I warrant that I am in good health and have no medical or health condition that could endanger or limit my ability whilst participating in an Event. If I am in doubt about my ability to take part in any Event or if I have a medical condition, I agree to consult a doctor prior to participation in that Event. I understand and have considered and evaluated the nature, scope and extent of the risks involved and I voluntarily and freely choose to assume all risks involved in the Event, both known and unknown. I also consent to treatment in the event of an emergency or other incident in which, in the reasonable judgement of the on-site personnel, I require medical care and agree to comply with the reasonable instructions of the Event leaders during the course of the Event.

Run Club has made no representation to me as to the suitability, condition, or safety of the Event venue and I acknowledge that participation in the Event may involve risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage. These may result from and include but not be restricted to my own actions or inactions, as well as the actions or inactions of others, the rules of play, and the condition of the facilities and equipment.  

2.1. I agree that at all times during an Event that I will adhere to all instructions given by the Event Leader at the Event or provided in advance of an Event. This includes, but is not restricted to, the requirement to wear clothing and footwear suitable for participating in the Event (such as  warm or waterproof clothing if the weather so requires) or to ensure I have sufficient nutrition and hydration with me for the Event in question.

2.3. I accept that Run Club is not obliged to put on any Events and that the Event Leader reserves the right to refuse entry to an Event or ask me to leave participation if I:

(c). am likely to cause offence to others including but not restricted to swearing, being abusive, threatening, violent or aggressive to others or causing a nuisance;

(d). am injured or show signs of illness; or

(e). fail to arrive at the specified time for the Event.

Where participation is blocked or terminated, Run Club reserves the right to block my participation in any future Events.

 
2.4. Run Club are not obliged to organise a minimum number of Events over any calendar year and may cancel an Event if circumstances beyond their reasonable control arise, including, without limitation, epidemic or pandemic threat, war, civil or political unrest, terrorism, inclement weather conditions or any other unforeseen circumstances. In such circumstances they will, if practicable, provide written notice of cancellation to the address given by me. In the event that written notice is not practicable due to the timescales involved they will use reasonable endeavours to provide other suitable methods of notice which may include, e-mail, mobile phone, text message, or social media.

3.1. I hereby fully and forever release and discharge Run Club from and against any and all liability, claims, causes of action, costs, losses, damages or proceedings whatsoever arising out of or in connection with my participation in or attendance at an Event (save for my death or personal injury resulting from the negligence of Run Club). This release also extends to WRTC UK Limited  trading as Run4It and to their affiliates and subsidiaries, their respective officers, directors, shareholders, employees, agents, representatives, contractors, successors, assignees, and insurers, all Event sponsors, organisers, advertisers, volunteers, and staff, and all owners or lessors of premises used in connection with any Event.

3.2. I hereby agree that I shall indemnify and keep Run Club indemnified against any claim made by any third party for death, personal injury or damage to property arising out of or in connection with my negligent actions or omissions whilst participating in any Event.

I understand that the Run Club and others involved in the Event do not provide me with any insurance, whether life or medical or liability, for any illness, accident, injury, loss or damage that may arise in connection with my participation or attendance at the Event.  If I want insurance of any kind, I must obtain my own.  I will pay my own medical emergency expenses and all subsequent medical expenses in the event of any illness, accident, or injury in connection with the Event.

I understand that the Run Club and others may photograph or film at the Event for advertising, promotional or other commercial purposes.  I hereby consent and agree that photographs, film and video and sound recordings may be taken of me whilst participating in the Event or related activities.  I irrevocably grant the Run Club, its affiliates, subsidiaries, successors, assignees and licensees an irrevocable and royalty-free licence in perpetuity and throughout the world, without any expectation of compensation, to use my photograph, video or film portrayal, image, likeness, voice and name in any manner or media (whether now known or hereafter developed or discovered) and for any purpose.  I irrevocably and unconditionally waive the benefits of and agree not to assert any provision of law known as “moral rights” or any similar laws of any jurisdiction.  

I hereby grant to the Run Club and its affiliates and subsidiaries a perpetual royalty free licence to use all comments, feedbacks and ideas I may share with them, without notice, compensation or acknowledgement to me, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving products and services.

7.1. The personal information in this Agreement (including any sensitive personal data) and any other personal information I pass to you (whether through forms I complete, emails, texts or other communication with Run Club) is processed to enable Run Club to organise, stage and administer the Event. The purposes of the processing includes but is not limited to the following:

• to assess my suitability to participate in the Event;
• to make arrangements in connection with the Event, including but not limited to: booking and payment arrangements (if any) and provide me with training information and Event updates; and
• to ensure the safety and security of all participants in the Event, including but not limited to health and safety purposes.

7.2. In the event of an emergency or if I require medical treatment as stated in Clause 1 above I hereby agree that Run Club may provide any personal information I have provided (including emergency contact details) to the emergency services or health care professionals for the purposes of treatment and for contacting the emergency contact.

7.3. I agree that my personal information may be anonymised and the anonymised data may be used in connection with the compilation of statistical information and to improve health and safety procedures at future Events.

7.4. I agree that all personal information provided by me is true, accurate and up to date and that I will keep you updated in relation to any changes in the same as soon as practical after a change is made.

I agree that the Run Club may assign the rights granted to it in this Deed of Release to any third party as it sees fit.

If any portion of this Agreement in part or in full is held invalid or unenforceable, all other provisions shall continue to be valid and enforceable. This Agreement supersedes any oral or written statements made by or to me in relation to the Event.  I understand that I cannot terminate, cancel, or revoke this Agreement  for any reason.

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed  in accordance with Scottish law and shall be subject to the exclusive jurisdiction of the courts of Scotland.
