To successfully enrol an applicant please complete the application form and transfer the full course fee. No booking is secured until the full payment is received (with an exception where a non-refundable deposit is agreed) and a booking confirmation emailed to the applicant. All bookings are subject to availability and Maximum Performances reserves the right to decline any booking at its discretion. Non-refundable deposits are available on some courses where payment with instalments are offered. Once we receive this deposit the space is reserved for the applicant. The full payment must reach our account by the agreed date otherwise the reservation will cease and the space becomes available to other applicants. Non-refundable deposits are non-refundable and non-transferable once paid and in case of a cancellation will be deducted from the refunded amount.
Bank transfer or PayPal: If paying by bank transfer, please be aware that all bank or PayPal charges related to the payment must be paid by the applicant. If making payment from abroad please make sure that we receive the whole amount in £.
Due to the limited number of participants, specialist coaching arrangements, venue hire costs and other costs incurred in advance of the course, the following cancellation terms apply:
Cancellation more than 30 days before the course start date: 15% of the course fee will be retained as a non-refundable administration and booking fee. The remaining balance will be refunded.
Cancellation between 15 and 30 days before the course start date: 50% of the course fee will be retained. The remaining balance will be refunded.
Cancellation less than 15 days before the course start date: 100% of the course fee will be retained and no refund will be payable.
Non-attendance for any reason will be treated as a cancellation and no refund will be payable.
Illness, injury, medical conditions, travel disruption, adverse weather, family circumstances, school commitments or any other personal circumstances preventing attendance will be treated as a participant cancellation and the cancellation terms set out above shall apply. We strongly recommend that participants obtain appropriate cancellation insurance at the time of booking.
Any request to transfer a booking to another course, clinic, session or future date will be considered at the sole discretion of Maximum Performances and is subject to availability. Maximum Performances is under no obligation to offer a transfer, credit note, alternative session or other compensation.
These cancellation charges represent a reasonable estimate of the losses and costs incurred by Maximum Performances as a result of a cancellation, including administration, staffing, venue hire and other commitments made in advance of the session.
INSURANCE:
We strongly recommend that participants take out appropriate cancellation, travel and medical insurance at the time of booking. Participants should ensure that any insurance policy provides adequate cover for cancellation, illness, injury, travel disruption, medical emergencies and personal belongings.
Our cancellation policy applies where a participant is unable to attend due to illness, injury, travel disruption, family circumstances or other personal reasons. Appropriate insurance may assist participants in recovering costs in such circumstances.
Maximum Performances shall not be responsible for losses incurred by participants arising from cancellation, non-attendance, illness, injury, travel disruption or other circumstances beyond our reasonable control, except where such liability cannot be excluded by law.
Attendees are encouraged to obtain appropriate medical, accident and travel insurance for their own financial and personal protection.
Participants who are not resident in the United Kingdom may be required to provide evidence of suitable travel and medical insurance covering participation in swimming activities in the United Kingdom before their enrolment can be confirmed.
Participants are responsible for ensuring that their insurance arrangements are adequate for their individual circumstances.
PHOTOGRAPHS/VIDEOS:
Photographs and videos may be taken and used for marketing purposes – objections in writing to
info@maximumperformances.com will be respected. Copyright of all photography and video remains the property of Maximum Performances. Videos recorded for training purposes (for example during Exclusive Clinics, Masterclasses or One2one Sessions with Video-analysis) will be shared with attendees while using website –
www.wetransfer.com.
JURISDICTION CLAUSE:
Your booking grounds the contract between you and Maximum Performances UK Ltd in English law and the exclusive jurisdiction of the English Courts. The contract is formed when we email you a booking confirmation. Your contract cannot be amended unless confirmed in writing by an authorised representative of Maximum Performances and yourself.
TIMETABLE:
We always aim to deliver our tuition according to advertised timetables. However, Maximum Performances reserves the right to make reasonable changes to course timetables where necessary. Minor timetable changes shall not entitle participants to a refund. Where a change materially affects the course, Maximum Performances will consider appropriate remedies at its discretion.
CANCELLATIONS AND REFUNDS - BY MP:

Maximum Performances reserves the right to cancel the course up to 2 days before the start date if numbers enrolled have not reached the minimum requirement. In the occasion of cancellation all participants will be notified as soon as possible and a full refund of the course fee will be given within 5-14 working days after the cancellation. We cannot be held responsible for any other losses incurred as a result of such cancellations.
CHANGE OF VENUE:
If an alternative venue is required, Maximum Performances will use reasonable endeavours to secure a suitable replacement venue for the delivery of the course and will notify participants of any venue change as soon as reasonably practicable. If the course is delivered at the replacement venue, no refund shall be payable solely as a result of the venue change.
CANCELLATION DUE TO VENUE CANCELLATION:
Maximum Performances reserves the right to cancel any course at any point in case the course venue notifies us that the facilities are not fit for use on course dates or cancels our venue hire booking. In the occasion of cancellation all participants will be notified as soon as possible and a full refund of the course fee will be given within 5-14 working days after the cancellation. We cannot be held responsible for any other losses incurred as a result of such cancellations.
FORCE MAJEURE -’Event outside our control’:DELAY OR FAILURE TO PERFORM:
We shall not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation); an act of God, illness/virus outbreak, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to notify us of any changes of supplied information.
SAFETY:
Regulations made for the safety and comfort of course attendees, staff and others must be observed at all times.
BEHAVIOUR:
In order to guarantee the safety and enjoyment of all attendees Maximum Performances reserves the right to discipline and in extreme cases to send anyone home at the parent or guardian’s expenses, without the refund of fees.
PERSONAL LOSS / INJURY:
Maximum Performances staff will take all reasonable care of every attendee. However, participation in swimming and sports-related activities involves inherent risks and Maximum Performances cannot eliminate all risks associated with participation.
Maximum Performances shall not be liable for any loss of or damage to personal property, or for any injury, illness, loss or damage suffered by a participant except where such loss, damage, injury or illness is caused by the negligence of Maximum Performances, its employees, coaches or authorised representatives.
The parent or guardian enrolling a child onto our courses acknowledges that the applicant is voluntarily participating with knowledge of the inherent risks associated with sporting and swimming activities. Participants and their parents/guardians accept responsibility for injury, loss or damage resulting from risks inherent in such activities and/or from the participant's own acts, omissions or misconduct.
PERSONAL PROPERTY:
Maximum Performances will not be liable for any item of personal property brought by your child to our courses. Your child is advised not bring with them items such as mobile phones, personal music or media devices, jewellery, cash or other valuables. A attendee’s personal property is the attendee’s own responsibility, unless loss or damage is proven to be due to Maximum Performances’ negligence. If anything is missing, please notify staff immediately as there may still be time to find it before the end of the course. Items of property left behind by your child may be disposed of if not claimed and collected by you within 20 days of the end of our courses. We will endeavour to return items to their rightful owners, however delivery costs might be charged.
SUITABILITY TO ATTEND OUR COURSES:
Maximum Performances reserves the right to determine the suitability of an individual to participate in our courses and reserves the right not to accept a booking or to withdraw a participant from a course where we reasonably believe this is necessary for the safety, wellbeing or enjoyment of the participant, other participants, staff or any other persons involved in the course.
Parents or guardians must inform Maximum Performances at the time of booking of any relevant medical, behavioural, social, educational or other circumstances that may affect the participant's ability to participate safely and successfully in the course, or which may affect other participants or staff.
Any disability, medical condition or additional support requirement should be discussed with us at the time of booking so that we can assess the suitability of the course and consider any reasonable adjustments that may be appropriate.
Maximum Performances will consider reasonable adjustments where appropriate. However, where we reasonably believe that we cannot safely meet a participant's needs, provide an appropriate level of supervision, or ensure the safety and wellbeing of participants, staff or others, we reserve the right to refuse a booking or withdraw participation.
If relevant information is not disclosed at the time of booking and subsequently comes to light before or during the course, Maximum Performances reserves the right to refuse participation or withdraw the participant from the course.
In the event that a participant is refused participation or withdrawn from a course under this clause, no refund or reduction of fees shall be payable. Any additional costs incurred by Maximum Performances arising from such refusal or withdrawal shall be the responsibility of the participant's parent or guardian.
YOUR RESPONSIBILITIES:
It is your responsibility to ensure Maximum Performances is fully notified of any dietary needs, behavioural, medical or social problems that the applicant may have, particularly when those needs might affect the applicant or other participants during our courses. This is to ensure that Maximum Performances is able to provide a suitable level of care and supervision, to enable all participants to participate fully in our courses and to prevent individuals attending our courses who may require a higher level of (medical) care or supervision than Maximum Performances can reasonably provide.
ADMINISTERING MEDICINES TO STUDENTS:
Whenever possible, medication should be given at home and every effort should be made to avoid course hours. In case there is a need of medicine administering during the course hours please indicate so in your application form or once enrolled as soon as possible and request an Authorisation for Dispensing Medication Form. This form has to be filled in and submitted with your application or latest at the start of the course.
FIRST AID / URGENT TREATMENT CONSENT:
I, being the parent/carer/legal guardian herby give my permission for the administration of basic first aid treatment by staff or lifeguards supplied by the venue. In the event of an emergency I also authorise the staff or lifeguards supplied by the venue to take appropriate action to obtain necessary medical help for my child, including sending them to hospital. I also give permission for the staff to give the immediately necessary authority on my behalf for any medical or surgical treatment recommended by competent medical authorities, where it would be contrary to the swimmer’s interest, in the doctor’s medical opinion, for any delay to be incurred by seeking my personal consent.
COMPLAINTS:
In the event a participant has a problem or a complaint, it is important that they bring it to the attention of staff as soon as it arises. Any member of staff can be approached and will be willing to give assistance. If the problem is not resolved satisfactory the participant should contact the directors who have overall responsibility for our courses. COLLECTION AUTHORISATION:
For your child’s personal safety if a chaperone other than the parent is collecting your child please inform the directors while stating the name and relationship of the chaperone (please inform the chaperones that they may be asked to provide Photo ID for security purposes).
TRAVEL CONSENT:
I give my consent for my child to use the mode of transport during the course organised by Maximum Performances (for example trip to a doctor’s surgery or A&E). I give my consent that under circumstances considered appropriate by the Directors for my child to walk between the accommodation and the sporting facilities or on a public road where necessary accompanied by the Maximum Performances Staff. I give my consent for my son/daughter to use this mode of transport. I understand that every care will be taken to safeguard my son/daughter, but that the organisers cannot be held responsible for loss, damage or injury caused or suffered by my child arising during the trip.
YOUR INFORMATION:
All personal information will be handled sensitively and confidentially. We shall only store and use the information you supply to us for the purposes of carrying out our contract with you and to inform you of other services and programmes which we may make available in the future. PRIVACY:
Maximum Performances processes personal information in accordance with its Privacy Policy.
