ASSUMPTION OF RISK AND RELEASE OF LIABILITY
Read Carefully Before Signing

This assumption of Risk and Release of Liability (the “Release”) limits the rights of recovery for damages in case of accident. The Release is intended to provide a comprehensive assumption of risk, waiver, covenant not to sue, and release of liability in favor of Platinum Gymnastics Academy LLC ("Platinum Gymnastics").
 
READ IT BEFORE SIGNING. In partial consideration for allowing the student(s) identified in my account to participate in the activities and programs offered by Platinum Gymnastics, I understand, acknowledge and agree that:
 
I am the parent or legal guardian of the student(s) listed in my account. I consent that this Release shall be effective for myself, the student(s) and our heirs, assigns, and next of kin.
 
I am aware that the activities and programs offered by Platinum Gymnastics are dangerous and involve the risk of property damage and/or serious injury and/or death. These activities and programs include, but are not limited to, tumbling, trampoline, gymnastics, and other activities involving height and motion.
 
By execution of this Release, I ASSUME THE RISK for any damage, injuries, or death that I, or the student(s) listed in my account, may sustain as a result of participation in the activities and programs offered by Platinum Gymnastics. To the fullest extent allowed by law, I, for myself and the student(s) listed in my account, and on behalf of our heirs, assigns, personal representatives and next of kin. HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Platinum Gymnastics, its shareholders, directors, officers, agents, employees, successors and assigns (“Released Parties”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with participation in, or observation of, the activities and programs offered by Platinum Gymnastics.
 
This Release is effective, whether caused by the negligence of the Released Parties or otherwise, for all property damage, injury and/or death sustained as a result of participation in the activities or programs offered by Platinum Gymnastics. This Release is governed by the laws of the State of Iowa and is intended to be as broad and inclusive as is permitted by Iowa law.
 
It is understood and acceptable for Platinum Gymnastics Academy LLC, to photograph and/or take motion picture or videotape my children to use for marketing/advertising purposes by Platinum Gymnastics Academy LLC.
Platinum Gymnastics Academy LLC or its agents may use and distribute for publication/broadcast any images of my children for any/advertising purpose deemed proper.

This consent is expressly intended to release Platinum Gymnastics Academy LLC from liabilities, which could result from unauthorized use of photographs and/or motion pictures and videotape.

I HAVE READ AND UNDERSTAND THE ABOVE RELEASE; I FULLY UNDERSTAND ITS TERMS; I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.
