This Release and Waiver of Liability in favor of The Ark of San Juan Companion Animal Rescue (“The Ark”). Volunteer desires to work for The Ark and engage in the activities related to being a volunteer for a work project. I, the volunteer, hereby and freely and voluntarily, without duress, execute this Release under the following terms:

1.Waiver and Release: I forever discharge and hold harmless The Ark and its adoption partners from any liability or (civil and administrative) claim that I may have against The Ark and its adoption partners and successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work and association with The Ark and its adoption partners. Adoption partners are herein defined as entities that provide venues for The Ark to hold its adoption events and operate special facilities such as catteries or kennels. Adoption partners herein defined shall also include PetSmart and PetSmart Charities as well as Petco. I understand and acknowledge that this Release discharges The Ark and its adoption partners from any liability or claim that I may have against The Ark and its adoption partners with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to The Ark or occurring while I am providing volunteer services. Further I understand that The Ark and its adoption partners do not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of my injury, illness, death or damage of my property. I expressly waive any such claim for compensation or liability on the part of The Ark and its adoption partners beyond what may be offered freely by The Ark in the event of such injury or medical expenses incurred by me.

2.Insurance: Further I understand that The Ark does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of my injury, illness, death or damage to my property. I expressly waive any such claim for compensation or liability on the part of The Ark beyond what may be offered freely by The Ark in the event of such injury or medical expenses incurred by me.
3.Medical Treatment: I hereby Release and forever discharge The Ark from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a volunteer with The Ark.

4.Assumption of Risk: I understand that the services I provide to The Ark may include and involve certain activities and companion animals which present an inherent risk of injury. In consideration for the risk of injury while participating in animal rescue with The Ark and as consideration for the right to participate, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation with The Ark and Release and forever discharge The Ark, its officers, directors, affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, adoption partners, predecessor, successors and assigns, from any physical or psychological injury, including but not limited to illness, personal injury, property damage, economical or emotional loss, that I may suffer as a direct result of my voluntary participation with The Ark.

5.Photographic Release: I grant and convey to The Ark all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by The Ark in connection with my providing volunteer services to The Ark.

6.Other: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California, and that this Release shall be governed by the laws of the State of California, without giving effect to any of its conflict of laws, provisions, and litigation, if any, regarding this Agreement will be brought in federal or state court in Orange County, California. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable. I agree to indemnify and hold harmless The Ark against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or anyone else acting on my behalf.
