This constitutes the agreement between Smart Repertoire and Consortium Member for participation in a consortium to create new works for saxophone as described below:
- A new work for tenor saxophone and piano by Arson Fahim
- A new work for alto saxophone and piano by Kenneth Fuchs
1. SERVICES: Members will receive two new works for saxophone and piano.
2. DELIVERY: The consortium organizer will deliver the final score/parts to the commissioner by 02/15/2025. Delivery of the work shall consist of electronic copies of the score in the form of PDF files.
3. COMMISSION FEE: A fee of $50 will be required to join consortium.
4. PAYMENT SCHEDULE: Full payment will be due before 02/01/2025 to become a member of the consortium. Payments are to be delivered via Paypal or Venmo.
5. NON-DELIVERY PROVISION: The consortium organizer shall use all reasonable effort to have the pieces completed and delivered by DEADLINE. Otherwise, the commission may be withdrawn after due consultation with the composer, and any part of the commission fee that has been paid shall be reimbursed by the organizer. However, with the written consent of both parties, a new delivery date may be set.
6. RIGHT TO EXCLUSIVE PERFORMANCE: Performances of the work will remain the exclusive right of the commissioner and consortium members until 02/01/2026. The work will not be published, sold for performance purposes, or performed by anyone outside of the consortium until exclusivity expires.
7. PERFORMANCE NOTIFICATION AND USE OF RECORDINGS: The commissioner and/or consortium members will notify the composer each time the piece is performed and will send an electronic copy of the program and any recordings of the performances. The commissioner and consortium members shall give the composer the right to use any performance or studio recordings for promotional and educational purposes.
8. COPYRIGHT: It is agreed that the copyright of the work remains the exclusive property of the composer.
9. SCORE DEDICATION: Consortium members will be listed in the works.
10. WARRANTIES AND REPRESENTATIONS: The composer hereby makes customary representations and warranties as to the originality of the score, that the Score violates no rights of any third party, that there will be no liens or encumbrances on the score.
Any changes, additions, corrections, or addendum to this document must be approved and initialed by all parties. Signatures below constitute approval and acceptance of this agreement by all parties.
