To sign a waiver, you must be 19 and/or over and if this is for a minor, it must be completed and signed by a parent or legal guardian.

Signing this document means I have read and understand it entirely (not just this bold portion), and agree to its consents. My signature means, in part, that I understand participation in an activity at, or a class or program of ENERGETIC EDGE CHEER ASSOCIATION can be risky and dangerous, and may result in serious injury or death to me or my child, but that I will not sue or bring any action against EDGE CHEER, or anyone associated with ENERGETIC EDGE CHEER ASSOCIATION.

To: ENERGETIC EDGE CHEER and their respective directors, coaches, and Edge members.

 If you are signing this document ob behalf of a minor, you are (i) telling us that you are in fact that minor's legal guardian, and (ii) you are making the following acknowledgements on both your and that minor's behalf.

ASSUMTION OF RISK

I acknowledge that all programs and activities of Energetic Edge Cheer including, but not limited to cheerleading, dance, tumbling, team training, practices, open gyms, performances, competitions, demonstrations, community events, virtual online training, and travelling to and from such activities, whether held at the premises of Energetic Edge Cheer or else where, and no matter how or where the travel conducted  (collectively referred to as the "Activities") are physical activities that involve running, jumping, kicking, lifting, rotation, and coordinated body movements, I acknowledge that (a) the Activities themselves are inherently dangerous and (b) preparation for and travel to the Activities involve constant exposure to Energetic Edge Cheer staff, other participants and staff, and uncontrolled environments or conditions including but not limited to locker rooms and third party transportation ("Ancillary Activities"). I acknowledge and agree that participation by the Participant in the Activities and Ancillary Activities includes the potential that the Participant suffers, among other things, serious bodily injury, serious illness (including COVID-19), paralysis and death (the "Risks"). It is entirely my voluntary and informed choice that the Participant take part in the Activities and Ancillary Activities, and I knowingly accept the Risks and all consequences associated therewith.

WAIVER

In exchange for being allowed to participate in the Activities, I (on my own behalf, on the Participant's behalf as applicable, and on behalf of any next of kin, executor, administrator, or other assign of both myself and the Participant, where applicable) (collectively the "Successors") do hereby fully release Energetic Edge Cheer (including any of Energetic Edge Cheer professional advisers, board members, occupiers of property, coaches, or other assigns) (collectively, the "Released Parties") from any and all liability, claims and causes of action arising from any injury, damage or loss that I (or the Participant) may sustain as a result of any circumstances arising out of, connected with, or in any way associated  with or related to the Participant's participation in the Activities or Ancillary Activities. I understand this means I am waiving my right to sue the Released Parties for any claim related to the Participant, whether caused by the negligence of the Released Parties or otherwise. This is a complete and irrevocable release and waiver, and I covenant and agree not to bring any such claim.

INDEMNITY

I agree to indemnify, hold harmless and defend the Released Parties from any and all claims arising out of, connected with, or in any way associated with or related to the Participant's participation in the Activities or Ancillary Activities, regardless of who brings that claim. This indemnification includes, but is not limited to, legal fees.

MEDICAL AUTHORIZATION

In the case that the Participant sustains any injury or medical emergency during the Activities or Ancillary Activities, the coaches, or other associated representatives of Energetic Edge Cheer are authorized to act for the Participant, according to their judgement, which includes seeking immediate treatment and/or the necessary emergency care for the Participant. This authorization DOES NOT require a prior determination of a threat to the Participant's life or a danger of serious permanent injury to the Participant. I hereby hold coaches, or other associated representatives of Energetic Edge Cheer harmless in the exercise of the authority, including any such costs for emergency transport or treatment. If the Participant is participating in a virtual online training, no medical attention in immediately available and participants should stop if they feel discomfort.

AUTHORISATION FOR PHOTO/VIDEO USE & USE OF CONTACT INFORMATION

I authorise Energetic Edge Cheer to use photographs, video recordings or any other likeness of the Participant in its promotional or sales materials, advertisements, Facebook, Instagram, TicTok, or the like, and I hereby waive any right to compensation or any claim of ownership to such likeness. I agree with receiving a follow up email from Energetic Edge Cheer, understanding that I have the ability to opt out of all further emails. If the Participant is active on a Energetic Edge Cheer team, I also authorise Energetic Edge Cheer to release my contact information to the parents, Safety Parent, other representatives and coaches for purposes of providing fundraising, other related information to me and for communicating with me regarding Activities or Ancillary Activities.

GYM RULES & POLICIES

I have read, understand and agree to the Energetic Edge Cheer Gym Rules & Policies below. I understand they are designed for the safety and protection for me/the Participant and I hereby agree to inform my child (the Participant) of the risks of the Activities and Ancillary Activities and the importance of abiding by the Rules & Policies.

Use of the equipment is strictly forbidden without the proper supervision of a qualified Energetic Edge coach.

The Supervising Coach is in charge. The manager and/or supervising coach has the authority to refuse anyone entry to, or remove anyone from the gym.

Horseplay in the gym is not tolerated.

Open Gym is for ages 8 and up. 

All accidents/incidents must be reported to the supervising coach or gym manager immediately.

All equipment must be returned to its original place by the user.

Any skill which is unfamiliar to a person must not be performed without supervision by a certified coach.

Only clean indoor running shoes are allowed on the gym floor. Outdoor shoes must be placed on the shoe racks.

Jewellery of any kind, including all body piercing jewellery, is not allowed in practices, classes or open gym. Taping of piercings is only allowed in the months of May, June, July, and August. Keep this in mind if getting a new piercing. Outside of these months, piercings must be removed.

No shouting, swearing, or rude language while in the gym or while representing Energetic Edge Cheer.

Long hair must be tied back.

Finger nails must be an appropriate “sport length”. Athletes whose nails are deemed too long (unsafe) will not be permitted to practice until they are cut.

Appropriate athletic clothing must be worn while training in the gym. No loose clothing.

No gum, candy, food, or drink (except water) allowed in the training area.

Phones should be kept inside zipped up bags/purses while athletes are in practice or participating in an activity. Coaches will remove phones and not return until the end of practice to the parent, not athlete if needed to be taken away.

Proper equipment set-up and safety mats must be in place at all times for all skills at all levels.

Energetic Edge Cheer has a nut allergy alert in effect. Nut products are not allowed at Edge Gym/any facility Energetic Edge Cheer utilises.

Smoking, e-cigarettes, vaping, drugs (including marijuana) or alcohol are strictly prohibited while
at the gym, while in team gear/uniform or while representing Energetic Edge Cheer. Any athlete
contravening this may be immediately removed from their team and the gym.

Anyone coming to the gym under the influence of alcohol or drugs may be immediately dismissed
from the gym/program.

Jeopardising the safety of oneself or anyone else is grounds for disciplinary action or dismissal from the gym/program.

Inability or refusal to follow these and other coach directives and/or rules may result in immediate
expulsion from the gym/program. This applies to athletes, parents, and anyone visiting the gym.

ENERGETIC EDGE CHEER PAYMENT & REFUND POLICY

 Payments 
1. Payments may be made at the time of registration by any of the following means: 
a. CASH. 
b. EFT to: energeticedgecheer@hotmail.com 
c. CHEQUE to: Energetic Edge Cheer 

2. Regular fees for prep and all-star programs are due by the 5th of each month. All other fees are due at the time of registration and may be processed at any time. 

3. The first program fee or class fee must be paid prior to the athlete’s first practice/class. No exceptions.

 4. Payment must be made in full at the time of registration to ensure a spot in a class. 

5. A $45 NSF/late fee will be assessed to any declined payment or bank withdrawals that are returned. Accounts that are not paid on the due date will also have a $45 late fee assessed. 

6. Athletes with outstanding accounts may not be permitted to practice. 

 Refunds & Withdrawals for All-Star, Prep and Rec Teams: 
1. Withdrawals before the first scheduled All Star, Prep Plus, or Prep team practice, will receive a refund of fees paid less a $150 administration fee.

2. There are no refunds on All Star, Prep, and Rec fees after the third scheduled practice. If withdrawing from the program before the end of the third practice, a refund of fees paid in the initial payment minus a $150 administration charge will be given. 

3. Withdrawals from the program after the third scheduled practice will receive no refund on fees already paid. Additional fees and charges as per the payment schedule will cease 14 days after notice has been given in writing. 

4. Withdrawals must be made in writing to: energeticedgecheer@hotmail.com 

5. There are no refunds on uniforms, clothing, or shoes. 

6. There are no refunds on travel and or competition fees.

I have read and fully understand this release, waiver, indemnity and authorisation, Payment & Refund Policies and have had the opportunity to ask questions and have them answered. I am aware that by signing this release, waiver, indemnity and authorisation, Payment & Refund Policies I am giving up certain rights which I, my child, the Participant or my Successors may have against Energetic Edge Cheer. *
