IN CONSIDERATION of receiving permission from Newport Skatepark, Inc. (hereinafter referred to as "the Skatepark") to enter the premises of Newport Skatepark, the receipt of such permission being also acknowledged, the undersigned participant and their parents/guardian, if they are under the age of 18 years, hereby releases the Skatepark, its agents, its officers, servants, and employees, of and from any loss, damage, or injury, including death, that may be sustained by the participant, or any property of participants' parents/guardian, while in, on, upon or near the premises.

Both participant and participant's parents/guardian are duly aware of the risks and hazards inherent upon entering said premises and/or in participating in activities at the subject premises, and hereby voluntary elect to enter - or have their children enter upon said premises and participate in activities thereon, knowing the present condition of the facilities and knowing that said condition of the facilities may become hazardous, or dangerous - or more dangerous during the time that the participant is on the premises or continues to, from time to time, use the facilities. The participant and/or their parents/guardian if participant is below the age of 18 years, hereby voluntarily assumes all risks of loss, damage, or injury, including death, that may be sustained by the participant or participants' parents/guardian or any property of either, while in, on, near or upon the premises and/or skatepark.

THIS WAIVER AND RELEASE SHALL BE BINDING UPON THE PARTICIPANT, THEIR PARENT/GUARDIAN, THEIR DISTRIBUTES, HEIRS, NEXT OF KIN, AND PERSONAL REPRESENTATIVES.

That they agree to adhere to and follow all safety and disciplinary rules and guidelines set by the Skatepark. Acknowledging the Skateparks Three Strikes Policy, described as follows: 3 Strikes – First- verbal warning, Second- call parent/guardian (if rider is 16 years of age or older second strike will be another verbal warning, Third- A three-day suspension from Skatepark. **Reach THREE strikes twice, within six months – At risk of being banned from Skatepark permanently.

That they (Parent/Guardian’s) acknowledge that children ages 9 and under are unable to be left at the park without parental supervision. Children ages 10 and above are able to be dropped off at the Skatepark, providing parent/guardian’s contact information has been provided to Park Management.

THE PARTICIPANT AND PARENT/GUARDIAN (IF PARTICIPANT IS UNDER 18 YEARS OLD) HEREBY UNDERSTANDS THAT THIS IS A RELEASE and that they are hereby GIVING UP EVERY RIGHT THEY HAVE TO RECOVER FOR ANY INJURY, DAMAGE OR DEATH occurring as a result of the use of the facilities.

That the participant and parent/guardian (if participant is under 18 years old), in consideration of the Skatepark granting permission hereinbefore described do hereby expressly stipulate and agree to indemnify and hold forever harmless the Skatepark, its successors and assigns, against any loss from any and all claims, demands, or actions in law or equity that may hereafter at any time be made or brought by the participant (be they a minor or not) or brought by anyone on behalf of said participant for the purpose of enforcing a claim for damages on account of any injuries received or sustained in consequence of the participant's actions on the premises or facilities.
