting.

What Can a Parent Do If the Meeting with the Coach Did Not Provide a Satisfactory Resolution?

For parents/guardians of participants of minority age (Under 18 years old at the time of this registration)


FACILITY RULES AND GUIDELINES


ONLY COACHES AND PLAYERS ARE ALLOWED IN THE TRAINING FACILITY.
All players understand they use the facility at their own risk.  Injuries can result from the use of the batting cages.  The Rise and Grind Training is not liable for any personal injury.

Players must be accompanied by a coach at all times.

Always be alert and aware of your surroundings.

Watch out for stray balls.

Swinging a baseball bat is only allowed inside the batting cage.

Never stand in front of the pitching machine or home plate.

All players must wear proper batting helmets when hitting in a batting cage.

It is not permitted for Players to front toss, throw BP, or feed the ball to the pitching machines. These activities can only be performed by coaches.


No:
Hitting activity outside the batting cage is permitted. Absolutely no soft toss or T work is allowed outside of the batting cage net.

Cleats or spikes are allowed.

Gum, candy, seeds, food or drinks are allowed inside the training facility.

Horseplay.

Hanging or climbing on nets.

The rules have been established to ensure the safety of all players and coaches.  The rules must be adhered to at all times.  Individuals observed to be in violation of said rules are subject to the loss of privilege to use the facility.

 
This is to certify that I, as parent/guardian with legal responsibility for this Participant, have indeed read this release and agreement and I agree, for myself, my heirs, assigns, and next of kin, to release and hold harmless and waive subrogation to Rise and Grind and Team Crush Baseball and all others from any and all liabilities incident to my minor child’s involvement or participation in these outlined activities or programs, even if arising from the acts or omissions of Rise and Grind and Team Crush Baseball, to the fullest extent permitted by law. I further agree to instruct my minor child to comply with the stated and customary terms and conditions for participation in the program or activity itself. If they are behaving in such a way that is not in compliance with the terms and conditions for participation in the program or activity, I will remove my child from participation and bring such to the attention of the nearest Rise and Grind Training and TEAM Crush Baseball official immediately.
 

I have read and understood this release and agreement and agree to its provisions. I am not under the influence of any drugs, alcohol, or other intoxicants. I am not suffering from any illness or incapacity. I am over 18 years of age. (If not over 18 years of age, parent or guardian must sign.)
