1. As a participant in ZUMBA with AYA, and any type of fitness class offered by Aya Zaghloul, I recognize that all of the classes offered require physical exertion that may be strenuous and may cause physical injury, including death, and I am fully aware of the risks and hazards involved. 2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in ZUMBA with AYA and any other fitness classes offered by Aya Zaghloul. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in ZUMBA with AYA classes and any other classes led by Aya Zaghloul.
3. In consideration of being permitted to participate in ZUMBA with AYA, I agree to assume full responsibility for any risks, injuries or damages (known or unknown), property damage or loss of any kind, which I may incur as a result of participating in ZUMBA with AYA. This also applies to any type of class led by Aya Zaghloul.
4. In further consideration of participating in ZUMBA with AYA, I knowingly, voluntarily and expressly waive any claim that I may have against Aya Zaghloul, for any injuries or damages (known or unknown), property damage or loss of any kind, including death, that I may sustain as a result of participating in any classes offered by ZUMBA by AYA, offered by Aya Zaghloul at any given location. This further applies to all classes led by Aya Zaghloul at any location.
5. This is a legally binding Release, Waiver, Discharge and Covenant Not to Sue (collectively “Release”) the authorized instructor, Aya Zaghloul for any injury, death, property damage or loss of any kind caused by my voluntary participation in any ZUMBA with AYA classes as well as any other type of fitness classes offered by Aya Zaghloul. This Release Waiver Discharge and Covenant Not to Sue is signed voluntarily by me, the undersigned Releasor, on my own behalf, and on behalf of my heirs, executors, administrators, and legal representatives.
6. By registering for classes or events, I acknowledge and grant ZUMBA with AYA permission to use my likeness in photographs and/or videos for promotional and marketing purposes. This includes, but is not limited to, publications, advertisements, social media, website content, and any other promotional materials, without any payment or consideration provided.I acknowledge that these photographs and/or videos become the exclusive property of ZUMBA with AYA and will not be returned. The attendee authorizes ZUMBA with AYA to use, edit, copy, publish, or exhibit any photo or video for any lawful purpose related to the promotion of the studio.
I also waive the right to review or approve any photo or video before it is used and releases ZUMBA with AYA from any claims or demands arising out of the use of their likeness, including but not limited to any claims for royalties or compensation.
Please note that photographs and videos may be taken during classes and events, and some of them may be shared on the ZUMBA with AYA website, social media platforms, or other promotional materials. If you do not wish to have your picture or video made public, kindly inform instructor, Aya. 7. I have read the above release waiver of liability and assumption of risk. I fully understand its contents and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be on the complete and unconditional release of all liability. I voluntarily agree to the terms and conditions stated above. This agreement remains in effect for as long as I participate in any classes led by Aya Zaghloul leading as an instructor.
