Technology Release Agreement & Recipient Acknowledgement
EqOpTech Inc. (“DONOR ”), a California 501(c)(3) nonprofit, releases equipment ownership and any liability derived from its future use (such as parts or software break-down) to the transferee “ RECIPIENT”. RECIPIENT acknowledges that he/she received the technology equipment as indicated here from the DONOR at no cost to him/her for his/her use.
Donation Description: 1 Refurbished Computer with Software
Accessories: Built-in keyboard & mouse, WIFI and speakers and power adapter
DISCLAIMER:
Central Processing Units released for home use by DONOR are operational and in good working condition. Level of technological capability depends on the unit’s hardware specifications. All central processing units donated had a clean operating system installed. RECIPIENT is not entitled to any software upgrades. Software installed is provided “AS IS” and DONOR is not responsible for any faults found within. No additional warranties to these items either written or implied exist or may be made by DONOR or its employees.
RECIPIENT ACKNOWLEDGEMENT AND AGREEMENT
I acknowledge that I received all technology equipment as indicated on this form. I understand that EqOpTech Inc., Los Altos through the “Bridging the Digital Divide Program”, released ownership of the equipment to me, free of charge, and that if the equipment (hardware/software) needs service at a future date, the cost for the item(s) transportation, service, and repair will be at my own expense.
Non-Transfer Agreement:
I agree not to sell this donated computer or obtain profit from it.
Acknowledgement:
I agree DONOR have no liability or obligation to provide technical support services for the computer I received. In consideration for accepting donated computer from the DONOR, I hereby unconditionally release, waive, discharge and covenant not to sue EqOpTech, their officers, directors, agents, administrators, volunteers from any and all liability, claims, demands and actions related to any loss, damage, or injury relating to the donated equipment. I acknowledge that I have no claim against the DONOR for warranty of merchantability or fitness for a particular purpose; for loss of or damage to data; or for special incidental or indirect charges allegedly caused by the technology equipment and software from DONOR. I further hereby agree to indemnify and hold harmless the DONOR from any loss, liability, damage or costs, including court costs and attorney fees for all matters relating to the donated equipment. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, my heirs, assigns, and personal representative.
Proper disposal of computer at the end of its life:
With regard to donated equipment that is no longer in working order: Recipient is responsible for proper and lawful disposition of any and all items received from EqOpTech’s Bridging the Digital Divide Project.
Photo Use Release:
I hereby grant and authorize EqOpTech Inc. the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of me and/or my child to be used in and/or for legally promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats and markets now known or hereafter devised. This authorization shall continue indefinitely, unless I otherwise revoke said authorization in writing. I understand and agree that these materials shall become the property of EqOpTech Inc. and will not be returned.
I hereby hold harmless, and release EqOpTech Inc. from all liability, petitions and causes of action which I, my heirs, representative, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate.
***
