In consideration for allowing me to participate in the volunteer mission trip of Brush for Life, Inc. (BFL) and any Brush for Life, Inc. Sponsored recreational, social or athletic activity (“Trip”), I, the undersigned, hereby agree to the following:

1. Waiver and Release of Claims. I understand that this is a binding legal agreement, under which I waive certain rights and claims I may have and assume the risks inherent in the Trip, as well as all foreseen and unforeseen risks that may arise out of the Trip. I understand that if I have any questions about this Waiver and Release of Liability (“Waiver”), I should consult with an attorney of my choosing at my expense for legal advice.

2. Voluntary Activity and Indemnification. I acknowledge that when and if I participate in the Trip, I am voluntarily participating in the Trip with the knowledge of the numerous risks and dangers involved, including, but not limited to: harm; loss; damage; physical exertion for which I am not prepared; forces of nature; travel, whether in civilized or remote areas and by plane, train, auto, boat or other conveyance; consumption of alcoholic beverages; crime; civil unrest; terrorism; breakdown of equipment; high altitude; accident, injury, illness, or death without access to means of rapid evacuation or availability of medical supplies; the adequacy of medical attention once provided; and/or negligence on the part of Brush for Life, Inc., its employees, volunteers, officers, agents or others. I agree I will conduct myself in a safe and reasonable manner. I will not participate in an activity while under the influence of medication, drugs or alcohol, or while suffering from any medical, health or other condition (including, but not limited to, illness or injury), that might in some manner potentially cause harm or injury to me or to another participant. Unless specifically excluded herein, I will defend and indemnify Brush for Life, Inc., and its agents and employees, in response to any claim for injury, damage, or loss arising in some manner from my participation in the Trip.

3. Acknowledgement of Travel Risks. I am aware of the risks of travel in general and the risks to my safety and security associated with air, sea, and land travel while participating on Trip. I also am aware that the United States Department of State might periodically issue a Travel Warning or Travel Alert to United States citizens regarding travel to certain parts of the world. Additional travel warnings may have been issued by the Department of Homeland Security. I understand that I am encouraged to visit the Department of Homeland Security and the Department of State’s websites (http://www.dhs.gov and http://www.state.gov, respectively) for updated warnings and travel advisories issued by those agencies.

4. Assumption of Risks. I knowingly assume various risks associated with participation in this Trip, including, but not limited to, those noted above.

5. Rules of Safety Agreement. I agree to follow all written and verbal rules of safety presented to me by Brush for Life, Inc., its employees, volunteers, officers, agents or others. EXCEPT AS OTHERWISE PROVIDED IN THIS AGREEMENT, I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN HEALTH AND WELFARE AND ACCEPT ANY AND ALL RISKS OF DELAY, UNANTICIPATED EVENTS, ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH. Brush for Life, Inc. does not warrant or guaranty that the physical location of the Trip is safe and appropriate for such an activity.

6. Non-Employee Release of Claims. I am not an employee of Brush for Life, Inc. and my participation in the Trip, including related events before and after the Trip, is not within the scope of employment with Brush for Life, Inc. and these are voluntary recreational or athletic activities that are not covered under California’s workers’ compensation statutes. However, as lawful consideration for being permitted to participate in the Trip, I hereby RELEASE AND DISCHARGE Brush for Life, Inc. AND ITS EMPLOYEES, VOLUNTEERS, OFFICERS, AGENTS OR OTHERS (“RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL LIABILITY WHICH IS NOT COVERED AS SUMMARIZED IN THE ATTACHED, INCLUDING ANY AND ALL CLAIMS IN THE UNITED STATES AND ANY OTHER JURISDICTION ON A GLOBAL BASIS, ARISING FROM MY PARTICIPATION IN ANY BRUSH FOR LIFE, INC. TRIP OR BRUSH FOR LIFE, INC.-SPONSORED EVENT REGARDLESS OF WHETHER THE RISK IS KNOWN OR UNKNOWN, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE. To the fullest extent allowed by law, I waive and release any potential future claim(s) against any and all persons or entities of Brush for Life, Inc. that may in some manner be responsible for sponsoring, directing, or supervising my activities, the activities of others, or that own, control, or maintain the physical location in which such activities are conducted. I agree that this release shall be legally binding upon me, my heirs, executors, and assigns, and all minors participating or traveling with me. I also agree, on request, to execute such further documents as may be required to give effect to the release and waiver contained herein.

7. Voluntary Participation. I am participating in the Trip on an entirely voluntary basis for my own charitable, humanitarian, and/or religious objectives.

8. Entire Agreement. This Release constitutes the entire agreement concerning the subject matter, and cannot be amended or modified except in a written agreement signed by an authorized officer of Brush for Life, Inc..

9. Counterparts, Multiple Originals, and Related Provisions. This Release may be executed in counterparts, each of which shall be deemed an original and all of which taken together shall constitute one and the same instrument signed by all of the parties. Photographic or electronically scanned and emailed copies of such signed counterparts may be used in lieu of originals for any purpose. Facsimile and electronically scanned and emailed signatures on this Release shall be deemed to have the full force and effect as original signatures.

10. Choice of Law. This Release shall be interpreted under the laws of the State of California.

11. Statement of Non-Coercion. I have signed this Release freely and voluntarily, without relying on any promises or assurances from the Released Parties.

12. Acknowledgement of Enforceability; Knowing and Voluntary Agreement. In signing this Release, I agree, understand, and intend that this Release shall be binding and enforceable as permitted under law and by my signature, I acknowledge that:
1) I have carefully read and fully understand all the provisions of this Release;
2) I am voluntarily entering into this Release with full knowledge of the rights that I may be waiving;
3) I have entered into this Release based on my own judgment; and
4) I have not relied upon any representations or promises not contained in this Release.
