This Waiver and Release of Liability Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) and, if applicable, the parent(s) or legal guardian(s) of a minor child (“Minor”), in favor of SEE IT (Seeing Everyone Enriched in Thriving) 501(c)(3), The People of Palmer Park, Detroit Parks and Recreation, Friendly Scales, Detroit Animal Care and Control or any of their officers, directors, employees, volunteers, contractors, affiliates, sponsors, representatives, and agents (collectively, the “Released Parties”).

I understand and acknowledge that participation in physical, recreational, and community activities organized, hosted, or facilitated by the Released Parties involves inherent risks, including but not limited to:

slips, trips, and falls;

injuries resulting from exercise, sports, swimming, or recreational play;

exposure to environmental conditions;

contact with other participants; 

injuries resulting from interacting with demonstration activities / animals and

in rare cases, permanent disability or death.

I voluntarily assume all such risks, whether known or unknown, and accept full responsibility for any injury, illness, loss, damage, or death that may result from my participation or that of my child(ren).

In consideration of being allowed to participate in activities offered or sponsored by the Released Parties, I, on behalf of myself, my child(ren), my heirs, executors, administrators, and assigns, hereby:

Release and discharge the Released Parties from any and all liability, claims, demands, actions, or causes of action, whether arising from negligence or otherwise, that may result in personal injury, illness, death, or property damage arising from participation.

Agree not to sue or assert any claims against the Released Parties for any injury or damages alleged to have been sustained in connection with participation.

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, costs, and expenses (including attorney’s fees) arising out of or related to my or my child(ren)’s participation in these activities.

I consent to the administration of first aid and other emergency medical treatment deemed necessary, and I agree to assume all costs associated with such treatment.

If I am the parent or legal guardian of a minor child(ren) who will participate:

I understand this Agreement applies to both my child(ren) and myself if I also choose to participate in the activities.

I warrant that I have full legal authority to sign this Agreement on behalf of the minor child(ren).

I understand that I am waiving and releasing the same rights and assuming the same risks on their behalf as I am for myself.

I hereby grant permission to the Released Parties to photograph, film, and/or record me and/or my child(ren) during participation in activities. I consent to the use of these photographs, videos, and recordings for educational, training, promotional, or informational purposes, including but not limited to use on websites, social media, printed materials, or presentations, without compensation to me or my child(ren).

I understand that the Released Parties will not sell or license these images to unaffiliated third parties for commercial purposes.

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan.

I have carefully read this Agreement, fully understand its terms, and voluntarily sign it. I acknowledge that by signing this document, I am waiving substantial legal rights, including the right to sue.
