By completing this form, you are agreeing to HEYDAY ATHLETIC'S participation and release of liability waiver.

In consideration of being permitted to participate in any league, event or activity sponsored by Heyday Athletic (Heyday) the undersigned, for myself, my representatives, assigns, successors and heirs, acknowledge, appreciate, understand and agree that:

1. Participation in any league, event or activity conducted by Heyday is a test of a person's physical and mental abilities and carries with it the risk for serious injury, permanent disability, paralysis, and/or death. While Heyday employs particular rules, equipment, and personal discipline to help reduce these risks, the risk of serious injury and/or severe social and economic losses does exist. The risks include, but are not limited to, those caused by my own actions or the actions of participants, facilities, temperature, weather, condition of athletes, vehicular traffic, lack of hydration, the rules of play, or the condition of the premises or any equipment used, which may result not only from personal action, inactions or negligence, but the actions, inactions or negligence of other people including but not limited to, participants, volunteers, spectators, event organizers, event officials, facility staff and other facility users. I understand and voluntarily accept the aforementioned risks and agree on behalf of myself, my heirs, executors, administrators, successors and assigns that Heyday, its officers, directors, members, agents and independent contractors will not be liable for any injury including, without limitation, personal, bodily or mental injury, economic loss, or any damages to myself, my spouse, my domestic partner, guests, unborn child, or relatives, resulting from the negligent, reckless or intentional conduct of Heyday or anyone on Heyday's behalf whether related to Heyday's leagues, events and/or activities or not.

2. In consideration for permitting me to engage in Heyday leagues, events and/or activities, I agree for myself, my executors, administrators, heirs, successors and assigns as follows:

(A) I WAIVE, RELEASE AND DISCHARGE Heyday, including its officers, directors, members, agents, volunteers, representatives and independent contractors, from any and all liability including, but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which my hereafter occur to me including my traveling to and from Heyday leagues, events and/or activities.

(B) I INDEMNIFY, HOLD HARMLESS AND PROMISE NOT TO SUE the entities and persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in Heyday leagues, events and/or activities, whether caused by the action or inaction of the released parties or otherwise.

3. Prior, during or after participation, I agree to inspect the facilities and equipment to be used, and if I believe anything in the playing environment is unsafe, I will immediately bring such to the attention of the nearest facility staff member and notify Heyday of such condition(s) and refuse to participate.

4. I am legally and financially accountable for any damage/theft to venue property (including the facility itself) and Heyday's equipment.

5. I am at least eighteen years of age, physically fit, have trained sufficiently for participating in Heyday leagues events and/or activities and

have not been advised otherwise by a qualified medical person. I also certify that I will be enrolled in a qualified health insurance plan throughout participation of the league and consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness.

6. I must abide by all Rules and Regulations set forth by Heyday (and the host facility). In the event that I am unable to abide by all rules and regulations, I acknowledge and agree that Heyday organizers reserve the right to suspend and/or terminate current and/or future participation without refund of any portion of paid league fees.

7. During participation in the league or related activities, I may be photographed, videotaped, or have my likeness reproduced and that such media shall be the sole and exclusive property of Heyday. I agree to allow my likeness to be reproduced by Heyday and used for any legitimate purpose by Heyday in its sole discretion.

8. Payment is non-refundable. Late fees can be assessed after deadlines for late registrants (team players). All registration is first come, first served and is subject to availability. Heyday reserves the right to cancel or modify registrations at any time.

9. I understand that this Waiver is intended to be as broad and as inclusive as permitted by the laws of the Commonwealth/State wherein my registered activity is hosted and I agree that if any portion is held to be invalid, the remainder of this Waiver will continue in full force and effect. I further agree that the venue for any legal proceeding regarding this Waiver and/or my participation in Heyday leagues, events or activities shall be in or near (30mi) Philadelphia, Pennsylvania.

THE PARTICIPANT HAS READ THE ABOVE WAIVER TERMS AND LEAGUE RULES AND REGULATIONS, AGREES AND UNDERSTANDS THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SUBMITTING THEIR REGISTRATION AND IN EFFECT PROVIDING AN ELECTRONIC SIGNATURE AGREEING TO THESE TERMS KNOWINGLY, VOLUNTARILY AND INTELLIGENTLY.
