Please submit only one form for each address, as we are limited to planting no more than two trees per address (or up to five if your address is between Tennessee Street/Mahan Drive and Orange Avenue). In the event of duplicate orders for a given address, we will use only the last order submitted and discard the earlier ones.

Temporary Construction Agreement with Rights of Access

I hereby grant the City of Tallahassee (CITY), and its designee, the right to enter upon the OWNERS property (PROPERTY) outside of the existing public Rights of Way (ROW) for the purpose of tree installation (PROJECT) on OWNER’S PROPERTY. Community Beautification, or its designee, will enter the PROPERTY for the sole purpose of installing the tree(s) requested by OWNER through the Adopt a Tree program.

The CITY’s right to enter upon the PROPERTY shall be limited to time and the areas necessary to access the tree PROJECT. All access to the PROPERTY will be made on foot; no vehicles or motorized equipment will enter the PROPERTY.

The OWNER agrees that the City shall not be responsible for the maintenance, removal or replacement of any tree after installation.

The OWNER will defend, indemnify, and hold harmless the City from any and all claims demands, suits or damages, including those arising from personal injury or bodily or property damage, in connection with any of the actions performed pursuant to this Agreement.
