In consideration of the undersigned participation in the MASSACHUSETTS ELKS VETERANS CHARITY MOTORCYCLE RUN (herein referred to as "EVENT"), the undersigned hereby agrees to release, defend, indemnify and hold harmless the MASSACHUSETTS ELKS VETERANS MOTORCYCLE RUN and DONALD BARNARD, MICHELLE RAYNE, KIM ADAMS,
HEATHER INGERSOLL, PAUL HEBERT, JUDITH GARDNER, DEB CARVER, JOHN CARVER, PENNY
SOKOLOWSKI, SHAINA BARNARD, ALLISON KEAR, TIMOTHY LANDRY, LISA LANDRY, BEVERLEY SANTOSUOSSO,
RICHARD EVANS, KHYRSTYNE QUIGLEY,
JOHN KERINS, ERIC PURCELL, MICHELE BEAULIEU, BILLERICA LODGE OF ELKS # 2071,
NORTH DISTRICT ELKS, MASSACHUSETTS ELKS ASSOCIATION, ALL ELKS RIDERS, MIDDLESEX
COUNTY SHERRIFF, SUFFOLK COUNTY SHERRIFF, NORFOLK COUNTY SHERRIFF, BILLERICA
POLICE, NATIONAL GRAND LODGE ELKS, MASS VETERANS FUND and any other promoters; organizers; officials; advertisers; sponsors; clubs; participants; volunteers; owners, lessees, or occupants of premises or property used to conduct the "EVENT;" sanctioning organizations; any affiliates, subsidiaries, or parents thereof; including, but not limited to, their officers, employees, agents, representatives, and attorneys (collectively referred to herein as "RELEASEES"), from and against all liability to the undersigned, his personal representatives, assigns, heirs, and subrogees for any and all claims, liabilities, damages, losses, costs, and expenses, including actual attorney’s fees, for bodily and/or emotional injury (including death) or damage to property, whether caused by the negligence or gross negligence of the "RELEASEES" or otherwise and whether based in contract, tort, or under a theory of strict liability, arising out of or in any way connected with participation in the "EVENT" and in any way resulting from, arising out of or in connection with the performance of their duties and my participation in said "EVENT." By participating in this "EVENT," I agree to ride at my own risk, and fully understand: • Participants are prohibited from consuming alcohol or taking illegal drugs while participating in the "EVENT."
• The "EVENT" reserves the right to decline to accept or retain any person as a tour participant at any time for any reason.
• By submitting/signing this form, the undersigned certifies that he/she does not have any physical, mental or other condition or disability or that he/she is not taking any medication which may adversely affect their coordination or alertness that could or would create a hazard for the undersigned or any other "EVENT" participant. The undersigned certifies that he/she is over 18 years of age and in possession of a current valid motorcycle operator’s license and understands wearing a safety helmet and other protective gear is mandatory. • The undersigned agrees to observe and obey all federal, state, and local rules, regulations, and statutes, including, but not limited to, all Massachusetts motor vehicle laws while participating in the "EVENT."
• The undersigned agrees to operate his or her motorcycle or other vehicle in a safe manner and not to operate it in such a way that is likely to cause harm to the undersigned, another participant or a pedestrian.
• Participating in this "EVENT" is at undersigned’s own risk
• I grant full permission for the "EVENT" to use photographs, videotapes or other recordings of me that are made during the course of the "EVENT."
• I fully understand the risks, dangers and responsibilities that are inherent to being a participant at such an "EVENT." ADDITIONAL AGREEMENTS AND UNDERSTANDINGI UNDERSTAND AND AGREE that, by signing this Release of Liability and Indemnification, I am giving up and releasing any claim I may have; including for damages that may not have yet happened and that may be foreseen or unforeseen, expected or unexpected. I state I am old enough to sign this Release of Liability and Indemnification and to be legally bound by the Agreement contents; I recognize that this is a legal Release that is binding upon the undersigned. I have read this Release of Liability and Indemnification carefully and I understand all of it. I understand that I am free to consult with an attorney of my own choosing if I so desire. In agreeing to sign this Release of Liability and Indemnification I have not relied on any statements or explanations by the "RELEASEES" or any of its representatives. I understand and agree that this Release of Liability and Indemnification contains all of the agreements between the "RELEASEES" and undersigned and that we have no other written or oral agreements.
