The Coordinating Partners (collectively, the Sponsor and the Arboretum) are committed to conducting this tree planting project in a safe manner and hold the safety of the Volunteer in high regard. The Coordinating Partners strive to reduce risks of injury and therefore require that you, as the Volunteer, follow safety rules and instructions that are designed to protect your safety.  

Notwithstanding such precautions, you, as the Volunteer, are voluntarily participating in this activity with the knowledge of  the risks and dangers involved, which include, but are not limited to the following: contact with other participants, rough terrain within the tree planting area, the effects of the weather (including wet pathways), travel to and from the tree  planting, equipment failures, and acts of God; all such risks to yourself being known and appreciated by you. Further, you are acknowledging that not all hazards or dangers can be foreseen and that the Coordinating Partners cannot guarantee absolute safety even with the precautions it is undertaking.

You are solely responsible for determining if you are physically fit and/or properly skilled for this activity. It is always  advisable, especially if the volunteer is pregnant, disabled in any way, or recently suffered an illness, injury or impairment,  to consult a physician before undertaking any physical activity.  

As lawful consideration of, and as part of the payment for, the right to participate in the tree planting project, I hereby  expressly agree to be responsible for my own welfare and assume all of the above risks, including both those known and  unknown to me.

As lawful consideration of, and as part of the payment for, the right to participate in the tree planting project, and as part of the payment for the services arranged for me by the Arboretum, I HEREBY EXPRESSLY AGREE TO RELEASE, DISCHARGE AND  HOLD HARMLESS FOREVER the Coordinating Partners, their trustees, employees, shareholders, affiliated entities, employees, agents, representatives, officers, directors, associates, volunteers, successors and assigns from and against any  liability, actions, causes of actions, debts, suits, claims and demands of any and every kind and nature whatsoever which I  now have or which may hereafter arise out of or in connection with the tree planting project or participation in the  activities arranged for me by the Coordinating Partners. I agree that the terms of this agreement shall serve as a complete  release and express assumption of risk for myself, my heirs, successors, assigns, and legal representatives. It is my intention  to fully assume all risks associated with this tree planting project and to release the Coordinating Partners from any and all  liability to the maximum extent permitted by law.

I further agree to indemnify the Coordinating Partners against any claim by any person arising in whole or in part from an  injury or other loss suffered or caused by me in connection with my participation in the tree planting project.  

I have carefully read and understand the provisions and legal consequences of this agreement, and I hereby agree to all of  its terms. I agree that execution of a facsimile counterpart or electronic transmission of this agreement shall be deemed  execution of the original agreement.
