Please read this Agreement carefully and be aware that by making use of any service or facilities provided by Operation Clean Duds, you assume all risks related to or arising from your use, and you will be required to indemnify, hold harmless, and defend Operation Clean Duds for any claims arising out of your use of services or facilities.
Your signature below indicates you have read, understand, and agree to the following terms:
1) The user agrees that their use of laundering facilities provided by Operation Clean Duds is voluntary. Additionally, the user agrees to assume any risk that is associated with using those laundering facilities and releases Operation Clean Duds from any and all claims of injury, death, damage or loss that may be as a result from that usage. The release is without limitation and includes the personal injury fees, attorney’s fees and any other losses that might occur to the user.
2) The user agrees to hold Operation Clean Duds harmless against all claims of damage and loss, including damage to Operation Clean Duds property caused by the user.
3) The user warrants that they are physically able to make use of the laundering facilities provided by Operation Clean Duds without any undue risk.
4) Operation Clean Duds maintains the right to refuse usage of the laundering facilities if they foresee that use would risk damage to any party.
5) This waiver agreement is governed by the laws of Ohio. The state of Ohio is the exclusive jurisdiction for any legal claims or lawsuits related to usage of laundering facilities provided by Operation Clean Duds.
6) The user grants and conveys to Operation Clean Duds all right, title, and interest in any photograph, video, or audio recording taken of the user, the user’s child, or ward in connection with the use of laundering facilities provided by Operation Clean Duds, including the right to reproduce or publish (including on social media) such photographs, videos, or audio recordings.
7) The user agrees that this waiver agreement shall remain in full force and take effect without change and that usage of laundering facilities provided by Operation Clean Duds is pursuant to the terms of this Agreement.
8) The user understands any threatening behavior towards other user or staff could result in loss of services.
