ABSENCE POLICY

I understand that once I register, if I am late for my competition, as stated in the rules, I will not be allowed to compete.  Additionally, I understand that the Registration Fee is non-refundable.       *
LIABILITY WAIVER

I, of my own free will, I am allowing my applicant to participate in an audition for a program offered by Pilates Dance and More Productions, Inc., herein referred to as "PDM Productions, Inc." I understand that, like any activity, participation in the performing and fine arts-related programs may present some unavoidable risk of injury, especially to people who have pre-existing conditions, illnesses, or medical disabilities. I understand that the use of various types of instruments, apparatuses, equipment, props, etc., also carries with it a risk of injury.  I recognize that many changes may occur as a result of participation in any of the activities, rehearsals, workshops, or performances; including possible short-term aggravation of some symptoms, feeling of tiredness, light-headedness, increased energy, mood changes, etc. I also understand that a medical evaluation is advisable before commencing any program of physical or mental development. I have and will continue to keep PDM Productions, Inc., its owners, employees, volunteers, and contractors, fully informed of any physical or mental condition or disability which would prevent or limit my applicant's participation in any of the activities in which he/she is engaged. I also acknowledge that neither PDM Productions, Inc., its officers, employees, or volunteers are engaged in the diagnosis or treatment of any medical disease or deficiency, (whether physical, mental, or emotional) expressly assume all risks of my and/or my applicant's participation in any of the programs offered by PDM Productions, Inc. and waive any claim which I might otherwise bring against Pilates Dance and More Productions, Inc. doing business as PDM Productions, Inc., its officers, directors, shareholders, employees, volunteers, sponsor organizations (including Manchester High School) or contractors as a result of any injury or illness (including COVID-19) resulting from or related to my participation in any PDM Productions, Inc. programs. PDM Productions, Inc. its officers, directors, shareholders, employees, volunteers, sponsor organizations (including Manchester High School) contractors shall not be responsible or liable for any articles lost, stolen, or damaged during, in or about any location of activities. *
PHOTOGRAPHY & INFO RELEASE FORM

PDM Productions, Inc. frequently takes photographs to help in keeping records of performances, workshops, special events, rehearsals, and various activities, as well as for use in promotions and advertisements and “photo journal”. These images may be used in print materials on any of PDM Productions websites (PAPARAZZOTALENT.com and THENUTCRACKERSWEET.COM) Facebook OR Instagram page, DVDs/Digital Video, and other forms of social media. Everyone who participates in any of our activities may be intentionally, or unintentionally, photographed. By checking below, I hereby give PDM Productions, Inc. permission to take photographs of me and/or my applicant(s), for use in any and all forms of their promotions, advertisements, website, Facebook page, and any other form of social media that PDM Productions, Inc. may use. I understand that no names will accompany any of the photographs at any time without my written consent. I also understand that as a performer image(s) will not be intentionally shared with other organizations or individuals of any kind.  *
COVID-19 ASSUMPTION OF RISK AND RELEASE OF LIABILITY

PDM Productions Inc. Inc is committed to providing a safe and healthy environment for its employees, participants, and other guests. As a result, PDM Productions Inc has implemented the foregoing policies and procedures, which are subject to change based on government guidance. Although preventive measures are in place and will be adhered to, given the novel nature of COVID-19 and the rapid pace at which it spreads, PDM Productions Inc. cannot guarantee that you, the participants, or others will not be exposed to or become infected with coronavirus. By accessing the rehearsal and performance buildings and attending the rehearsals and performances, you may be putting yourself, your participant, and others at increased risk for contracting coronavirus.  

By signing below, you understand, acknowledge, and agree to the following:
 
• You assume the risk that you, your participant, and others may be exposed to or become infected with coronavirus and that such exposure and/or infection may result in death; personal injury; illness, causing mild symptoms such as, fever or body aches, or more severe complications, such as pneumonia or organ failure; or permanent disability 

• You understand that the risk of exposure to or infection with coronavirus may result from the acts, omissions, or negligence of PDM Productions Inc., Manchester High School or others, including but not limited to, the faculty, staff, volunteers, guests of PDM Productions, Inc, and program participants and their families; and from persons in facilities being rented by PDM Productions, Inc.

• You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself, your participant, or others (including, but not limited to, personal injury, disability or death), or any illness, damage, loss, claim, liability or expense (including medical bills, attorneys’ fees and court costs), of any kind, that you, your performer, or your family members may experience or incur in connection with your participant’s access to Manchester High School buildings used by PDM Productions, Inc. or his/her participation in the Program provided by PDM Productions, Inc. (collectively, “Claims”)

• Participants and his/her assignees, heirs, parents, guardians, and legal representatives hereby release, covenant not to sue, discharge and hold harmless PDM Productions, Inc., and its officers, directors, employees, faculty, staff, participants, agents, representatives, affiliates, successors, and assigns (collectively “Releasees”) of and from all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or related to the performer’s or the performer’s family members’ or guardians’ access to Manchester High School buildings or participation in the Program provided by PDM Productions, Inc., whether arising out of the negligent acts or omissions of any Releasee or otherwise, and whether any coronavirus infection or exposure occurs before, during or after access to Manchester High School buildings or participation in the Program provided by PDM Productions, Inc,  
 
• You understand that by signing this release, you are voluntarily waiving any and all Claims, known and unknown, including those Claims that may be unknown to you, or which you do not suspect to exist at this time.  

• If any provision of this release is held to be unenforceable by a court of competent jurisdiction, then (a) this release shall be deemed to be amended to the extent necessary to render the otherwise unenforceable provision, and the rest of the release, valid and enforceable, or, alternatively (b) the invalidity or unenforceability of any provision of this release shall not affect the validity or enforceability of the remaining provisions, which shall be enforced as if the offending provision had not been included in this release. Releasees are third-party beneficiaries to this release and shall have the right to enforce it to the full extent permitted by law.

• By selecting "I understand and agree" below I acknowledge that I have read and fully understand all of the terms of the COVID-19 release and waiver above, I have been given the opportunity to review its terms with my legal counsel, and I am voluntarily giving up substantial legal rights, including the right to sue releasees for claims, whether known or unknown, arising out of my or my participant's access to Manchester High School buildings or participation in the program provided by PDM Productions, Inc.

REGISTRATION FEE DUE TODAY

I understand there is a registration fee of $20.00 per contestant per entry that is due at the time that this application is submitted. I understand that each contestant in a group entry must submit a registration fee of $20.00 per entry. I am aware that this fee needs to be submitted via VENMO@Nutcrackersweet. Furthermore, I understand that my spot is not reserved until this application and fee has been submitted. Deadline is January 10, 2027.

 Remember that each contestant, whether a solo, duet, trio, small or large group, must complete an application for registration or the individual will not be registered and will not be allowed to participate. Remember, if you are competing multiple times you MUST complete an application for each time you are competing, otherwise you will not be registered and will not be allowed to compete. Remember to include the name/title of the group/act, as well as the number participating in the group/act.  Make sure to include your full name and make sure all of your information is complete before you submit your registration.
