WAIVER AND RELEASE FORM

I understand that athletics, sports, and physical exercise can be strenuous and can lead to serious injury. I certify that I or, where applicable, my minor child, have/has been examined by a doctor and cleared to engage in strenuous physical activity and exercise. I agree that by participating or having my minor child participate in physical exercise or athletic activities, I am doing so entirely at my own risk. I agree to keep all relevant medical professionals informed of any recommendations made by any trainer or changes in diet or exercise, including the use of food supplements, weight reduction, and/or body building enhancement products, and that while participating in any athletic activity or exercise I will follow any and all recommendations of the said medical professionals. I agree to keep all participants and volunteers fully apprised of any restrictions placed on me or my minor child by any medical professionals to the fullest extent possible. I understand that I am under no obligation to engage in any exercise or physical activity, and that by doing so I am voluntarily participating in these activities and assuming all risks of injury, illness, death, or damages of any kind, including property damage. This release is intended to be general and ongoing in nature, but I specifically acknowledge that I am waiving all rights and releasing all liability arising from or relating to the activities I am presently signing up for or asking to participate in.

I authorize the Rocky Mountain Christian Athletic Association to keep my information listed on file and to disclose the said information as necessary in order to render care or medical assistance in the event it becomes necessary in its sole discretion.

I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a general release of liability. I expressly agree to release and discharge the association, trainers, and instructors from any and all claims or causes of action and agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action of any type against the Rocky Mountain Christian Athletic Association, as well as all employees thereof, including any claims or actions for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence to the fullest extent legally allowed.

This release is intended to bind both me and my estate, including any and all heirs of my estate. In the event that any such claim or action is brought in the future, I agree to indemnify the Rocky Mountain Christian Athletic Association and pay for the cost of any attorney fees or reasonable legal expenses incurred as a result of me or my estate filing any such claims or actions. To the fullest extent allowed under law, I am agreeing to indemnify, defend, and hold the Rocky Mountain Christian Athletic Association harmless for any claims alleged or filed against it arising out of or relating to my or my minor child’s participation in the activities.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force in effect and the offending provision or provisions severed here from.

By signing this release, I acknowledge that I have been given the opportunity to consult with an attorney, that I understand its content, that this release cannot be modified orally, and that I am signing this release voluntarily. In the case of participating minors, I am agreeing to sign this waiver and release as the parent or guardian on behalf of my minor child, and I agree that I have full legal authority to do so. I agree to fully indemnify the Rocky Mountain Christian Athletic Association and hold it harmless for any claims brought on behalf of myself or any minor child I am signing up for or asking to participate in activities for any allegations arising out of or related to this form or the activities themselves.
