RELEASE AND ASSUMPTION OF RISK FORM
WARNING! BY SIGNING THIS LEGAL DOCUMENT, YOU WILL BE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE -

In consideration of being allowed to participate in any way in the Fleetwood Badminton Club sports program, or any related events and activities organized or co-organized by the Fleetwood Badminton Club, the undersigned acknowledges and agrees that:
1. I risk bodily injury, including paralysis, dismemberment, disability, and death, and while particular rules of the sport, equipment, and discipline may reduce this risk, this risk of injury does exist, as well as the risk of damage to or loss of property; and,
2. that “activities” includes but is not limited to sports, fitness, functions, instructions, use of the facilities, participation in programs, tournaments and services provided or co-organized by Fleetwood Badminton Club and/or its directors, or any individuals related to Fleetwood Badminton Club, or any other organizations involved in the organization and co-organization of the activities; and,
3. I knowingly and freely assume all such risk; both known and unknown, even if arising from the negligence of the releases of others and agree to the terms of this waiver EVEN IF Fleetwood Badminton Club, its directors or any individuals related to Fleetwood Badminton Club, or any other organizations involved in the organization and co-organization of the Activities, found to be negligent or in breach of any duty or care or any obligation to me in my participation in the Activities involved; and,
4. I am aware that I should discuss my participation in this activity with my physician to determine the effect on my current health, and I also acknowledge my responsibility to ensure adequate medical, dental and accident insurance coverage, as well as protection of my personal possessions; and,
5. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual or unnecessary hazard during my presence or participation or if I observe any concern in my readiness for participation, I will immediately bring such to the attention of the nearest official and refrain from participation; and,
6. I, for myself, and on behalf of my heirs, next of kin, legal guardian, executors, administrators, assigns or Initial representatives in the event of my death or incapacity, assign personal representatives and next of kin, herby release, hold harmless and promise not to sue Fleetwood Badminton Club, its directors, their sponsors, their officers, volunteers, staff, agents, or anyone else involved in the organization or co-organization of the Activities, (the releasees) with respect to any and all injury and loss arising from my participation due to any cause, including but not limited to negligence (failure to use such care as a reasonably prudent and careful person would use under similar circumstances), breach of any duty imposed by law, breach of contract or mistake or error of judgement of Fleetwood Badminton Club, its directors, or any other individuals involved in the organization and co-organization of the Activities; and agree to be liable for and to hold harmless and indemnify Fleetwood Badminton Club, its directors, or any other individuals involved in the organization and co-organization of the Activities from all actions, proceedings, claims, damages, costs, demands including court costs and costs on a solicitor and client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with my, or any minor (s) that I am the parent or guardian, or my guests’ participation in Activities; and,
7. I agree to be bound by the rules and regulations of the Fleetwood Badminton Club and I hereby stipulate that I am eligible to play in the events for which I am applying and that I understand that the above mentioned make no representation or warranty with respect to the condition of the premises or the operation of the event; and,
8. I hereby grant to Fleetwood Badminton Club, its directors, or any individuals related to Fleetwood Badminton Club, or other organizations involved in the organization and co-organization of the Activities, its licensees and contractees including any photographers, television and motion picture rights including to film or videotape me during matches, narratives, personal interviews, or comment thereon for any and all commercial, news or other purposes together with the right to transfer or grant their rights to others, all without remuneration or compensation to me whatsoever.
THIS AGREEMENT shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns or Initial representatives in the event of my death or incapacity.
IN ENTERING INTO THIS AGREEMENT, I am not relying upon any oral or written representations or statements Initial made by the Releasees other than what is set forth in this agreement. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS OR ASSIGNS MAY HAVE AGAINST THE RELEASE.
This is to certify that I/We as parent(s)/ guardian(s) with legal responsibility for this participant do consent and agree not only to his/her release, but also for myself, ourselves and my/our child involvement as stated above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
