This section describes the policy for pets at Seton Park Place III. The policy does not replace or supersede the Condominium Corporation’s pet Bylaw 2.1 (g) (xi) still in full force and effect. It is intended as a guideline to further assist residents in making decisions regarding their pets and potential pet applications.

The pet policy intends to provide a welcoming environment for all pets in compliance with the policy and to promote harmony between pet owners and non-pet owners.

The bylaws state in Section 2.1 (g) (xi) that an owner, their visitors, and tenants, shall: “not, keep, harbor, house, or in any manner whatsoever, allow anywhere in either, his Unit or the Project any pets, animal or non-human animal, unless the Owner:

obtains the express written consent of the Board, which consent may be unreasonably withheld or withdrawn at any time;
enters into an agreement with the Corporation providing the conditions for keeping such a pet;
posts a reasonable damage deposit for the keeping of such pet;
keeps the pet under control and leashed or contained on the Common Property;
agrees to be responsible for all damage caused by the pet; and
provides any information reasonably requested by the Corporation in respect of the pet (including as is necessary to identify the pet), and such pet, animal or non-human animal to be restricted to: fish (in an aquarium up to 100 U.S. gallons); up to 2 domestic cats or (but not both) 2 domestic dogs (with each dog being less than 40 kg); or 1 domestic cat and 1 domestic dog (such dog shall be less than 40 kg.);”

The bylaws allow a maximum of two pets to reside per unit. This means either one (1) dog (up to 40 kgs) AND one (1) cat, OR two (2) dogs OR two (2) cats, with the approval of the Board of Directors. Service dogs are also permitted provided they meet the requirements of the Service Dog Act of Alberta. Occupants should always be mindful of the 40kg weight limit. To obtain approval for pets please complete the online registration form.

To complete the registration, the applicant must include a photo of the pet(s) and provide confirmation of registration with the City of Calgary.

Pets must be on a leash at all times in common spaces. Any repairs and/or clean-up fees required as a result of damage to common property caused by an owner’s pet or that of a tenant’s pet, or visiting pet will be charged back to the Unit Owner. Excessive barking will be treated as a noise complaint and may result in the Board of Directors levying a fine to the Unit Owner. In addition, the City of Calgary Bylaw 23M89 Section 4 (a) (v) indicates the City of Calgary may impose a fine on the pet Owner.

Complaints must be made to Three By Three Inc., in writing via email or post, to be considered official. Official complaints investigated and substantiated by Three By Three Inc. and the Board of Directors will result in warnings and/or fines to the pet owner.

In addition, your cooperation is greatly appreciated in maintaining the following rules:

All cats and dogs must be licensed — City of Calgary Bylaw 23M2006 — fines applicable.
Urination is prohibited in condo green and common areas. Unsightly “burn” or potential damage to trees/shrubs as well as concrete surface staining will be the responsibility of pet owners to replace or repair.
In the event your pet defecates before you get off of the property, all droppings on the common areas of the property must be picked up immediately. Please have a container or bag with you when walking your pet. City of Calgary Bylaw 23M 2006— fines applicable.
Pets on common property must be on a leash (less than six feet long at all times). Pets must not run at large. City of Calgary Bylaw 23M2006 — fines applicable and impounding of the pet.
Excessive barking, howling or noise that causes a disturbance will be treated as a noise complaint — City of Calgary Bylaw 23M2006 — fines applicable.
Pets are not permitted to urinate or defecate, or be tied to patios, balconies, or anywhere on the property. In the event this occurs, the resident will be subject to infractions which may include a monetary fine. Repeat occurrences will result in escalating fines.
Should your pet be seen or reported as urinating within the building and soiling the carpets, this will result in an automatic fine to cover the cost of removing the stain or replacing the carpet tile.
Cat litter must be tied in a plastic bag and placed directly in the garbage bin.
Pet approval by the Board and registration must be requested through the Management Company before a pet becomes a resident in a unit. Approval will not be unreasonably withheld.

Application Guidelines:

Application form needs to be completed and provided to Three By Three Inc.
Pet application responses will be completed within seven business days of receipt.
Photo of pet is required.
Proof of licensing is required.

Damages Caused by Pets

In accordance with the Condominium Property Act and the Bylaws for the Condominium, a warning will be issued to the owner should the guidelines listed above not be followed or there is damage to the property or common areas including but not limited to, hallways, stairwells, the parkade, patios, balconies, and landscaping. Should the issues persist, the Corporation can fine in accordance with the Bylaws and the fine schedule outlined in the Schedule of Fines Policy.

In addition, any residents found to have pets that are not registered onsite without Board approval violates Bylaw 2.1 (g) (xi) and will result in a fine of $150, to be levied against the Unit Owner.

Please note that having a pet is a privilege, not a right. The Board of Directors may, in its sole discretion, revoke any permission previously given and may require any pet to be removed from the unit with reasonable notice.
