These Terms and Conditions applicable to Local and International Orders and Deliveries.
Artiste Atelier Academy Sdn. Bhd. provides this sale and service to you subject to the following notices, terms and conditions are important and that you should read them because, by placing order with us, you are indicating that you accept and agree to comply these terms. We may amend these terms, which may be notified to you vide emails, or notices at obvious places of our Premises or our website at www.artizsoap.com / www.artizatelier.com
Our General Terms and Conditions shall exclusively apply to all contracts between us and our customers shall not apply.
You may place your order with us via Whatsapp/SMS/Call to 016-3396303 / 016-3396289 or via email to firstname.lastname@example.org / email@example.com or via online at our website www.artizsoap.com. You are most welcome to come and visit us at our outlet at Artiste Atelier Academy Sdn. Bhd., Bukit Rimau. If you need to make further enquiry, please feel free to give us a call make your appointment.
Upon placing your order, we will Email/Whatsapp you a quote of price / quotation for your order. YOUR AGREEMENT ON PRICE IS REQUIRED IN PRIOR TO CONTINUE WITH THIS FORM.
Note that international parcels may be subject to additional taxes or duty in your own country and these additional charges will be responsible by the purchaser.
Full payment shall be made at the time of submitting this ORDER FORM at time of acceptance of the quotation, by way of cash, cheque (beneficiary: Artiste Atelier Academy Sdn. Bhd.), credit card at our outlet, and online transfer to (beneficiary: Artiz Atelier Academy, CIMB 8003599676)
Please note that there shall be additional charges for designing, printing customised labels and packaging on the products.
We will commence work upon clearance of cheque or confirmation of the online transfer or cash payment.
All our orders are exclusively handmade for you, therefore orders are usually turned around in 2 to 6 weeks (depend types of products). There will additional time for courier service which takes about 3 days working days within Malaysia. However, we will prior notify the delivery date once received payment and this FORM from you.
Kindly be informed that estimated delivery dates are to be used as guidance only. Although we aim to deliver within the estimated delivery dates, delivery sometimes may take longer due to unexpected events. Please understand that we are not responsible for delay caused by circumstances outside our control.
If for some reason, you have not received your order, please contact us as soon as possible for us to check on the necessary. We recommend delivery to be made by POSLAJU a reputable courier service provider as we will not be responsible for goods lost or damaged in transit.
On the other hand however, if you fail to take delivery of the products or any part of them on the delivery date or you fail to provide any instruction or document required to enable the products to be delivered on the delivery date, we shall be entitled upon given notice to you to store or arrange for the storage of the products. in this event, the risk in the products shall pass to you, delivery shall be deemed to have taken place. Please understand that in these circumstances, we reserve our right to charge for the costs and expenses for storage or re-delivery or insurance of the products until actual delivery. We further reserve our right to destroy the products for health or hygiene reasons in the event that there is no instruction received for delivery after expiry of the products.
All products labelling will be using Artiz Atelier Academy / Artiz Soap Label, unless requested for custom labels. All custom labels will be charge for extra designing and printing cost.
6. RETURN / EXCHANGE
Inspections are done on all products prior to delivery and because of this, we hope that you will be happy with your purchase.
Since the products are made or personalised to your requirements and specifications, no return or exchange shall be accepted except for defective or damaged products. Please email to us at firstname.lastname@example.org / email@example.com within five (5) working days from the date of receipt of the products for any request for return or exchange accompanying by the proof of defects or damage with attach of photos of the damaged products. We reserve the right to replace the defective or damaged products until and unless we have received the products for inspection. Immediately after five (5) working days from the date of receipt, the Customers are deemed to have accepted the products in good condition and no complaint and request for return or exchange shall be entertained thereafter.
Strictly no return or exchange for products which have been unsealed or used due to health protection or hygiene reasons.
7. CANCELLATION OF ORDERS
As our products are made to order, hence there us strictly no cancellation of orders will be entertained. No refund of payment will be made for any cancellation of orders made at any stage.
While we make every effort to describe each product as accurately as possible, we hope you understand that all samples, drawings, descriptive matter, specifications and advertising and any descriptions or illustrations contained in the photos, catalogues, brochures and website are purely for reference. They are to be considered non-binding material for sole illustration purposes, giving only an approximation of properties and specification. They shall not form part of the contract and shall not constitute a sale by sample or description.
The beauty of hand-crafted products is that each of the products is unique on its own. Hence, the colour, texture, style, weight and scents will vary from batch to batch or even piece to piece.
We also wish to advise that handmade soaps will shrink minimally when left dry over a period and that there is an expiry date to all handmade products. Hence, please use and look after the products as instructed.
10. QUALITY ASSURANCE
We have a policy and program in place which endeavours to keep the quality of products made to an acceptable standard.
Our products are in their natural state with addition of natural herbs and powders of cleansing, moisturising and soothing properties. Although we may recommend any ingredients which may be beneficial to your skin, our products are not meant to diagnose or treat or cure or prevent any disease or any physical or emotional condition.
Many of the herbs, clays, powders, essential or fragrance oils and other natural ingredients in our products are not intended to be used to self-medicate or treat any form of physical or mental disease or health problem. We do not recommend the use of our products as a substitute for medical care.
While allergic reactions to our natural ingredients are uncommon, we recommend you to test our products first on a small patch of skin for 24hours. In the unlikely event that redness or irritation develops, please discontinue to use.
We also strongly advise you to keep us notified in advance of any allergy to any particular ingredients while placing your order with us. Each product consists a list of ingredients and we are not responsible for any individual reaction to any particular ingredient.
When you share your contact and email with us during the ordering process, you will be added to our newsletter. Periodically, you will receive any message or email about your products, promotions, news and activities.
12. EXCLUSION OF LIABILITY
To the fullest extent permitted by law, we do not accept liability of any injury damage, loss, delay or additional expenses whatsoever and howsoever arisen, which are incurred at or in association with these products.
The provisions of these Terms and Conditions are intended to be severable. If for any reason any of the provisions herein shall be held invalid or unenforceable in whole or in part, such provision shall be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability.
14. GOVERNING LAWS
These Terms and Conditions shall be governed and construed in accordance with the law of Malaysia. The Courts having jurisdiction over our principal place of business shall have exclusive jurisdiction for any action or proceedings commenced for any breach of these Terms and Conditions.
15. NO WAIVER
The failure of either party to this Terms and Conditions to insist upon the performance of any of the terms and conditions hereof, or the waiver of any breach of any of the terms and conditions hereof, shall not be construed as thereafter waiving any such terms and conditions, unless made in writing.
16. OUR RIGHT TO VARY THESE CONDITIONS
We reserve our right to revise and amend the Terms and Conditions herein from time to time as we think fit without prior notice.
These Terms and Conditions together with the contents of our website and facebook and instagram are to provide Customers sufficient information about our products and services so that customers can make an informed choice about whether or not to engage in the transaction.
We do not take any responsibility or have any propriety rights of web sites or advertisements linking out of us. While we will do our utmost to ensure the highest quality from our products and services, we do not warrant that the products or services provided will meet all and any of the Customers' need or requirements. In particular, we do not warrant that our products or services will always be available, accessible, timely, secure and error free.
These Terms and Conditions and the contents of our website are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no and expressly disclaim all representations or warranties of any kind, expressed or implied, including without limitation to the implied warranties of satisfactory quality, fitness for a general or particular purpose, non-infringement and authenticity of any material or claim, and to any implied warranty arising from the course of dealing or usage of trade.
No oral advice or written information given by us or our employees shall be used as a warranty nor shall the Customer reply on any such information or advice.
