Media Pass Terms, Release, and AgreementBy submitting this Media Pass Application, the applicant acknowledges and agrees to the following terms as a condition of receiving media credentials for any National Motor Fest or NMF Smoke Show event.
1. Assumption of Risk and Release of Liability
The applicant understands that National Motor Fest events may include motorsports activities, moving vehicles, burnout competitions, motorcycles, demonstrations, heavy equipment, crowds, uneven terrain, noise, smoke, debris, and other conditions that may present inherent risks of injury, property damage, disability, or death.
The applicant voluntarily assumes all risks associated with attending, photographing, filming, or otherwise covering the event. To the fullest extent permitted by law, the applicant releases and agrees to hold harmless National Motor Fest, NMF, its owners, officers, employees, contractors, volunteers, sponsors, partners, event producers, property owners, venue operators, and their respective representatives from claims arising from injury, death, loss, or property damage occurring while the applicant is attending or working at the event, except to the extent such release is prohibited by applicable law.
2. Independent Media Representative
Approval of a Media Pass does not create an employment, agency, partnership, or contractor relationship between the applicant and National Motor Fest or the event venue. The applicant is responsible for their own equipment, personnel, expenses, taxes, business activities, and legal obligations.
3. Insurance Requirement
All professional photographers, videographers, media companies, production companies, and other credentialed media representatives are responsible for maintaining their own appropriate insurance coverage, including general liability insurance and any other insurance reasonably necessary for their activities.
National Motor Fest and the event venue do not provide insurance coverage for credentialed media representatives or their equipment.
4. Photography and Content Sharing
As a condition of receiving a complimentary or approved Media Pass, the applicant agrees that a reasonable selection of professional photographs and media content captured at the event shall be made available to National Motor Fest and the event venue following the event.
The applicant grants National Motor Fest and the event venue a nonexclusive, perpetual, worldwide, royalty free license to use, reproduce, publish, display, distribute, edit, and share submitted event photographs and media for promotional, advertising, editorial, social media, website, public relations, archival, sponsorship, and event marketing purposes.
Whenever reasonably practicable, National Motor Fest may provide photographer or media outlet credit when using submitted content, but failure to provide credit shall not constitute a breach of this agreement.
5. Safety and Restricted Areas
Media credentials do not provide unrestricted access to the event grounds. The applicant agrees to follow all instructions provided by National Motor Fest staff, venue personnel, security, safety personnel, fire personnel, and event officials.
Media representatives may only enter restricted areas, competition areas, burnout areas, staging areas, pits, tracks, or other controlled locations when specifically authorized. National Motor Fest reserves the right to immediately revoke credentials from anyone who disregards safety instructions or enters an unauthorized area.
6. Conduct and Credential Revocation
National Motor Fest reserves the right to approve, deny, suspend, or revoke any Media Pass at its sole discretion. Credentials may be revoked for unsafe behavior, interference with event operations, harassment, unauthorized commercial activity, credential sharing, misrepresentation, or failure to comply with these terms.
Media credentials are personal to the approved applicant and may not be transferred, sold, loaned, or shared with another individual without written authorization from National Motor Fest.
7. Applicant Agreement
By submitting this application, the applicant confirms that they have read, understand, and voluntarily agree to these Media Pass Terms, Release, and Agreement. Submission of the application shall constitute the applicant's electronic acceptance of these terms regardless of whether the application is ultimately approved.
The applicant further acknowledges that approval of a Media Pass is a privilege and not a guarantee of access to any specific location, activity, participant, vehicle, or restricted area within the event.
