My name is Olivia. I am doing a questionnaire survey as part of my research on the dual administration roles in the NZS 3910:2023 construction contract. This forms part of my Master of Construction (Construction Law) at Massey University.
2 Target participants, duration, and what is in it for you?
If you have an interest in construction contracts in New Zealand in any capacity, I invite you to participate in my survey. It will take you about 10 minutes.
If you do this survey, I will happily share a summary of the key findings with you soon after I complete my research in January 2025.
3 Background
The old NZS 3910:2013 had one person named engineer doing two roles. The gist of the two roles are (i) acting as the Principal's agent and (ii) acting as an independent professional. The new NZS 3910:2023 edition now identifies and separates the two roles and renames each role to be done by a Contract Administrator and Independent Certifier. The Contract Administrator acts on behalf of the Principal and issues instructions, while the Independent Certifier generally makes decisions independently. Both persons are typically engaged and paid by the Principal.
This study explores the industry's perception of how these separately identified roles function in practice, how effective these provisions are, and any challenges faced. Among the potential challenges include the provision for both roles to be done by the same person.
3 Project data and confidentiality
The data you provide will be kept confidential and stored securely. Only the researcher and the supervisor have access to the survey data. You can do this survey anonymously. Your participation is voluntary, and you will not be identified in any publication of findings. But if you want me to send you a summary of the key findings of this research, please provide your email at the end of the survey.
4 Ethics committee notification
This project has been evaluated by peer review and judged to be low risk. Consequently, it has not been reviewed by one of the University’s Human Ethics Committees. The researcher named below is responsible for the ethical conduct of this research.
