I will inspect the premises and, if at any time I feel anything to be unsafe, I will immediately refuse to participate in any activities and will leave the premises immediately. General Waiver of Liability Agreement

In consideration of the opportunity afforded me to participate in events (special or otherwise), volunteering, and horseback riding sponsored by ORR FARM RESCUE & SANCTUARY, INC., also referred to as ORR PROPERTIES, LLC, on the grounds located on the following described real property, to-wit: parcel of land located in Chambers County, Alabama. This parcel includes, but is not limited to, ORR FARM RESCUE & SANCTUARY, INC. campground and any facility located thereon being operated by ORR FARM RESCUE & SANCTUARY, INC.

This waiver serves as recognition of the possible dangers to which I voluntarily subject myself by participating in events (special or otherwise), volunteering, horseback riding, and any other related activities associated with ORR FARM RESCUE & SANCTUARY, INC. Knowingly, freely, and voluntarily, for myself, my heirs, personal representatives,

I understand that by initialing and signing this waver, I waive any right or cause of action of any kind whatsoever arising because of my participating in events (special or otherwise), fundraisers, volunteering, horseback riding, or any other related activities located on or adjacent to said described real property from which any liability may or could accrue to ORR FARM RESCUE & SANCTUARY, INC and/or ORR PROPERTIES, LLC.

I assume all risks of injury and danger to myself, including death or any other accident, while participating in any activities incidental thereto. I know that the risks and dangers may be caused by my own actions and inactions, and the actions or inactions of others participating in the events.

I assume all risks of injury to myself and to my property while present at ORR FARM RESCUE & SANCTUARY; I understand that the activities of riding, or the event, are dangerous and can result in being seriously injured, including being paralyzed or killed; I understand horseback riding participants are encouraged to wear a helmet; I will utilize all safety precautions while volunteering or visiting ORR RESCUE & SANCTUARY.

Specifics of Liability Agreement

For myself and my heirs, personal representatives, or assigns, from the date of this release and waiver agreement, and forever hereafter, I hold the said owners and ORR FARM RESCUE & SANCTUARY, INC. harmless and blameless for any injury to myself, including death, occasioned by my participation in, or presence at, any activities, whether resulting by or through the negligence of the owners, or ORR FARM RESCUE & SANCTUARY, INC., their agents, officers, volunteers, or employees. Should I, my heirs, personal representatives, and/or my heirs’ legal representatives and/or assigns take action, I hereby agree to pay all costs of such action, including attorney’s fees and court costs incurred by them.

I have read the Appendix (included in this form) regarding specific behaviors and inherent dangers of the presence of horses, cows, goats, dogs, and roosters. I agree to heed all advice given, and to ask the directors of ORR FARM RESCUE & SANCTUARY, INC. if I have further questions about the animals.

I also understand that under Alabama law, an equine activity sponsor or equine professional is not liable for any injury or death of a participate in equine activities resulting from the inherent risks of equine activities.

I understand that participants may take photos during the event (from the beginning date through the ending date, and during al times in between, whether taken or “personal time” or otherwise), however, neither participants nor their agents may use such photos for any commercial purposes without the express written permission of ORR FARM RESCUE & SANCTUARY, INC. addressed under separate written agreement with ORR FARM RESCUE & SANCTUARY, INC. Participants may share their photos in which event participants acknowledge that by doing so, such photos may be used by ORR FARM RESCUE & SANCTUARY, INC. I further acknowledge that participants agree that their name, address, phone, email address, and other information contained herein and/or learned by ORR FARM RESCUE & SANCTUARY, INC. during the event may be shared with other registrants, vendors, sponsors, and/or used for any other promotion or reason by ORR FARM RESCUE AND SANCTUARY, INC., as it, in its sole discretion may determine. I hereby agree to waive my rights of privacy or publicity with the regard to ORR FARM RESCUE & SANCTUARY, INC (and those acting under their authority), copyrighting, distributing, televising, publishing, and using in any way the audio and visual portions of any film and photographs of me or of interviews, scenes, or other sequences in which I may be included, and any reproduction thereof, anywhere at any time through any media for advertising, promotion, trade, television programming, or other lawful purpose whatsoever, and I shall not be entitled to receive any royalties or other compensation with such use.

I understand and agree that this release applies to all participation and former events and activities, current events on this date, and all future events. This agreement shall remain in effect from the date signed until termination by me in writing and shall apply each time I, my child(ren), or any person that I sign for as a guardian participate in any activities in, on, or around ORR FARM RESCUE & SANCTUARY, INC. regardless of frequency. Any termination of this agreement shall be in effect only with respect to activities occurring after the date of termination and shall have no effect of the validity of the agreements or releases set for herein with respect to any event occurring prior to such termination.
