Now is the time to Stand up, Speak out and Shield Vermont!
1. Vermont’s constitution DOES NOT HAVE an equal protection provision.
2. States may provide greater protections of
rights under state constitutions than are provided by the federal constitution as interpreted by the
U.S. Supreme Court.
3. An equal protection clause to the Vermont constitution would
represent an important symbolic commitment to the principle of equal protection under the law giving expression to the fundamental values and commitments of the
people of a state.
Proposal 4 would provide Vermont with:
A state constitutional foundation for equal protection
Independence from federal doctrinal collapse
Capacity to address disparate impact and systemic harm
Authority to scrutinize discriminatory algorithms
Constitutional support for durable civil rights policy
