As a condition of use of the facility, CLIENT shall procure, at its sole cost and expense, and maintain in full force and effect during the term of the Agreement (including setup and breakdown periods), a policy of Commercial General Liability (“CGL”) insurance.

Such policy shall:

Be written on an occurrence form (not claims-made);
Provide coverage for bodily injury, personal injury, contractual liability, and property damage;
Have limits of not less than $1,000,000 per occurrence and $2,000,000 aggregate;
Include coverage for premises and operations, independent contractors, and (if applicable) participant liability.

The following shall be named as the Certificate Holders:

CLIENT shall ensure that:

The policy includes a waiver of subrogation in favor of all Additional Insureds;
The policy is primary and non-contributory with respect to any insurance carried by the Additional Insureds;
A certificate of insurance and additional insured endorsement is delivered no later than ten (10) days prior to the event date;
The insurer is authorized to do business in the State of Hawaii and maintains an A.M.
Best rating of A- VII or better.
