RELEASE WAIVER & INDEMNITY FOR PARTICIPATION:

I, parent/guardian, hereby give and assign to Austin Texans Soccer Club, and its legal representatives the right and permission to publish my child’s name, likeness, photographic image, video, and biographical data for the specific purpose of publicity and promotion of the player, team, and/or Austin Texans Soccer Club.

In consideration of Austin Texans Soccer Club allowing my child to participate in Austin Texans Soccer Club programs, I HEREBY WAIVE AND RELEASE, INDEMNIFY, HOLD HARMLESS AND FOREVER DISCHARGE Austin Texans Soccer Club, CITY OF CEDAR PARK, WILLIAMSON COUNTY REGIONAL PARK, TAYLOR REGIONAL SPORTS COMPLEX, AUSTIN INDOOR SOCCER, SOCCERPLEX-CEDAR PARK, LAKELINE, SOCCER ZONE SOUTH,TOWN & COUNTRY OPTIMISTS, CITY OF AUSTIN, CITY OF BUDA, AUSTIN INDEPENDENT SCHOOL DISTRICT, NORTH AUSTIN LIONS CLUB, NORTH AUSTIN OPTIMISTS, STEINER RANCH MASTER ASSOCIATION, CITY OF PFLUGERVILLE, 1849 PARK, WELLS POINT PARK, CITY OF ROUND ROCK, ROUND ROCK MULTIPURPOSE COMPLEX, ROUND ROCK SPORTS CENTER, AND ANY OTHER PARTNER OR PROVIDER OF FACILITIES, ITS AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS (HEREBY JOINTLY AND SEVERALLY REFERRED TO HEREIN AS “RELEASED PARTIES”), OF AND FROM ANY AND ALL CLAIMS, DEMANDS, DEBTS, CONTRACTS, EXPENSES, CAUSES OF ACTION, LAWSUITS, DAMAGES, AND LIABILITIES, OF EVERY KIND AND NATURE, WHETHER KNOWN OR UNKNOWN, IN LAW OR EQUITY, THAT I OR MY CHILD EVER HAD OR MAY HAVE ARISING FROM OR IN ANY WAY RELATED TO MY CHILD’S PARTICIPATION.

This waiver and release include (but is not limited to) claims based on or arising from any injuries to my child resulting from said child’s participation in any of the training, camps, or related soccer or physical activities conducted by, or on the premises of, or for the benefit of any of the RELEASED PARTIES as well as injuries resulting from engaging in fitness or strength and endurance workouts, practicing and/or engaging in soccer practices, scrimmages, tournaments, league games or other related activities including travel to and from. I understand the activities that said child will participate in can be dangerous, involves risks of serious bodily injury, including permanent disability, paralysis, and death, including but not limited to exposure to and illness from infectious diseases such as COVID-19, influenza, and other viruses, which can cause bodily injury, disability and possibly death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the RELEASED PARTIES named above; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I and/or my minor child incur as a result of my and/or my minor child’s participation. On behalf of myself, child, my heirs, assigns and next of kin, my child, my spouse (if applicable), and I waive all claims for damages, injuries, and death sustained that we may have against RELEASED PARTIES regarding any such activity. I certify to the best of my knowledge that my child's current physical condition is satisfactory for participation in the Austin Texans Soccer Club soccer program and that my child is free of any health problems, which would endanger his/her, participation. I will inform the coach should his/her condition change at any time during his/her participation in this program. This waiver of liability does not apply to any acts of gross negligence or intentional, willful, or wanton misconduct.

I further agree that in consideration of and as a material term of Austin Texans Soccer Club, Inc. agreed to allow my child to participate, I AGREE TO INDEMNIFY, DEFEND AND HOLD Austin Texans Soccer Club. HARMLESS FOR THE COST OF DEFENDING AND SATISFYING ANY CLAIM THAT IS FILED AGAINST Austin Texans Soccer Club BASED ON OR ARISING FROM INJURIES TO MY CHILD.

This waiver and release contain the entire agreement between the parties and supersedes any prior written or oral agreements concerning this subject matter. The provisions of this may be waived, altered, amended, or repealed, in whole or in part, only upon the prior written consent of all parties.

I have read, understand, and fully agree to the terms of this waiver and release. I agree to pay all fees as outlined in the 2025-2026 commitment agreement and understand that failure to pay fees may result in my child being placed in “no train” status. I understand and confirm that by accepting this waiver and releasing said child and I have given up considerable future legal rights. I have accepted this Agreement freely, voluntarily, and under no duress or threat of duress, without inducement, promise, or guarantee being communicated to me. By signing below, I am executing a complete and unconditional waiver and release of all liability to the full extent of the law. I understand that Austin Texans Soccer Club is a Texas non-profit corporation. I expressly agree that the foregoing Release Waiver is intended to be as broad and inclusive as is permitted by the law of the State of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Photo Release and Liability Waiver

This form must be completed for each soccer player (participant) and, if the player is under 18-years old, must be approved by the player’s parent or legal guardian. No player will be allowed to participate in the tryout without this form, properly executed, and on file. , I do hereby willfully acknowledge that my consent below attests to my understanding and agreement that: I will not compromise myself in such a way as to do harm to the tryouts, knowing that players may be dismissed from participation, with possible loss of payment or dues, for violent conduct or unsportsmanlike behavior on or off the field of play. I agree to pay for any and all damages to any property or indemnities caused by me willfully, negligently, or otherwise.

 I hereby grant Austin Texans Soccer Club permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of the Austin Texans Soccer Club and will not be returned. I hereby irrevocably authorize Austin Texans Soccer Club to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge Austin Texans Soccer Club from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I understand that playing or participating in the above sport may be a potentially dangerous activity involving risk of injury. I understand that in any contact sport, such as the sport involved during this tryout as an athletic participant can be seriously injured. I am aware that the dangers and risks playing or participating in the above sport include, but are not limited to, falls, contact or collisions with other participants, equipment and facilities, and the effects of weather, including high heat and humidity (facilities are not air conditioned). I have certified to the owner, by my acknowledgment below, that I/my child is in good health and physical condition and sufficiently able to participate in the above sport. I have advised the owner of any limitations on myself/child's activities for medical reasons in this document. Knowing and having been informed of the potential dangers and risks associated with playing the above sport, and in consideration of myself/ child being allowed to participate in the tryout, I hereby agree on behalf of myself, my family members and or my child to assume all such risks and, further, to waive, release, discharge and hold harmless the Austin Texans Soccer Club, its owners and their respective employees from any and all liability, actions, causes of actions, claims or demands for personal injury and/or illness of any kind or nature, and any other claims whatsoever arising out of, or in any way connected with, myself/ child's playing and participating in the above tryout. This Release and Waiver extends to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown. The tryouts does not have personal injury insurance that covers my participation. Therefore, I should have a personal injury insurance policy in force. Under any condition, I am responsible for any and all medical expenses arising from my participation, both in practices and games and while travelling to and from these events.

Financial Responsibility 

Upon committing to the Austin Texans Soccer Club, you are financially obligated to complete all payments until the final payment is made. 

COVID-19 PANDEMIC PLAYER CONSENT FORM Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is highly contagious and is believed to spread mainly from person-to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Austin Texas Soccer Club, has put preventative measures to reduce the spread of COVID-19; however, Austin Texans Soccer Club cannot guarantee that you or your child(ren) will not become infected with COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and/ or team members and I may be exposed to or infected by COVID-19 by attending this event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the tournament may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the event (“Claims”). On my behalf, and on behalf of my children, I at this moment release, covenant not to sue, discharge, and hold harmless Austin Texans Soccer Club, and its employees, agents, and representatives, of and from the Claims, including all

liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Austin Texans Soccer Club, and its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation.
