1. Copyright & Artwork Ownership
I retain the copyright and intellectual property rights to the artwork itself. Purchasing a commission does not transfer copyright of the artwork to the client unless otherwise agreed upon in writing.
I reserve the right to display, reproduce, and share commissioned artwork in my portfolio, social media, website, and other promotional materials unless the client purchases a private/portfolio exclusion before work begins.
2. Character & Concept Ownership
Clients retain ownership of their pre-existing characters, concepts, landscapes, and other intellectual property they provide. I will not claim their existing characters or concepts as my own.
Character designs created specifically for the client as part of a commission may be used by the client as agreed upon, while I retain copyright to the artwork itself unless otherwise agreed upon in writing.
3. Design Credit
Please do not claim the final artwork or artwork/design process as your own work.
You are welcome to credit yourself as the owner/creator of your character or concept where applicable.
4. Commercial Use
Commissioned artwork is for personal, non-commercial use by default.
Commercial use requires prior agreement and an additional fee of 50% of the original commission price.
Commercial use includes, but is not limited to:

Merchandise
-
Advertising
-
Promotional materials
-
Monetized products
-
Business use
-
Commercial publications
-
Games or other commercial projects
If you are unsure whether your intended use counts as commercial use, please ask me beforehand.
5. Private Artwork / Portfolio Exclusion
I normally reserve the right to display completed commissions in my portfolio and social media.
If you do not want your commissioned artwork to be publicly posted or used in my portfolio, an additional fee of 100% of the original commission price applies.
This request must be made and agreed upon before work begins.
6. Revisions
You are welcome to request changes during the sketching phase.
Once a sketch, character design, composition, or other stage has been approved, subsequent changes may be subject to additional fees.
Major changes include, but are not limited to:

Changing the character's pose
-
Changing the outfit
-
Changing anatomy
-
Changing the composition
-
Changing the camera angle
-
Changing previously approved design elements
Small adjustments after the sketch phase may still be possible depending on the situation.
7. Approval
Once a sketch, design, composition, or other stage has been approved by the client, changes to that approved stage may require an additional fee.
Please make sure you are happy with each stage before approving it, as major changes later in the process can require significant additional work.
8. Payment
Work begins once at least 50% of the total price has been paid.
The remaining balance must be paid before the final high-resolution artwork is delivered.
Watermarked or lower-resolution previews may be provided before final payment, but the final high-resolution files will only be delivered once the remaining balance has been paid.
I currently accept payment through PayPal.
9. Cancellation & Abandonment
Payments are non-refundable once the commission process has begun.
If the client cancels the commission after work has started, payments already made will not be refunded.
If the client becomes unresponsive for an extended period of time (generally 30 days) without prior arrangement, the commission may be considered abandoned and payments already made will not be refunded.
10. Deadlines & Client Delays
The deadline depends on the complexity of the project. Most commissions are completed within 14 days, but larger or more complicated projects may take longer. I will provide an estimated timeline in advance.
Estimated completion times assume timely responses and feedback from the client.
Delays in receiving references, feedback, approvals, payment, or other necessary information from the client may extend the estimated completion date.
11. Source Files
Source/project files such as .clip files are not included with commissions unless specifically agreed upon beforehand.
If source files are requested, an additional fee may apply.
12. Rush Commissions
Rush commissions may incur an additional fee depending on the requested deadline and my availability.
Rush requests are not guaranteed and will be accepted at my discretion.
13. Chargebacks & Payment Disputes
Please contact me first if there is an issue with a payment or commission.
By commissioning me, you agree not to initiate an unjustified chargeback or payment dispute after receiving the agreed services or artwork.
This does not prevent legitimate disputes or claims handled through PayPal's applicable policies.
14. AI Use
My artwork will not be used to train, fine-tune, test, generate, or otherwise develop AI/ML models.
This applies to both commissioned and non-commissioned artwork.
15. Delivery
The final artwork will be delivered digitally in the agreed format and resolution.
The final high-resolution files will only be delivered after the remaining balance has been paid in full.
16. Agreement
By commissioning me, you acknowledge that you have read and agreed to these terms and conditions.
Any special arrangements or exceptions must be agreed upon in writing before work begins.
