By using the Licensed Rights (defined below), you agree to the terms of this PASSION Data Use Public License ("PASSION License").

If this PASSION License is considered a contract, you are granted the Licensed Rights by accepting these terms. The Licensor provides these rights in exchange for the benefits they receive from making the Licensed Material available.

a. “Adapted Material”: Material based on the Licensed Material that has been altered, arranged, or modified in any way requiring permission under copyright laws.

b. “Adapter's License”: The license you apply to your contributions to Adapted Material, according to the terms of this PASSION License.

c. “Copyright and Similar Rights”: Copyright or similar rights related to performance, broadcast, sound recording, etc.

d. “Effective Technological Measures”: Technology that cannot be bypassed without authorization under laws from the WIPO Copyright Treaty (1996) and other similar agreements.

e. “Exceptions and Limitations”: Legal exceptions like fair use or fair dealing that apply to your use of the Licensed Material.

f. “Licensed Material”: The images, labels, or data in the database provided under this PASSION License.

g. “Licensed Rights”: The rights granted to you under this PASSION License, limited to the copyright and similar rights that apply to your use.

h. “Licensor”: The person or entity granting rights under this PASSION License.

i. “Share”: To make material available to others in any way that requires permission under the Licensed Rights.

j. “Sui Generis Database Rights”: Rights from the European Directive 96/9/EC or other equivalent rights globally.

k. “You”: The person or entity using the Licensed Rights.

a. License Grant

1. The Licensor grants you a worldwide, royalty-free, non-sublicensable, non-exclusive, and irrevocable license to:

   a. Reproduce and Share the Licensed Material for non-commercial purposes only.

   b. Produce, reproduce, and Share Adapted Material for non-commercial purposes only.

Commercial use is strictly prohibited.

1. Exceptions and Limitations: If legal exceptions apply, you don't need to follow the terms of this PASSION License.

2. Term: The term of this PASSION License is outlined in Section 6(a).

3. Media and Formats: You can use the Licensed Material in all media and formats and make necessary technical modifications.

4. Downstream Recipients:

   a. Anyone receiving the Licensed Material automatically gets the rights under this PASSION License.

   b. You cannot add restrictions to the Licensed Material that prevent others from using it.

5. No Endorsement: This license does not imply any endorsement or sponsorship by the Licensor.

b. Other Rights

1. Moral rights, privacy rights, and publicity rights are not licensed, but the Licensor waives these to allow you to use the Licensed Rights.

2. Patent and trademark rights are not included.

3. The Licensor waives the right to collect royalties from you for using the Licensed Rights.

Your use of the Licensed Rights is subject to the following:

a. Attribution

1. When Sharing the Licensed Material or Adapted Material, you must:

   a. Include any attribution information provided by the Licensor, such as creator names, copyright notices, a notice of this PASSION License, and a link or URI to the Licensed Material.

   b. Indicate if the material has been modified and retain a record of previous modifications.

   c. Note that the material is licensed under this PASSION License.

2. You can provide the required attribution in any reasonable way, depending on the context.

3. If requested, you must remove any of the required attribution information to the extent practicable.

4. The license for any Adapted Material must not prevent others from complying with this PASSION License.

b. Restrictions

1. Non-Commercial Use Only: The material may only be used for non-commercial purposes.

2. Prohibition on Re-identification: You cannot attempt to re-identify individuals whose data has been de-identified. Doing so terminates all rights to the material.

3. Sharing Restrictions:

   • You cannot share the direct download link to the Licensed Material.

   • You may only share the link to the website hosting the material, not the direct download link.

   • You cannot repost the material on other websites or platforms.

If the Licensed Rights include database rights:

a. Section 2(a)(1) allows you to extract, reuse, and share the contents of the database for non-commercial purposes only, as long as you don't share direct download links.

b. If you create a new database using the material, that new database is considered Adapted Material.

a. The Licensor provides the Licensed Material "as-is" and makes no warranties about it.

b. The Licensor is not liable for any damages arising from your use of the Licensed Material.

c. The disclaimer and limitation of liability aim to waive all liability as much as possible.

a. This License lasts for the term of the Copyright and Similar Rights, but your rights end if you violate the terms.

b. Your rights can be reinstated if the violation is cured within 30 days or upon express reinstatement by the Licensor.

c. This does not affect the Licensor's right to seek remedies for violations.

d. The Licensor can offer the material under different terms or stop distributing it, but that does not end this License.

e. Sections 1, 5, 6, 7, and 8 remain in effect after termination.

a. The Licensor is not bound by any additional terms unless agreed upon.

b. Any agreements outside this License are independent of its terms.

a. This License does not restrict any legal uses of the material that do not require permission.

b. If any part of this License is unenforceable, it will be reformed to the minimum extent needed to be enforceable.

c. No term is waived unless agreed by the Licensor.

d. This License does not limit any privileges or immunities that apply to the Licensor or You.
