Exception Request Requirements
CDASS members or their Authorized Representatives (AR) may request an exception to hire a prospective attendant who has been found initially ineligible for hire by their FMS.
The prospective attendant must meet the following requirements to receive an exception. Note: Conviction means there is a "Guilty" court disposition on the report for the charge(s) that made them initially ineligible for hire.
- Abduction / Kidnapping: Conviction must be 10 years or older
- Any Violent Felony: Conviction must be 20 years or older
- Child or At-Risk Person Abuse, Neglect, or Exploitation: Misdemeanor conviction must be 10 years or older. Felony conviction must be 20 years or older.
- Crimes Against a Child or At-Risk Person that Causes Harm: Misdemeanor conviction must be 10 years or older. Felony conviction must be 20 years or older.
- Felony Arson within the last 10 years: Conviction must be 10 years or older
- Felony Drug Offenses: Conviction must be 3 years or older
- Felony Fraud within the last 5 years: Conviction must be 5 years or older
- Felony Theft: Conviction must be 5 years or older
- Felony Involving an Act of Domestic Violence: Conviction must be 20 years or older
- Hate Crimes within the last 10 years: Conviction must be 10 years or older
- Neglect or Abuse by a Caregiver: Conviction must be 10 years or older
- Sexual Offenses: Conviction must be a misdemeanor

- Murder / Homicide
- Purchase or Sale of a Child
- Sexual Exploitation Against a Child or At-Risk Person
