The following outlines terms and conditions as a participant in the activities organized by Enlesce Apparel Inc (referred to as "ENLESCE"):
Assumptions of Risk: I am aware that cycling involves inherent risks, including but not limited to accidents, collisions, falls, and injuries, both minor and severe. I voluntarily and willingly choose to participate in ENLESCE's activities, understanding and assuming these risks.
Release and Waiver: In consideration of being allowed to participate in ENLESCE's activities, I hereby release, discharge, and hold harmless ENLESCE, it's organizers, officers, volunteers, employees, ride leaders, agents, sponsors, event partners, and any other affiliated individuals or entities from any and all claims, liabilities, damages, injuries, or losses, including any legal fees, arising directly or indirectly from my participation in ENLESCE's activities.
Responsibility and Acknowledgement: I acknowledge that I am solely responsible for my own safety and well-being during ENLESCE activities. I agree to abide by all safety guidelines, traffic laws, and instructions provided by the organizers or designated ride leaders. I understand that failure to do so may increase the risk of accidents, injuries, or other harm.
Indemnification: I agree to indemnify and hold harmless ENLESCE from any and all claims, actions, damages, or losses brought by a third party arising from my conduct during participation in the activities.
Medical Condition and Fitness: I certify that I am physically and mentally fit to participate in ENLESCE's activities. I acknowledge that it is my responsibility to consult with a healthcare professional regarding my medical condition and obtain medical clearance if necessary. I agree to inform the organizers of any relevant medical conditions, allergies, or other factors that may affect my ability to safely participate.
Emergency Medical Treatment: In the event of an accident or medical emergency, I authorize ENLESCE and its representatives to secure emergency medical care on my behalf and agree to be responsible for any associated costs.
Photo and Video Release: I grant ENLESCE the right to use photographs, videos, or other media taken during the activities for promotional or informational purposes without compensation or notification.
Governing Law: This waiver and release liability shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of laws principles.
Informed Consent Clause: I confirm that I have read this waiver and fully understand its terms. I acknowledge that I am giving up certain legal rights, including the right to sue, and I do so voluntarily and of my own free will.
Severability Clause: If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
